EVANSTON CITY COUNCIL Second Regular Meeting November 15th, 2022 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of November was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, Evan Perkes, Dave Welling, Mike Sellers and Mikal Welling. Tib Ottley appeared by video. Welling. Council Comments Council member Perkes reminded everyone to be sure to clean off their windshield in the early morning. He said he has noticed many people trying to drive without their windshield being cleaned off and what a safety hazard that is. Council member Sellers commented that since the holidays are approaching, be mindful of how people are feeling and acting. Suicides tend to increase around the holidays. Also, he mentioned that we need to educate ourselves on signs and symptoms of heart attacks. There have been a number of young adults that have lost their lives to heart attacks recently. Board Appointment Mayor Williams made an appointment to the following board. Welling. Consent Agenda Council member M. Welling moved, Council member Sellers seconded, to approve the following Consent Agenda: Parade Route Permit requested by Downtown Evanston Promotions and Rachel Reifon for the Annual Parade of Lights on Thursday, December 1st, 2022, beginning at 6:00 p.m. at the Uinta County Library parking lot on Main Street. The parade will go down Main Street to the Machine Shop Parking Lot, turn around and go down Main Street back to the Library Parking Lot and disperse. Open Container Permit requested by Downtown Evanston Promotions and Rachel Reifon for the Annual Downtown Open House on Main Street from 9th Street to 11th Street and 10th Street from Front Street to Main Street on Thursday, December 1st, 2022, from 5:00 p.m. to 8:30 p.m. Parade Route Permit requested by Urban Renewal Agency for the Jingle Bell Jaunt 5K Fun Run/Walk on Saturday, December 3rd, 2022, beginning at 9:00 a.m. at the Strand Theater. The motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, Welling, Sellers, M. Welling. Resolution 22-81 Council member Lynch introduced Resolution 22-81. Council member Lynch moved, Council member Perkes seconded, to adopt Resolution 22-81. RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF COMMERCIAL ALARM AGREEMENT WITH FIRE PROTECTION SERVICE CORPORATION TO INSTALL A FIRE MONITORING SYSTEM AT THE BEEMAN CASHIN BUILDING. WHEREAS, the City of Evanston has a need to upgrade the fire monitoring system at the Beeman Cashin Building; and NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Commercial Alarm Agreement with Fire Protection Service Corporation, a copy of which is attached, to upgrade the fire monitoring system at the Beeman Cashin Building. Resolution 22-82 Council member Welling introduced Resolution 22-82. Council member Welling moved, Council member M. Welling seconded, to adopt Resolution 22-82. A RESOLUTION OF THE CITY OF EVANSTON AUTHORIZING THE SUBMISSION OF AN APPLICATION FOR A WYOMING OUTDOOR RECREATION GRANT TO THE WYOMING STATE PARKS & CULTURAL RESOURCES DEPARTMENT FOR THE BEAR RIVER GREENWAY PHASE 5 PROJECT. WHEREAS, there is funding available through the Wyoming Outdoor Recreation Grant Program to increase and improve outdoor recreation opportunities within a community; and WHEREAS, the Bear River Greenway Phase 5 Project would use grant funds to add and improve trails and interpretive improvements to the Bear River Greenway; and WHEREAS, the Project will significantly enhance and improve recreation for tourists and members of the community at the Bear River Greenway; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The Mayor, City Clerk and the Community Development Director are hereby authorized to execute all documents necessary to submit an application for a Wyoming Outdoor Recreation Grant to the Wyoming State Parks & Cultural Resources Department for the Bear River Greenway Phase 5 Project. ORDINANCE 22-05 Council member Lynch sponsored Ordinance 22-05. Council member Welling moved, Council member Perkes seconded, to pass Ordinance 22-05 on first reading. AN ORDINANCE APPROVING AND AUTHORIZING A ZONE CHANGE FOR PROPERTY IN THE CITY OF EVANSTON FROM COMMUNITY BUSINESS DEVELOPING TO BUSINESS/LIGHT MANUFACTURING-REDEVELOPMENT, AS REQUESTED BY JAYGEE BROS AND ALL WEST COMMUNICATIONS OF THE LAND MORE PARTICULARLY DESCRIBED HEREIN. WHEREAS, Jaygee Bros. filed an application with the Planning and Zoning Commission of the City of Evanston, Wyoming to change the zoning of the property described below from a Community Business Developing Zone to a Business/light Manufacturing-Redevelopment Zone; and WHEREAS, Jaygee Bros. and All West Communications, the owners of the property, have petitioned or consented to the proposed zone change; and WHEREAS, the Planning and Zoning Commission scheduled a public hearing to consider said application on October 3, 2022; and WHEREAS, notice of the public hearing and application was published in a newspaper of general circulation and notices of the hearing were mailed to affected landowners pursuant to City Ordinance; and WHEREAS, on October 3, 2022,the Planning and Zoning Commission continued the public hearing to November 8, 2022, to allow Jaygee Bros time to obtain the written consent to the zone change from All West Communications; and WHEREAS, the public hearing was held on November 8, 2022 by the Planning and Zoning Commission to consider the application for the proposed zone change; and WHEREAS, after receiving testimony and evidence from the applicant, affected landowners and the public at large, the Planning and Zoning Commission voted to recommend to the governing body that it approve the zone change. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, THAT: Section 1. The request of Jaygee Bros. and All West Communications the to change the zoning of the property described below, from a Community Business Developing Zone to a Business/light Manufacturing-redevelopment Zone is hereby approved and authorized. Said real property being more particularly described as follows: A tract of land in the SW ¼ of Section 20, T15N, R120W, 6TH P.M., in the City of Evanston, Uinta County, Wyoming, said tract being more particularly described as follows:  BEGINNING at a point on the East line of said SW ¼ (North-South centerline of said Section 20) said point of beginning lying N 0°05'49" W, 1093.06 feet from the South one-quarter corner of said Section 20, said point of beginning also lying on the North Line of the West Cheyenne Drive Addition to the City of Evanston, said point of beginning also lying on a curve concave to the South, from which the radius point bears S 15°41'01" W, 1028.34 feet; thence Westerly 136.75 feet along said North line and the arc of said curve, through a central angle of 7°37’09”, the long chord of which bears N 78°07'34" W, 136.65 feet; thence N 81°56'08" W, 595.72 feet along said North line to the Point of Curvature of a curve concave to the South and having a radius of 822.06 feet; thence Westerly 508.69 feet along said North line and the arc of said curve, through a central angle of 35°27’17”, the long chord of which bears S 80°20'13" W, 456.72 feet thence S 62°36'35" W, 237.46 feet along said North line to the Easternmost corner of the Westgate Park Addition to the City of Evanston; thence N 39°31'39" W, 393.69 feet along the East line thereof to the Southerly right-of-way line of Interstate Highway No. I-80; thence N 50°32'28" E, 812.01 feet along said Southerly right-of-way line to the Point of Curvature of a non-tangent curve concave to the South, from which the radius point bears S 1°05'13" E, 1659.86 feet, said point of curvature being monumented with a standard WyDOT monument; thence Easterly 1000.91 feet along said Southerly right-of-way line and the arc of said curve, through a central angle of 34°33’00”, the long chord of which bears S 73°48'43" E, 985.82 feet, to a standard WyDOT monument; thence S 56°26'04" E, 124.97 feet along said Southerly right-of-way line to a point on said East line of the SW ¼ of Section 20, said point being monumented with a standard WyDOT monument; thence S 0°05'49" E, 394.20 feet along said East line to the POINT OF BEGINNING.
