EVANSTON CITY COUNCIL First Regular Meeting December 6th, 2022 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of December was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, Evan Perkes, David Welling, Mike Sellers and Mikal Welling. Tib Ottley was excused Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Police Chief, Mike Vranish; Public Works Director, Gordon Robinson; Information Technology Coordinator, Preston Sheets; Community Development Director, Rocco O’Neill; Parks/Recreation Director, Scott Ehlers; and Senior Planner, DuWayne Jacobsen. Director of Engineering and Planning, Dean Barker was excused. Approve Agenda Council member Welling moved, Council member M. Welling seconded, to approve the agenda . Welling. Council Comments Council member Sellers commented that he had received comments about how great the snow plowing had been. He reminded everyone that the Suicide Number has changed to 988. Council member Sellers also encouraged everyone to shop locally to help make a difference. Consent Agenda Council member Welling moved, Council member M. Welling seconded, to approve the following Consent Agenda Items: Parade Route Permit requested by the Evanston Police Officers Association for the Annual Shop with a Cop Parade on Saturday, December 17, 2022, beginning at 7:30 a.m. at the Hampton Inn and ending at Walmart. Parade Route Permit requested by the St. Mary Magdalen Church for the Our Lady of Guadalupe Procession on Saturday, December 10, 2022, beginning at 6:00 p.m. at the Saint Mary Magdalen Church and ending at the Machine Shop. The motion passed unanimously with 6 yes votes: Williams, Lynch, Perkes, Welling, Sellers, M. Welling. ORDINANCE 22-05 Council member Perkes moved, Council member Sellers seconded, to table Ordinance 22-05 on second reading until the January 3rd 2022 City Council Meeting. AN ORDINANCE APPROVING AND AUTHORIZING A ZONE CHANGE FOR PROPERTY IN THE CITY OF EVANSTON FROM COMMUNITY BUSINESS DEVELOPING TO BUSINESS/LIGHT MANUFACTURING- REDEVELOPMENT, AS REQUESTED BY JAYGEE BROS AND ALL WEST COMMUNICATIONS OF THE LAND MORE PARTICULARLY DESCRIBED HEREIN. WHEREAS, Jaygee Bros. filed an application with the Planning and Zoning Commission of the City of Evanston, Wyoming to change the zoning of the property described below from a Community Business Developing Zone to a Business/light Manufacturing-Redevelopment Zone; and WHEREAS, Jaygee Bros. and All West Communications, the owners of the property, have petitioned or consented to the proposed zone change; and WHEREAS, the Planning and Zoning Commission scheduled a public hearing to consider said application on October 3, 2022; and WHEREAS, notice of the public hearing and application was published in a newspaper of general circulation and notices of the hearing were mailed to affected landowners pursuant to City Ordinance; and WHEREAS, on October 3, 2022,the Planning and Zoning Commission continued the public hearing to November 8, 2022, to allow Jaygee Bros time to obtain the written consent to the zone change from All West Communications; and WHEREAS, the public hearing was held on November 8, 2022 by the Planning and Zoning Commission to consider the application for the proposed zone change; and WHEREAS, after receiving testimony and evidence from the applicant, affected landowners and the public at large, the Planning and Zoning Commission voted to recommend to the governing body that it approve the zone change. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, THAT: Section 1. The request of Jaygee Bros. and All West Communications the to change the zoning of the property described below, from a Community Business Developing Zone to a Business/light Manufacturing- redevelopment Zone is hereby approved and authorized. Said real property being more particularly described as follows: A tract of land in the SW ¼ of Section 20, T15N, R120W, 6TH P.M., in the City of Evanston, Uinta County, Wyoming, said tract being more particularly described as follows: BEGINNING at a point on the East line of said SW ¼ (North-South centerline of said Section 20) said point of beginning lying N 0°05'49" W, 1093.06 feet from the South one-quarter corner of said Section 20, said point of beginning also lying on the North Line of the West Cheyenne Drive Addition to the City of Evanston, said point of beginning also lying on a curve concave to the South, from which the radius point bears S 15°41'01" W, 1028.34 feet; thence Westerly 136.75 feet along said North line and the arc of said curve, through a central angle of 7°37’09”, the long chord of which bears N 78°07'34" W, 136.65 feet; thence N 81°56'08" W, 595.72 feet along said North line to the Point of Curvature of a curve concave to the South and having a radius of 822.06 feet; thence Westerly 508.69 feet along said North line and the arc of said curve, through a central angle of 35°27’17”, the long chord of which bears S 80°20'13" W, 456.72 feet thence S 62°36'35" W, 237.46 feet along said North line to the Easternmost corner of the Westgate Park Addition to the City of Evanston; thence N 39°31'39" W, 393.69 feet along the East line thereof to the Southerly right-of-way line of Interstate Highway No. I-80; thence N 50°32'28" E, 812.01 feet along said Southerly right-of-way line to the Point of Curvature of a non- tangent curve concave to the South, from which the radius point bears S 1°05'13" E, 1659.86 feet, said point of curvature being monumented with a standard WyDOT monument; thence Easterly 1000.91 feet along said Southerly right-of-way line and the arc of said curve, through a central angle of 34°33’00”, the long chord of which bears S 73°48'43" E, 985.82 feet, to a standard WyDOT monument; thence S 56°26'04" E, 124.97 feet along said Southerly right-of-way line to a point on said East line of the SW ¼ of Section 20, said point being monumented with a standard WyDOT monument; thence S 0°05'49" E, 394.20 feet along said East line to the POINT OF BEGINNING. Said tract containing 19.771 acres, more or less. Section 2. The City of Evanston is hereby authorized and directed to take all action necessary to implement said zone change. Council member Perkes moved, Council member Lynch seconded, to adopt Resolution 22-83. RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE ACCEPTANCE AND EXECUTION OF AMENDMENT NO. ONE TO THE GRANT AGREEMENT NO. 3-56–0036-028-2020 WITH THE UNITED STATES OF AMERICA THROUGH THE FEDERAL AVIATION ADMINISTRATION TO OBTAIN GRANT FUNDS TO RECONSTRUCT THE GENERAL AVIATION APRON AND INSTALL PERIMETER FENCING AT THE EVANSTON-UINTA COUNTY AIRPORT. WHEREAS, the Evanston-Uinta Airport Joint Powers Board was previously awarded a grant from the Federal Aviation Administration to reconstruct the aviation apron and install perimeter fencing at the Evanston-Uinta County Airport; and WHEREAS, it is necessary for the City of Evanston to accept and execute Amendment No. One to Grant Agreement No. 3-56–0036-028-2020 with the Federal Aviation Administration in order to receive additional grant funds for the Project; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The City of Evanston hereby accepts and authorizes the execution of Amendment No. One to Grant Agreement No. 3-56–0036-028-2020 the with the Federal Aviation Administration to reconstruct the general aviation apron and install perimeter fencing at the Evanston-Uinta County Airport Burns Field. Section 2: The Mayor and City Clerk are hereby authorized to sign and attest said Amendment No. One with the Federal Aviation Administration on behalf of the City of Evanston. RESOLUTION 22-84 Council member Lynch introduced Resolution 22-84. Council member Lynch moved, Council member Welling seconded, to adopt Resolution 22-84. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH MYERS ANDERSON ARCHITECTS, PLLC TO PROVIDE DESIGN AND CONSTRUCTION MANAGEMENT SERVICES FOR THE CITY HALL ROOF REPLACEMENT PROJECT. WHEREAS, the City of Evanston and Myers Anderson Architects, PLLC have negotiated an agreement whereby Myers Anderson Architects, PLLC, will provide design and construction management services for the City Hall Roof Replacement Project; and NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Agreement between the City of Evanston and Myers Anderson Architects, PLLC, a copy of which is attached hereto, to provide design and construction management services for the City Hall Roof Replacement Project. RESOLUTION 22-85 Council member Sellers introduced Resolution 22-85. Council member Sellers moved, Council member Welling seconded, to adopt Resolution 22-85. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF A REVISED GRANT AWARD AGREEMENT WITH THE WYOMING OFFICE OF HOMELAND SECURITY TO OBTAIN FUNDS WHICH ARE DESIGNATED FOR LAW ENFORCEMENT TERRORISM PREVENTION- ORIENTED ACTIVITIES AND EQUIPMENT. WHEREAS, the City has previously approved and executed on October 18, 2022, a Grant Award Agreement with the Wyoming Office of Homeland Security for grant funds to be used for law enforcement terrorism prevention-oriented activities and equipment; and WHEREAS, the Wyoming Office of Homeland Security has requested the City approve and execute a revised Grant Award Agreement in order to receive the grant funds; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The Mayor, Chief of Police and City Clerk are authorized to sign and attest on behalf of the City the attached revised Grant Award Agreement with the Wyoming Office of Homeland Security to obtain funds for law enforcement terrorism prevention-oriented activities and equipment.
