EVANSTON CITY COUNCIL First Regular Meeting June 1st, 2021 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of June was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. The meeting was also streamed live. Council member Perkes led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, Tib Ottley, Evan Perkes, David Welling, Mike Sellers and Mikal Welling. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Director of Engineering and Planning, Dean Barker; Public Works Director, Gordon Robinson; Police Lieutenant Ken Pearson; Community Development Director, Rocco O’Neill; and Director of Parks and Recreation, Scott Ehlers. Police Chief Jon Kirby was excused. A group of interested citizens were also present. Approve Agenda Council member Welling moved, Council member Ottley seconded, to approve the agenda. Council Comments Council member Welling recognized how exceptional the Cemetery looked over the Memorial Day holiday weekend. He recognized the hard work of Parks and Rec under the direction of Scott Ehlers. Council member Sellers recognized some elderly people around town, picking up garbage. Mayor Williams remarked that he hoped everyone had a good Memorial Day holiday. He mentioned that he hoped everyone remembers what that holiday is really about and that we never forget. Motion/North Ridge Council member Lynch moved, Council member Welling seconded to release retainage to North Ridge for the Evanston Railyards Roundhouse Windows and Masonry project in the City of Evanston. The motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, Welling, Sellers, M. Welling. Public Hearing/Hartzell Annexation City Attorney, Dennis Boal conducted a public hearing to receive public information, input, comments, and concerns regarding the annexation of real property as requested in the Petition to Annex submitted by Casey L. Hartzell and Jana L. Hartzell. City Engineer, Dean Barker gave an overview and brief summary of the annexation. Eric Wall of Uinta Engineering, representing Casey L. and Jana L. Hartzell, also gave a brief summary of the annexation. No one else addressed the issue and Mr. Boal closed the hearing. Presentation A Sponsor of the Year Award was presented to the City of Evanston from Evanston Cowboy Days President, Dustin Matthews accompanied by the Cowboy Days Queen and Princess.  Consent Agenda Council member M. Council member Welling moved, Council member Perkes seconded, to pass Ordinance 21-04 on first reading. AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING, ANNEXING THE REAL PROPERTY MORE PARTICULARLY DESCRIBED HEREIN AS REQUESTED IN THE PETITION TO ANNEX SUBMITTED BY CASEY L. HARTZELL AND JANA L. HARTZELL. WHEREAS, the governing body of the City of Evanston, Wyoming, did on the 4th day of May, 2021, pass a Resolution declaring the intention of the City to annex real property into the City of Evanston upon the Petition to Annex filed by Casey L. Hartzell and Jana L. Hartzell; and WHEREAS, an annexation report as specified in W.S. §15-1-402 has been prepared for the subject property; and WHEREAS, said Resolution set a hearing for the 1st day of June, 2021, at 5:30 p.m., at the City Council Chambers at City Hall of the City of Evanston, to receive comments from members of the public, to determine if the proposed annexation meets the conditions of W.S. 15-1-402 and if the required procedures have been met; and WHEREAS, notice of the hearing and the annexation report has been published and provided to all landowners and public utilities as required by W.S. 15-1-402 and W.S. 15-1-405; and WHEREAS, after considering the evidence presented at the hearing, the governing body for the City of Evanston finds the following: (i) An annexation of the area is for the protection of the health, safety and welfare of the persons residing in the area and in the city; (ii) The urban development of the area sought to be annexed would constitute a natural, geographical, economical and social part of the annexing city or town; (iii)The area sought to be annexed is a logical and feasible addition to the city and the extension of basic and other services customarily available to residents of the city shall, within reason, be available to the area to be annexed; (iv) The area sought to be annexed is contiguous with or adjacent to the city; (v) the existing utility franchises are able to serve the proposed annexed area; (vi) the terms and conditions of the Petition to Annex do exist; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, as follows: Section 1. The real property more particularly described below, is hereby annexed into the City of Evanston, Wyoming to-wit:  A tract of land in the NE ¼ NE ¼ of Section 34, T15N, R120W, 6TH P.M., Uinta County, Wyoming, said tract being more particularly described as follows: COMMENCING at the Northeast corner of said Section 34, running thence S 89°22'22" W, 74.04 feet along the North line thereof; to the Easterly boundary of the Grass Valley Addition to the City of Evanston-Amended; thence S 24°35'02" E, 176.91 feet along said Easterly boundary; thence S 0°09'15" W, 107.98 feet along said Easterly boundary to the Southeast corner thereof; thence S 65°27'27" W, 305.51 feet along the Southerly boundary thereof to the POINT OF BEGINNING; thence S 24°32'33" E, 30.00 feet; thence S 65°27'27" W, 300.00 feet; thence N 24°32'33" W, 80.00 feet; thence N 65°27'27" E, 150.00 feet to the Westerly boundary of said Grass Valley Addition; thence S 24°32'33" E, 50.00 feet along said Westerly Boundary to the Southwest corner thereof; thence N 65°27'27" E, 150.00 feet along Southerly boundary to the POINT OF BEGINNING. Section 2. A certified copy of this annexation ordinance and an annexation map prepared pursuant to W.S. 15-1-402 shall be filed with the County Clerk of Uinta County, Wyoming. RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE ACCEPTANCE OF A PROPOSAL FROM PORTER, MUIRHEAD, CORNIA & HOWARD TO PROVIDE THE CITY AUDIT SERVICES FOR THE YEAR ENDING ON JUNE 30 2021. WHEREAS, it is necessary for the City of Evanston to obtain an financial audit each and every year; WHEREAS, Porter, Muirhead, Cornia & Howard has submitted a proposal to the City of Evanston to perform the financial audit for the year ending on June 30, 2021; WHEREAS, the governing body has determined that acceptance of the proposal is in the public’s interest; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The proposal from Muirhead, Cornia & Howard to perform the financial audit for the City of Evanston for the year ending on June 30, 2021 is hereby accepted. Section 2: The Mayor and City Clerk are hereby authorized to sign and attest all documents necessary to accept the proposal from Porter, Muirhead, Cornia & Howard, a copy of which is attached hereto, to provide the audit services. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH FORSGREN ASSOCIATES, INC. TO PROVIDE ENGINEERING CONSTRUCTION MANAGEMENT SERVICES FOR THE 18th,19TH STREET AND WEST SUMMIT WATERLINE REPLACEMENT PROJECT. WHEREAS, the City of Evanston and Forsgren Associates, Inc. have negotiated an agreement whereby Forsgren Associates, Inc. will perform the services set forth in the Agreement for the 18th, 19th Street and West Summit Waterline Replacement Project; and WHEREAS, the City of Evanston and Forsgren Associates, Inc. have set their agreement in writing, a copy of which is attached hereto; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Agreement between the City of Evanston and Forsgren Associates, Inc., a copy of which is attached hereto, for engineering and construction management services necessary for the 18th, 19th Street and West Summit Waterline Replacement Project. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING AN APPLICATION TO OBTAIN A BULLET PROOF VEST PARTNERSHIP GRANT FROM THE U.S. DEPARTMENT OF JUSTICE. WHEREAS, grant funds are available from the U.S. Department of Justice which are to be used to assist in th purchase of bullet proof vests for the police department; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The Police Department of the City of Evanston is authorized to apply for a Bullet Proof Vest Partnership Grant from the U.S. Department of Justice. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF A CONTRACT WITH THE WYOMING DEPARTMENT OF HEALTH TO CONTINUE CORONAVIRUS SURVEILLANCE THROUGH THE TESTING OF THE CITY’S UNTREATED WASTEWATER. WHEREAS, the City of Evanston has the opportunity to continue a program conducted by the Wyoming Department of Health to ascertain the level of coronavirus that may exist in the community by testing its untreated waste water; and WHEREAS, the governing body has determined that it is in the public interest to continue participation in the program; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The Mayor is hereby authorized to sign and the City Clerk attest the Contract between the Wyoming Department of Health and the City of Evanston Wastewater Treatment Plant, a copy of which is attached hereto. Resolution 21-42 Council member Ottley introduced Resolution 21-42. Council member Ottley moved, Council member Welling seconded, to adopt Resolution 21-42. RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF A MEMORANDUM OF UNDERSTANDING BETWEEN THE HISTORIC PRESERVATION COMMISSION FOR THE CITY OF EVANSTON,(HPC), AND THE CITY OF EVANSTON TO FACILITATE THE RESTORATION OF THE HISTORIC UNION PACIFIC SWITCH ENGINE IN SECTION 2 OF THE ROUNDHOUSE. WHEREAS, the HPC has accepted the responsibility for the restoration to running condition of the historic Union Pacific 4420 switch engine belonging to the City of Evanston, (the Steam Engine); and WHEREAS, the HPC has moved the Steam Engine from static display in a city railroad park to Section 2 of the Roundhouse for the purpose of said restoration; and WHEREAS, the City and the HPC agree that it is in the public interest to enter into a Memorandum of Understanding setting forth the responsibilities of the parties with respect to restoring the Steam Engine in Section 2 of the Roundhouse; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor and City Clerk are hereby authorized to execute and attest on behalf of the City of Evanston, the Memorandum of Understanding between the Historic Preservation Commission for the City of Evanston and the City of Evanston to facilitate the restoration of the historic Union Pacific Switch Engine in Section 2 of the Roundhouse, a copy of which is attached hereto.  PASSED, APPROVED AND ADOPTED this 1st day of June, 2021. Public Participation Kayne Pyatt of the Uinta County Herald reported that Laurie Lambert, Head of the National Tennis Association in Utah was available at the tennis courts talking about tennis to a group of interested children.
