EVANSTON CITY COUNCIL Second Regular Meeting February 15th, 2022 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of February was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, Tib Ottley, Evan Perkes, Dave Welling, Mike Sellers and Mikal Welling. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; Director of Parks and Recreation, Scott Ehlers; Community Development Director, Rocco O’Neill; Police Chief, Mike Vranish; City Treasurer, Trudy Lym; City Engineer, Dean Barker; Senior Planner, DuWayne Jacobson; Building Inspector/Engineering Tech, Bob Liechty and Information Technology Coordinator, Preston Sheets. City Clerk, Diane Harris was excused. A group of interested citizens were also present. Approve Agenda Council member Welling moved, Council member Ottley seconded, to approve the agenda. Welling. Council Comments Council member Sellers wished the High School teams good luck at State. He also commented that he had listened to the State of the State address and the Governor spoke of the importance of suicide prevention. He encouraged everyone to watch for signs and be mindful of others. Appointment to Boards/Commissions Mayor Williams made appointments to the following boards. Welling.  Consent Agenda Council member Ottley moved, Council member Sellers seconded, to approve the following Consent Agenda Items: Street Closure Permit requested by Jon Pentz for the Evanston Car Show on Saturday, July 23rd, 2022 on Main Street from 7th Street to Harrison Drive, from 6:00 am to 5:00 pm. The motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. ORDINANCE 22-01 Council member Welling sponsored Ordinance 22-01. Council member Lynch moved, Council member M. Welling seconded, to pass Ordinance 22-01 on first reading. AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTIONS 9-3. A OF ARTICLE II OF CHAPTER 9, FIRE PREVENTION, OF THE EVANSTON CITY CODE TO ADOPT THE 2021 EDITION OF THE INTERNATIONAL FIRE CODE. WHEREAS, there is a public safety need for the City to adopt and provide for the enforcement of the most recent edition of International Fire Code; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: Section 9-3. A of the Evanston City Code is hereby amended and re-enacted to provide as follows: § 9-3. Adoption of the International Fire Code. A. There is hereby adopted by the City for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, the International Fire Code, being particularly the 2021 edition and the same is hereby incorporated in this section as if fully set out at length herein, and the provisions thereof shall be controlling within the City. Welling. RESOLUTION 22-12 Council member Sellers introduced Resolution 22-12. Council member Sellers moved, Council member Ottley seconded, to adopt Resolution 22-12. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING ADOPT THE 2021 INTERNATIONAL BUILDING CODE, THE 2021 INTERNATIONAL RESIDENTIAL CODE FOR ONE AND TWO FAMILY DWELLINGS, THE 2021 INTERNATIONAL EXISTING BUILDING CODE, THE 2021 INTERNATIONAL MECHANICAL CODE, THE 2021 INTERNATIONAL FUEL GAS CODE, THE 2021 INTERNATIONAL PLUMBING CODE AND THE 2020 NATIONAL ELECTRIC CODE PURSUANT TO SECTION 7-7 OF THE EVANSTON CITY CODE. WHEREAS, the governing body of the City of Evanston has determined that it is in the best interests of its citizens to adopt certain regulatory building codes for the purpose of prescribing regulations for the minimum standards for the construction of buildings to safeguard life, health, property and public welfare; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: Pursuant to Section 7-7 of the Evanston City Code, the City of Evanston, Wyoming hereby adopts the regulatory building codes set forth below: A. 2021 International Building Code; B. 2021 International Residential Code for One and Two Family Dwellings, exempting therefrom Section R313.2 One-and two-family dwelling automatic fire systems; C. 2021 International Existing Building Code; D. 2021 International Mechanical Code; E. 2021 International Fuel Gas Code; F. 2021 International Plumbing Code; and the G. 2020 National Electric Code. RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF A CONTRACT FOR SERVICES WITH THE EVANSTON RODEO SERIES, A WYOMING NON PROFIT CORPORATION. WHEREAS, the City of Evanston has a strong interest in promoting tourism within the community; and WHEREAS, the Evanston Rodeo Series increases tourism within the community by promoting and increasing the use of the Uinta County Fairgrounds through the Evanston Rodeo Series; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Contract for Services with Evanston Rodeo Series, a Wyoming non profit corporation, a copy of which is attached hereto. RESOLUTION 22-14 Council member Lynch introduced Resolution 22-14. Council member Lynch moved, Council member Welling seconded, to adopt Resolution 22-14. A RESOLUTION APPROVING AND AUTHORIZING THE FINAL PLAT FOR THE RUIZ ADDITION, A SUBDIVISION WITHIN THE CITY OF EVANSTON, WYOMING AS MORE PARTICULARLY DESCRIBED HEREIN. WHEREAS, Rodney Glen Ruiz and Kristina Marie Ruiz, (the “Subdivider”), has made application to the governing body of the City of Evanston, Wyoming for approval and authorization of the proposed subdivision entitled the Ruiz Addition, a subdivision located within the City of Evanston, Wyoming; and WHEREAS, the City of Evanston finds that said subdivision is a minor subdivision and can be approved pursuant to Section 22-10 of the Evanston City Code. NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming, that: Section 1. The final plat of the Ruiz Addition is hereby approved, accepted and authorized and described in particularity as follows, to-wit: "Ruiz Addition" to the City of Evanston, Uinta County, Wyoming, is a replat of Lot 2, Block 1, Sepulveda Addition to the City of Evanston as said Sepulveda Addition is platted and recorded in the Office of the Uinta County Clerk, said "Ruiz Addition" being located in the E1/2 SE1/4 of Section 21, Township 15 North, Range 120 West, 6th P.M., Uinta County, Wyoming, lying entirely within the corporate limits of the City of Evanston, and being more particularly described as follows: BEGINNING at the Northernmost corner of said Lot 2, Block 1 and running thence S 47°11'00" E, 294.86 feet along the Northeastery boundary of said Lot 2, Block 1 to the Easternmost corner thereof; thence S 42°49'19" W, 240.19 feet along the Southeasterly boundary of said Lot 2, Block 1 to the Southernmost corner thereof; thence N 47°09'50" W, 294.84 feet along the Southwesterly boundary of said Lot 2, Block 1 to the Westernmost corner thereof; thence N 42°49'00" E, 240.09 feet along the Northwesterly boundary of said Lot 2, Block 1 to the POINT OF BEGINNING. Said "Ruiz Addition" containing 1.625 acres, more or less. Section 2. The Mayor and City Clerk are hereby authorized and directed to enforce the mandates of chapter 22 of the Code of the City Evanston with regard to the filing of the final plat with the County Clerk of Uinta County, Wyoming as by law required.
