EVANSTON CITY COUNCIL Second Regular Meeting April 20th, 2021 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of April was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. The meeting was also streamed live. Council member Ottley led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, Tib Ottley, Evan Perkes, David Welling, Mike Sellers and Mikal Welling. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Treasurer, Trudy Lym; Public Works Director, Gordon Robinson; City Engineer, Dean Barker; City Clerk, Diane Harris ; Director of Parks and Recreation, Scott Ehlers; and Police Chief, Jon Kirby. Community Development Director, Rocco O’Neill was excused. A group of interested citizens were also present. Approve Agenda Council member D. Welling moved, Council member Ottley seconded to approve the agenda. The motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, Welling, Sellers, M. Welling. Welling. Council Comments Council member Perkes remarked that he had seen the scooters around town and how great that is. He reminded everyone to be careful on them. Council member Welling commented on the resignation of one of our Police Officers and retirement of one of our Community Services Officers. He thanked them for their service and wished them well. Council member Sellers recognized and thanked the Department Heads for the great job they do. Council member M. Welling and Mayor Williams reiterated the previous remarks. Consent Agenda Council member Welling moved, Council member Ottley seconded, to approve the following Consent Agenda Item: Parade Route requested by Jim Davis and Celeste Olson for the Annual All Alumni Noise Parade on Saturday, July 3rd, 2021 beginning at 10:00 a.m. at the Uinta County Library Parking Lot and ending at Depot Square. The motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, Welling, Sellers, M. Welling. ORDINANCE 21-01 AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SUBSECTION A. AND ENACTING SUBSECTION F. OF SECTION 4-9 OF CHAPTER 4, ALCOHOLIC BEVERAGES, TO REDUCE THE PUBLICATION AND POSTING REQUIREMENTS FOR A NOTICE OF A LIQUOR LICENSE APPLICATION AND SPECIFYING THE APPEAL PROCEDURE FOR A DENIED RENEWAL LICENSE. The motion to pass Ordinance 21-01 on second reading passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, Welling, Sellers, M. Welling.  ORDINANCE 21-02 AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING ENACTING SECTION 4-12.2 OF CHAPTER 4, ALCOHOLIC BEVERAGES, TO ENABLE CERTAIN LIQUOR LICENSEES TO DELIVER ALCOHOL LIQUORS AND MALT BEVERAGES TO CUSTOMERS. The motion to pass Ordinance 21-02 on second reading passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, Welling, Sellers, M. Welling. ORDINANCE 21-03 Council member Perkes sponsored Ordinance 21-03. Council member Welling moved, Council member Ottley seconded, to pass Ordinance 21-03 on first reading. AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 4-1 OF CHAPTER 4, ALCOHOLIC BEVERAGES, BY MODIFYING THE DEFINITION OF RESTAURANT AND AMENDING SECTION 4-24 TO PROVIDE THAT RESTAURANT LIQUOR LICENSEES SHALL HAVE DESIGNATED DISPENSING AREAS AND NOT OPERATE THE RESTAURANT AS A BAR. The motion to pass Ordinance 21-03 on first reading passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, Welling, Sellers, M. Welling. RESOLUTION 21-18 Council member Lynch introduced Resolution 21-18. Council member Lynch moved, Council member M. Welling seconded, to adopt Resolution 21-18. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING AN APPLICATION FOR A GRANT FROM THE WYOMING OFFICE OF HOMELAND SECURITY TO OBTAIN FUNDS WHICH ARE DESIGNATED FOR LAW ENFORCEMENT TERRORISM PREVENTION-ORIENTED ACTIVITIES AND EQUIPMENT. WHEREAS, there are funds available from the Wyoming Office of Homeland Security which could be used by the City for law enforcement terrorism prevention-oriented activities and equipment; and WHEREAS, it is in the public’s interest for the City of Evanston to apply for the grant funds; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The Chief of Police is authorized to submit on behalf of the City the application for a Grant from the Wyoming Office of Homeland Security to obtain funds for law enforcement terrorism prevention-oriented equipment. RESOLUTION 21-19 Council member Sellers introduced Resolution 21-19. Council member Sellers moved, Council member Perkes seconded, to adopt Resolution 21-19. RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH M & K STRIPING TO STRIPE CROSS WALKS, STOP BARS, PARKING LOTS, DOWNTOWN PARKING AND CURBS IN THE CITY OF EVANSTON. WHEREAS, the City of Evanston and M & K Striping have reached an agreement whereby M & K Striping will provide all materials and labor specified in the agreement to stripe cross walks, stop bars, parking lots, street parking and curbs in Evanston, Wyoming; and WHEREAS, the City of Evanston and M & K Striping have set their agreement in writing, a copy of which is attached hereto; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Agreement between the City of Evanston and M & K Striping, a copy of which is attached hereto, to stripe cross walks, stop bars, parking lots, street parking and curbs within the City of Evanston. RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH AMERICAN PAVEMENT MARKING, LLC. TO STRIPE EDGE AND CENTER LINES IN THE CITY OF EVANSTON. WHEREAS, the City of Evanston and American Pavement Marking, LLC. have reached an agreement whereby American Pavement Marking, LLC. will provide all materials and labor specified in the agreement to stripe the edge and center lines on selected city streets in Evanston, Wyoming; and WHEREAS, the City of Evanston and American Pavement Marking, LLC. have set their agreement in writing, a copy of which is attached hereto; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Agreement between the City of Evanston and American Pavement Marking, LLC., a copy of which is attached hereto, to stripe the edge and center lines on selected city streets within the City of Evanston. Welling moved, Council member Ottley seconded, to adopt Resolution 21-21. RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH M & K STRIPING TO DO STREET CRACK SEAL IN THE CITY OF EVANSTON. WHEREAS, the City of Evanston has solicited quotes from qualified contractors to do street crack seal in the City of Evanston; and WHEREAS, M & K Striping submitted the lowest bid to perform the work; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Agreement between the City of Evanston and M & K Striping, a copy of which is attached hereto, to do street crack seal within the City of Evanston as specified in the Agreement. RESOLUTION 21-22 Council member Sellers introduced Resolution 21-22. Council member Sellers moved, Council member Lynch seconded, to adopt Resolution 21-22. RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF A PLANNED MAINTENANCE AGREEMENT AND ADDENDUM WITH CUMMINS INC TO PROVIDE MAINTENANCE FOR ELECTRIC GENERATORS USED BY THE CITY. WHEREAS, the City has a need to maintain generators used by the City to provide services to its citizens; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, a Planned Maintenance Agreement and Addendum with Cummins Inc to provide maintenance for generators used by the City, a copy of the Agreement and Addendum is attached hereto.
