EVANSTON CITY COUNCIL Second Regular Meeting November 16th, 2021 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of November was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Council Member Sellers led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, Tib Ottley, Evan Perkes, Mike Sellers and Mikal Welling. Council member Welling was excused. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Clerk, Diane Harris; Director of Parks and Recreation, Scott Ehlers; Police Chief, Mike Vranish; City Treasurer, Trudy Lym; Main Street Coordinator/Grant Writer, Mieke Madrid and Senior Planner, DuWayne Jacobsen. City Engineer, Dean Barker; Public Works Director, Gordon Robinson and Community Development Director, Rocco O’Neill were excused. A group of interested citizens were also present. Welling. Revenue & Expenditure Report Council member Ottley moved, Council member Sellers seconded, to approve the Revenue and Expenditure Report for July, 2021. Council Comments Council member Perkes reminded everyone to watch for children while driving since it gets dark so early. Council member Sellers commented what a great opportunity the Nuclear Power Plant coming to Kemmerer will be. He also expressed gratitude to the Veterans Board and all who were involved in the community activities for Veteran’s Day. He reminded everyone to lend a helping hand to those in need during the Holiday Season as it can be a difficult time for people. He wished everyone a Happy Thanksgiving. Mayor Williams echoed Council member Sellers comments regarding the announcement of the Nuclear Power Plant being built in Kemmerer. He stated that it will benefit Southwest Wyoming.  Consent Agenda Council member M. Welling moved, Council member Ottley seconded, to approve the following Consent Agenda: Parade Route Permit requested by Main Street Promotions and Rachel Reifon for the Annual Parade of Lights on Thursday, December 2nd, 2021, beginning at 6:00 p.m. at the Uinta County Library parking lot on Main Street. The parade will go down Main Street to the Machine Shop Parking Lot, turn around and go down Main Street back to the Library Parking Lot and disperse. Open Container Permit requested by Main Street Promotions and Rachel Reifon for the Annual Downtown Open House on Main Street from 9th Street to 11th Street and 10th Street from Front Street to Main Street on Thursday, December 2nd, 2021, from 5:00 p.m. to 8:30 p.m. Parade Route Permit requested by Main Street Promotions for the Jingle Bell Jaunt 5K Fun Run/Walk on Saturday, December 4th, 2021, beginning at 9:00 a.m. at the Strand Theater. The motion passed unanimously with 6 yes votes: Williams, Lynch, Ottley, Perkes, Sellers, M. Welling. RESOLUTION 21-70 Council member Sellers introduced Resolution 21-70. Council member Sellers moved, Council member Perkes seconded, to adopt Resolution 21-70. RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE ACCEPTANCE AND EXECUTION OF AN AIRPORT RESCUE GRANT AGREEMENT NO. 3-56-0036-033-2022 WITH THE UNITED STATES OF AMERICA THROUGH THE FEDERAL AVIATION ADMINISTRATION FOR THE PURPOSE OF COMBATING THE SPREAD OF COVID 19 AT THE EVANSTON-UINTA COUNTY AIRPORT BURNS FIELD. WHEREAS, the Evanston-Uinta Airport Joint Powers Board has been awarded a Airport Rescue Grant from the Federal Aviation Administration to be used for reimbursement of costs related to operations, personnel cleaning and sanitation combating the spread of Covid 19 at the Evanston-Uinta County Airport Burns Field; and WHEREAS, it is necessary for the City of Evanston to accept and execute a Airport Rescue Grant Agreement No. 3-56-0036-033-2022 with the Federal Aviation Administration in order to receive the federal grant funds; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The City of Evanston hereby accepts and authorizes the execution of the Airport Rescue Grant Agreement No. 3-56-0036-033-2022 with the Federal Aviation Administration for grant funds to be used for reimbursement of costs related to operations, personnel, cleaning and sanitation combating the spread of Covid 19 at the Evanston-Uinta County Airport Burns Field. Section 2: The Mayor and City Clerk are hereby authorized to sign and attest the Grant Agreement with the Federal Aviation Administration on behalf of the City of Evanston. RESOLUTION 21-71 Council member Lynch introduced Resolution 21-71. Council member Lynch moved, Council member Sellers seconded, to adopt Resolution 21-71, including a motion to authorize a sublease. RESOLUTION OF THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF THE FIRST AMENDMENT OF THE REAL ESTATE LEASE WITH THE EVANSTON CHILD DEVELOPMENT CENTER, INC., A WYOMING NON-PROFIT CORPORATION, (ECDC). WHEREAS, the City and ECDC have entered into a Real Estate Lease, dated June 19 2019, to lease the real property and improvements, described therein, (the "Premises") except for that portion of the building and exterior grounds which were being occupied and used by Evanston Youth Club for Boys and Girls; and WHEREAS, the City and ECDC have also entered into a Lease Addendum for Leasehold Mortgages, (signed by the City on July 13, 2021), to enable ECDC to obtain a loan from USDA to fund the construction of improvements to the Premises; and WHEREAS, the Evanston Youth Club for Boys and Girls has vacated the Premises and terminated it’s Building Use Agreement with the City; and WHEREAS, the City and ECDC desire to amend the Lease to provide that ECDC shall lease from the City the entire Premises, subject to the City reserving the right to use one room for the temporary storage of personal property owned by the Evanston Youth Club for Boys and Girls; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor and City Clerk are authorized to sign and attest the attached the First Amendment of the Real Estate Lease with the Evanston Child Development Center, Inc on behalf of the City of Evanston. RESOLUTION 21-72 Council member Lynch introduced Resolution 21-72. Council member Lynch moved, Council member Sellers seconded, to adopt Resolution 21-72. RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION AND CONVEYANCE OF AN RIGHT OF WAY EASEMENT TO ROCKY MOUNTAIN POWER FOR THE INSTALLATION AND MAINTENANCE OF A ELECTRIC POWER TRANSMISSION, DISTRIBUTION AND COMMUNICATION LINES TO THE ECDC BUILDING. WHEREAS, Rocky Mountain Power has requested the City convey to it an easement for the installation and maintenance of electric power transmission, distribution and communication lines to the ECDC building which is owned by the City; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor and City Clerk are hereby authorized to sign, attest and convey the of Way Easement to Rocky Mountain Power for the installation and maintenance of electric power transmission, distribution and communication lines to the ECDC Building, a copy of which is attached hereto. Welling introduced Resolution 21-73. Council member M. Welling moved, Council member Perkes seconded, to adopt Resolution 21-73. RESOLUTION AUTHORIZING THE CITY OF EVANSTON, WYOMING TO ACCEPT AND APPROVE A RENEWAL OFFER WITH DELTA DENTAL OF WYOMING TO PROVIDE DENTAL INSURANCE FOR CITY EMPLOYEES. WHEREAS, the City of Evanston, Wyoming has for many years provided dental insurance for its employees; and WHEREAS, it is necessary for the City to accept the attached renewal offer with Delta Dental of Wyoming to continue to provide dental insurance for its employees. NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The City of Evanston hereby accepts and approves the renewal offer from Delta Dental of Wyoming, a copy of which is attached hereto and incorporated herein, to provide dental insurance for its employees. RESOLUTION 21-74 Council member Lynch introduced Resolution 21-74. Council member Lynch moved, Council member Sellers seconded, to adopt Resolution 21-74. A RESOLUTION APPROVING AND AUTHORIZING THE FINAL PLAT FOR THE LEWIS HEYREND ADDITION, A SUBDIVISION WITHIN THE CITY OF EVANSTON, WYOMING AS MORE PARTICULARLY DESCRIBED HEREIN. WHEREAS, Lewis M. Heyrend and Terrie L. Heyrend, the (“Subdivider”), has made application to the governing body of the City of Evanston, Wyoming for approval and authorization of the proposed subdivision entitled the Lewis Heyrend Addition, a subdivision located within the City of Evanston, Wyoming; and WHEREAS, the City of Evanston finds that said subdivision is a minor subdivision and can be approved pursuant to Section 22-10 of the Evanston City Code. NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming, that: Section 1.
