EVANSTON CITY COUNCIL Special Meeting April 11th, 2023 The official record of proceedings for a special meeting of the Evanston City Council was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:00 p.m. and welcomed everyone present. Those present from the governing body at the start of meeting were Mayor Williams; Council members Jesse Lind, Evan Perkes, David Welling, Mike Sellers and Jen Hegeman. Tim Lynch was absent. Staff members present at the start of the meeting were: City Attorney/Prosecutor, Amanda Kirby; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Police Chief, Mike Vranish; Recreation Division Manager, Kim Larson; Information Technology Coordinator, Preston Sheets; City Engineer, Dean Barker; Building Inspector/Engineering Tech, Bob Liechty and Environmental Services Manager, Brad Tollefson. Public Works Director, Gordon Robinson; and Community Development Director, Rocco O’Neill were excused. A group of interested citizens was also present. Approve Agenda Council member Welling moved, Council member Sellers seconded, to approve the agenda. The motion passed unanimously with 6 yes votes: Williams, Lind, Perkes, Welling, Sellers, Hegeman. Revenue & Expenditure Report Council member Lind moved, Council member Perkes seconded, to approve the Revenue and Expenditure Report for February 2023. The motion passed unanimously with 6 yes votes: Williams, Lind, Perkes, Welling, Sellers, Hegeman. Council Comments Council member Lind mentioned that sandbags and sand are available at the County Fairgrounds. He reminded everyone to bring your own shovel. Council member Sellers reminded everyone to be aware of people that may seem to be struggling, if anyone needs help the U.S. National Suicide Prevention Lifeline is 988 or text “WYO” to 741-741 for the Crisis Text Line. Council member Hegeman welcomed everyone and commented that is good to see people at the meetings. She remarked how great it is to watch the changes and growth in Evanston. Mayor Williams mentioned the big snowstorm last week and how the County and City buildings were closed. He expressed gratitude to Public Works for the great job removing the snow. RESOLUTION 23-27 Council member Sellers introduced Resolution 23-27. Council member Sellers moved, Council member Welling seconded, to adopt Resolution 23-27. RESOLUTION OF THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF THE ONEWYO II OPIOID SETTLEMENT MEMORANDUM OF AGREEMENT. WHEREAS, the State of Wyoming, through its Attorney General, has engaged in litigation with certain Pharmaceutical Supply Companies regarding opioid distribution which has allegedly harmed the people and communities of the State of Wyoming; and WHEREAS, one of the results of the litigation is the attached Settlement Agreement which would enable Wyoming communities like Evanston to participate and receive settlement funds to be used for opioid abatement programs; and WHEREAS, the governing body for the City of Evanston has determined that it is in the public=s interest to enter into the Settlement Agreement on behalf of the City; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The City of Evanston, Wyoming hereby approves and authorizes the execution of the OneWyo II Opioid Settlement Memorandum of Agreement, a copy of which is attached hereto. Section 2: The City Attorney is authorized to sign the OneWyo II Opioid Settlement Memorandum of Agreement on behalf of the City of Evanston, Wyoming. RESOLUTION 23-28 Council member Welling introduced Resolution 23-28. Council member Welling moved, Council member Perkes seconded, to adopt Resolution 23-28. RESOLUTION OF THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF THE NON-DISTURBANCE AND ESTOPPEL AGREEMENT WITH THE EVANSTON CHILD DEVELOPMENT CENTER, INC., A WYOMING NON-PROFIT CORPORATION, (ECDC). WHEREAS, the City and ECDC have entered into a Real Estate Lease, dated June 19 2019, to lease the real property and improvements, described therein, (the "Premises"); and WHEREAS, the City and ECDC have also entered into a Lease Addendum for Leasehold Mortgages, (signed by the City on July 13, 2021), to enable ECDC to obtain a loan from USDA to fund the construction of improvements to the Premises; and WHEREAS, a Non-disturbance and Estoppel Agreement between ECDC and the governing body is required for the desired Leasehold Mortgage on the Premises;  NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor and City Clerk are authorized to sign and attest the attached Non-disturbance and Estoppel Agreement with the Evanston Child Development Center, Inc. on behalf of the City of Evanston.
