EVANSTON CITY COUNCIL First Regular Meeting October 4th, 2022 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of October was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live. Council member Welling led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, David Welling, Mike Sellers and Mikal Welling. Council Comments Council member Sellers commented that the fall weather has been so nice, and he hopes everyone has been enjoying it. Consent Agenda Council member Welling moved, Council member Lynch seconded, to approve the following Consent Agenda Items: Open Container and Street Closure Permit requested by Downtown Evanston Promotions/Kate’s - for the 4th Annual Fall Main Street Bash on Saturday, October 8th, 2022, on Main Street from 9th Street to Harrison Drive, from noon to midnight. Open Container Permit requested by Downtown Evanston Promotions for the Annual Hunters’ Widows Night Out, on Main Street from 7th Street to Harrison Drive; 10th Street and 7th Street from Front Street to Main Street, on Thursday, October 20th, 2022, from 5:00 pm to 8:00 pm. Street Closure Permit requested by Downtown Evanston Promotions for the Annual Downtown Trick-or- Treating on Monday, October 31st, 2022, on Main Street from 7th Street to Harrison, from 4:00 pm to 6:00 pm. The motion passed unanimously with 5 yes votes: Williams, Lynch, Welling, Sellers, M. Welling. ORDINANCE 22-04 Council member Welling moved, Council member M. Welling seconded, to pass Ordinance 22-04 on second reading. AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 24-105 OF CHAPTER 24, ZONING, OF THE CITY CODE TO ALLOW MORE THAN ONE KITCHEN IN A DWELLING UNIT. WHEREAS, the definition of “Dwelling Unit” in Section 24-105 currently provides that there may be only one kitchen in a dwelling unit used for single family occupancy; and WHEREAS, there has been a demonstrated need to amend the ordinance to allow more than one kitchen in dwelling unit and at same time, not increase the density of residential neighborhoods; and WHEREAS, the Planning and Zoning Commission held a public hearing on September 13, 2022, to receive comments, information and input from the public regarding the proposed amendments to the definitions of “Dwelling Unit” and “Kitchen” in Section 24-105 of the code which would allow for more than one kitchen in a dwelling unit, and yet, not increase the density of the neighborhood; and WHEREAS, notice of the public hearing was published in a local newspaper of general circulation at least fifteen days in advance of the hearings; and WHEREAS, as a result of the hearing, the Planning and Zoning Commission forwarded a positive recommendation to the Governing Body of the City of Evanston to amend the definitions of “Dwelling Unit” and “Kitchen” as set forth below; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Definitions of “Dwelling Unit” and “Kitchen” set forth in Section 24-105 of Chapter 24 of the Evanston City Code are hereby amended and re-enacted to provide as follows: § 24-105. Definitions and standards enumerated. DWELLING UNIT - One or more rooms in a dwelling or portion thereof, used and designed and intended to be used for occupancy by one family or a group living together as a single unit as described in Section 24-17 of the Evanston City Code, including permanent provisions for living, cooking, eating, sleeping and sanitation. KITCHEN -That portion of a dwelling unit devoted to the cooking or preparation of food for the purpose of consumption by residents of the dwelling unit. The term includes a 'kitchenette', 'wet bar' or any area equipped with items such as a counter-top hot plate, counter-top grill, or microwave oven, together with an under- counter refrigerator and sink. 'Full kitchen facilities' indicates the presence of complete cooking facilities (i.e. stove, oven or microwave oven, refrigerator, and sink). The presence within any food preparation area of a ventilation hood, gas stub, 220-volt electrical outlet or wiring, or any combination thereof, shall be considered a 'full kitchen facility'. Water Department Truck Council member Lynch moved, Council member Sellers seconded, to accept the apparent low bid for a 2022 Ford 250/2500 3/4 Ton Crew Cab 4WD long Wheelbase Pickup with Flip Top Service Body to Greiner Schmidt Motors in Casper, WY. The motion passed unanimously with 5 yes votes: Williams, Lynch, Welling, Sellers, M. Welling. Department Comments Director of Public Works, Gordon Robinson reported on the water line leak on 6th Street between Front Street and Main Street. It went well and is taken care of.
