EVANSTON CITY COUNCIL Second Regular Meeting December 21st, 2021 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of December was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, Tib Ottley, Evan Perkes, Dave Welling, Mike Sellers and Mikal Welling. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Clerk, Diane Harris; Director of Parks and Recreation, Scott Ehlers; Community Development Director, Rocco O’Neill; Police Chief, Mike Vranish; City Treasurer, Trudy Lym; Senior Planner, DuWayne Jacobsen and Building Inspector/Engineering Tech, Bob Liechty. City Engineer, Dean Barker and Public Works Director, Gordon Robinson were excused. A group of interested citizens were also present. Approve Agenda Council member Welling moved, Council member Perkes seconded, to approve the agenda. Welling.  Council Comments Council members wished everyone a Merry Christmas and Happy New Year. Council member Perkes and Council member Welling expressed gratitude to City employees for doing a good job. Council member Welling mentioned the Wyoming Cowboys winning the Potato Bowl with a score of 52-38. Council member Sellers reminded everyone to be mindful of their neighbors and friends, as the holidays can be a difficult time for people. He also mentioned that with snow in the forecast, to thank Public Works for keeping our streets clear. Mayor Williams wished Merry Christmas to everyone including the citizens of Evanston. He expressed gratitude to everyone that stepped up while he was out sick. He had confidence that the responsibilities would continue to get done. Public Hearing City Attorney Dennis Boal conducted a public hearing to receive public comment on proposed modifications to the budget for fiscal year 2022. No one addressed the issue and the hearing was closed. ORDINANCE 21-06 Council member Perkes sponsored Ordinance 21-06. Council member Lynch moved, Council member Sellers seconded, to pass Ordinance 21-06 on first reading. AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 7-7 OF THE CITY CODE TO AUTHORIZE THE GOVERNING BODY TO ADOPT NEEDED REGULATORY BUILDING CODES BY RESOLUTION. WHEREAS, the governing body of the City of Evanston has historically adopted needed regulatory building codes for the City by undertaking the formal ordinance process of amending Section 7-7 of the City Code every few years; and WHEREAS, it makes sense from an expediency standpoint to amend Section 7-7 of the City Code to enable the Governing Body to timely adopt needed regulatory building codes by Resolution; NOW,THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: Section 7-7 of the Evanston City Code is hereby amended and reenacted as set forth below: Sec. 7-7. Adoption of Regulatory Codes. The governing body of the city is hereby authorized to adopt by Resolution, for the purpose of prescribing regulations for the minimum standards for building to safeguard life, health, property and public welfare, all needed regulatory building codes, for the City of Evanston, including without limitation, the International Building Code, the International Residential Code for One and Two Family Dwellings, the International Existing Building Code, the International Mechanical Code, the International Fuel Gas Code. the International Plumbing Code, and the National Electric Code. Welling. RESOLUTION 21-80 Council member Lynch introduced Resolution 21-80. Council member Lynch moved, Council member Welling seconded, to adopt Resolution 21-80. RESOLUTION OF THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF THE FOURTH AMENDMENT OF THE REAL ESTATE LEASE WITH OPTION PURCHASE, ENTERED INTO BY AND BETWEEN THE CITY OF EVANSTON AND THE EVANSTON GOLF CLUB.  WHEREAS, the Parties have previously entered into a Real Estate Lease with Option to Purchase, dated March 26, 2003, (the “Lease”), whereby the Golf Club leased premises from the City in the clubhouse of the Purple Sage Golf Course to operate a restaurant, bar and meeting facilities for its members and for members of the public; and WHEREAS, the Parties amended the Lease through the execution of an Amendment of the Lease, dated March 2, 2010, to reduce the rent and required hours-of-operation and thereby assist the Golf Club in attracting and retaining an operator for the restaurant and bar; and WHEREAS, the Parties entered into a Second Amendment of the Lease, dated October 16, 2012, which incrementally increased the rent to be paid by the Golf Club to the City over the five year period, commencing on April 1, 2013; and WHEREAS, the Parties entered into a Third Amendment of the Lease, which incrementally increased the rent to be paid by the Golf Club to the City over the five year period, commencing on April 1, 2018; and WHEREAS, the Parties now desire to enter into this Fourth Amendment of the Lease which will cap the rent to be paid by the Golf Club at the sum of $1,300.00 per month for the remaining term of the Lease and delete the covenant which prohibits the Golf Club from charging its tenant rent in an amount greater than the amount being charged by the City; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The City of Evanston, Wyoming is hereby authorized to execute the Fourth Amendment of the Lease, entered into by and between the City of Evanston and the Evanston Golf Club, a copy of said Fourth Amendment is attached hereto. Section 2: The Mayor is authorized to sign and the City Clerk attest the Fourth Amendment on behalf of the City of Evanston, Wyoming. PASSED, APPROVED AND ADOPTED this 21st day of December, 2021. RESOLUTION 21-81 Council member Sellers introduced Resolution 21-81. Council member Sellers moved, Council member Ottley seconded, to adopt Resolution 21-81. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE SUBMISSION OF AN APPLICATION TO THE STATE FORESTER FOR THE CITY OF EVANSTON TO BE OFFICIALLY RECERTIFIED AS A TREE CITY USA FOR YEAR 2022. WHEREAS, City of Evanston has been previously certified as a Tree City USA by the State Forester; and WHEREAS, the governing body has determined that it is in the public’s interest to apply for recertification; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The City of Evanston hereby authorizes the submission of an application to the State Forester for the City of Evanston to be recertified as a Tree City USA. Section 2. The Mayor and City Clerk are authorized to sign and attest all documents which are necessary to apply for the recertification.  PASSED, APPROVED AND ADOPTED this 21st day of December, 2021. Kent H. RESOLUTION 21-82 Council member Ottley introduced Resolution 21-82. Council member Ottley moved, Council member Perkes seconded, to adopt Resolution 21-82. A RESOLUTION AUTHORIZING ADJUSTMENTS TO THE BUDGET OF THE CITY OF EVANSTON, WYOMING FOR FISCAL YEAR ENDING JUNE 30, 2022, AND ALLOCATING SUCH FUNDS AND EXPENDITURES AMONG THE FUNDS AND DEPARTMENTS AS DESCRIBED HEREIN. WHEREAS, the City of Evanston, Wyoming has previously adopted a budget for fiscal year ending June 30, 2022, which budget estimated revenues and appropriated said expenditures to the funds and departments of the city; and, WHEREAS notice of the hearing to consider the Amendment to the Budget has been published in the newspaper as required by law.
