EVANSTON CITY COUNCIL Second Regular Meeting March 15th, 2022 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of March was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tib Ottley, Evan Perkes, Dave Welling, Mike Sellers and Mikal Welling. Council member Lynch was excused. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; Community Development Director, Rocco O’Neill; Police Chief, Mike Vranish; Police Lieutenant, Ken Pearson; City Treasurer, Trudy Lym; City Clerk, Diane Harris; City Engineer, Dean Barker; Public Works Director, Gordon Robinson and Information Technology Coordinator, Preston Sheets. Director of Parks and Recreation, Scott Ehlers was excused. A group of interested citizens were also present. Approve Agenda Council member Welling moved, Council member Sellers seconded, to approve the agenda with the following change: remove Revenue and Expenditure Report. Welling. Council Comments Crime Stoppers had their annual Fund-raiser drawing. There were 400 tickets sold. Three lucky winners were drawn. Council member Welling reminded everyone that this weekend is the Celtic Festival. He mentioned that there is a Scavenger Hunt happening downtown. He commented that it is great to see events happening again. Council member Sellers also mentioned Celtic Festival this weekend. He congratulated Community Development Director, Rocco O’Neill on the success of Jumpstart, they just wrapped up another year. He reminded everyone to watch for signs and be mindful of others, as there are many people struggling right now. Appointment to Board Mayor Williams made an appointment to the following board. Welling. Consent Agenda Council member Ottley moved, Council member M. ORDINANCE 22-01 Council member Welling moved, Council member Ottley seconded, to pass Ordinance 22-01 on third and final reading. AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTIONS 9-3. A OF ARTICLE II OF CHAPTER 9, FIRE PREVENTION, OF THE EVANSTON CITY CODE TO ADOPT THE 2021 EDITION OF THE INTERNATIONAL FIRE CODE. WHEREAS, there is a public safety need for the City to adopt and provide for the enforcement of the most recent edition of International Fire Code; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: Section 9-3. A of the Evanston City Code is hereby amended and re-enacted to provide as follows: § 9-3. Adoption of the International Fire Code. A. There is hereby adopted by the City for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, the International Fire Code, being particularly the 2021 edition and the same is hereby incorporated in this section as if fully set out at length herein, and the provisions thereof shall be controlling within the City. Welling.  ORDINANCE 22-02 Council member Perkes sponsored Ordinance 22-02. Council member Sellers moved, Council member Ottley seconded, to pass Ordinance 22-02 on first reading. AN ORDINANCE APPROVING AND AUTHORIZING A ZONE CHANGE FOR PROPERTY IN THE CITY OF EVANSTON FROM AGRICULTURAL-ESTABLISHED TO HIGHWAY BUSINESS-DEVELOPING, AS REQUESTED BY EQUINE CAPITAL NETWORK, LLC OF THE LAND MORE PARTICULARLY DESCRIBED HEREIN. WHEREAS, Equine Capital Network, LLC has filed an application with the Planning and Zoning Commission of the City of Evanston, Wyoming to change the zoning of the property described below from a Agricultural-Established Zone to s Highway Business-Developing Zone; and WHEREAS, the owner of the property has submitted to the City it’s written consent to the proposed zone change: and WHEREAS, the Planning and Zoning Commission scheduled a public hearing to consider said application on March 7, 2022; and WHEREAS, notice of the public hearing and application was published in a newspaper of general circulation and notices of the hearing were mailed to affected landowners pursuant to City Ordinance; and WHEREAS, a public hearing was held by the Planning and Zoning Commission of the City of Evanston on March 7, 2022, to consider said application for a zone change; and WHEREAS, after receiving testimony and evidence from the applicant, affected landowners and the public at large, the Planning and Zoning Commission voted to recommend to the governing body that it approve the zone change. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, THAT: Section 1. The request of the Equine Capital Network, LLC, to change the zoning of the property described below, from a Agricultural -Established Zone to a Highway Business-Developing Zone is hereby approved and authorized. Said real property being more particularly described as follows: A tract of land in the NW ¼ NW ¼ of Section 29 and the NE ¼ of Section 30, T15N, R120W, 6TH P.M., in the City of Evanston, Uinta County, Wyoming, said tract being more particularly described as follows: BEGINNING at the Northwest corner of said Section 29, running thence S 89°50'02" E, 147.08 feet along the North line thereof to the West boundary of Overthrust Road; thence the following four (4) courses along said West boundary: S 35°13'19" W, 67.35 feet to the Point of Curvature of a curve concave to the East and having a radius of 1081.74 feet; thence Southerly 654.24 feet along the arc of said curve, through a central angle of 34°39’10”, the long chord of which bears S 17°53'44" W, 644.32 feet; thence S 0°34'09" W, 1671.91 feet; thence S 0°00'39" E, 309.87 feet to the South line of said NE ¼; thence S 89°47'24" W, 2566.92 feet along said South line to the Southwest corner of said NE ¼ (Center one-quarter corner of said Section 30; thence N 0°02'57" E, 2206.54 feet to the Southerly right-of-way of Interstate Highway I-80; thence N 58°05'28" E, 842.72 feet along said Southerly right-of-way line to the North line of said Section 30; thence N 89°46'27" E, 1955.97 feet along said North line to the POINT OF BEGINNING. RESOLUTION 22-17 Council member Welling introduced Resolution 22-17. Council member Welling moved, Council member Sellers seconded, to adopt Resolution 22-17. RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE CITY OF EVANSTON TO ENTER INTO A LICENSE AGREEMENT WITH UNION TELEPHONE COMPANY, TO PROVIDE ACCESS AND UTILITIES TO A CELLULAR COMMUNICATIONS SITE. WHEREAS, Union Telephone Company has requested the City enter into a License Agreement to provide access and utilities to a cellular communications site; and NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The City of Evanston, Wyoming is hereby authorized to enter into the License Agreement to provide access and utilities to a cellular communications site, a copy of which is attached hereto. Section 2: The Mayor is authorized to sign and the City Clerk attest the License Agreement on behalf of the City of Evanston, Wyoming. PASSED, APPROVED AND ADOPTED this 15th day of March, 2022. RESOLUTION 22-18 Council member Ottley introduced Resolution 22-18. Council member Ottley moved, Council member M. Welling seconded, to adopt Resolution 22-18. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF A PROFESSIONAL SERVICES AGREEMENT WITH HAZEN AND SAWYER TO PROVIDE ENGINEERING SERVICES FOR THE EVANSTON WATER TREATMENT PLANT PROCESS IMPROVEMENT STUDY. WHEREAS, the City of Evanston and Forsgren Associates, Inc. have negotiated an agreement whereby Hazen and Sawyer will perform the services set forth in the Professional Services Agreement for the Evanston Water Treatment Plant Process Improvement Study; and WHEREAS, the City of Evanston and Hazen and Sawyer have set their agreement in writing, a copy of which is attached hereto; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Professional Services Agreement between the City of Evanston and Hazen and Sawyer, for the Evanston Water Treatment Plant Process Improvement Study, a copy of which is attached hereto PASSED, APPROVED AND ADOPTED this 15th day of March, 2022.  Kent H.
