EVANSTON CITY COUNCIL Second Regular Meeting May 16th, 2023 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of May was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, Jesse Lind, David Welling, Mike Sellers and Jen Hegeman. Evan Perkes was excused. Staff members present at the start of the meeting were: City Attorney/Prosecutor, Amanda Kirby; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Police Chief, Mike Vranish; Director of Parks and Recreation, Scott Ehlers; Information Technology Coordinator, Preston Sheets; Public Works Director, Gordon Robinson; Director of Engineering and Planning, Dean Barker and Community Development Director, Rocco O’Neill. A group of interested citizens was also present. Approve Agenda Council member Sellers moved, Council member Welling seconded to approve the agenda. The motion passed unanimously with 6 yes votes: Williams, Lynch, Lind, Welling, Sellers, Hegeman. Approve Minutes The official record of proceedings for the City Council Meeting held May 2nd, 2023, and the Work Session held May 9th, 2023, were approved as presented. Council Comments Council member Sellers recognized National Police Week, Sunday, May 14th – Saturday, May 20th, 2023 and National Nurses Week, Saturday, May 6th – Friday, May 12th, 2023. He also commented that the Boys and Girls Club will be having their Annual Dinner this weekend and thanked them for the great job they do. Council member Hegeman reminded everyone about the National Veteran’s Awareness Ride on May 18th. Mayor Williams commented that he had spoken to Josh Rasnake of Uinta County Emergency Management. Josh reported that the river is currently running fast, and it will peak in about two weeks. Mayor Williams reminded everyone to be careful. Consent Agenda Council member Welling moved, Council member Lynch seconded, to approve the following Consent Agenda Items: • Street Closure Permit requested by Downtown Evanston for the Crosswalk Re-painting Event at the intersection of 10th and Main Streets on Sunday, May 21st, 2023, from 8:00 am to 5:00 pm. • Parade Route requested by Nathan Prete of High Uinta Athletics for a Half Marathon on Saturday, June 10th, 2023. The Marathon begins at Sulphur Creek Reservoir at 7:00 am and ends at Bear Meadows. • Limited Malt Beverage Permit requested by Shades of Pale, Inc. for the High Uinta Athletics Half Marathon at Bear Meadows for the following date and time: Saturday, June 10th, 2023 8:00 am to 2:00 pm • Limited Malt Beverage Permit requested by Nicole Epsy for the Strike Out Softball Tournament at the Overthrust Ball Fields for the following dates and times: Friday, June 9th, 2023 8:00 am to 12:00 am Saturday, June 10th, 2023 8:00 am to 12:00 am Sunday, June 11th, 2023 8:00 am to 6:00 pm • Street Closure and Parade Route requested by the All Alumni Committee for the Noise Parade on Saturday, July 1st, 2023. Award Bid Councilmember Lynch moved, Councilmember Lind seconded, to accept the apparent low bid for the construction of four Pickleball Courts and two Basketball Courts for the City of Evanston Parks and Recreation to Courts Unlimited, LLC. The motion passed unanimously with 6 yes votes: Williams, Lynch, Lind, Welling, Sellers, Hegeman. Appoint Voting Delegates Councilmember Lynch moved, Councilmember Welling seconded, to appoint Mayor Williams as the Official Voting Delegate and Council member Welling as Alternate at WAM’s Summer Convention Business Meeting held Thursday, June 8th, 2023, in Cody Wyoming. The motion passed unanimously with 5 yes votes: Lynch, Lind, Welling, Sellers, Hegeman. Release Retainage Councilmember Sellers moved, Councilmember Welling seconded, to release retainage to SCI Construction for the Union Center Power Conduit Project. The motion passed unanimously with 6 yes votes: Williams, Lynch, Lind, Welling, Sellers, Hegeman. Resolution 23-34 Council member Lynch introduced Resolution 23-34. Council member Lynch moved, Council member Welling seconded, to adopt Resolution 23-34. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING AN APPLICATION TO OBTAIN A BULLET PROOF VEST PARTNERSHIP GRANT FROM THE U.S. DEPARTMENT OF JUSTICE. WHEREAS, grant funds are available from the U.S. Department of Justice which are to be used to assist in the purchase of bullet proof vests for the police department; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The Police Department of the City of Evanston is authorized to apply for a Bullet Proof Vest Partnership Grant from the U.S. Department of Justice. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH MJSA ARCHITECTS, P.C TO PROVIDE DESIGN AND CONSTRUCTION MANAGEMENT SERVICES FOR THE EVANSTON SHADES OF PALE PROJECT. WHEREAS, the City of Evanston and MJSA Architects (“MJSA”) have negotiated an agreement whereby MJSA will provide design and construction management services for the Evanston Shades of Pale Project (“Shades Project”); and NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the MJSA Contract, a copy of which is attached hereto, for the Shades Project, PASSED, APPROVED AND ADOPTED this 16th day of May 2023. RESOLUTION AUTHORIZING THE CITY OF EVANSTON, WYOMING TO ENTER INTO AN OPERATING AGREEMENT WITH THE EVANSTON PARKS AND RECREATION DISTRICT FOR THE OPERATION, MANAGEMENT AND REGULATION OF RECREATION WITHIN THE CITY OF EVANSTON. WHEREAS, the City of Evanston and the Evanston Parks and Recreation District have negotiated an agreement for the operation, management and regulation of recreation within the City of Evanston; WHEREAS, the City and the Recreation District have set the agreement in writing, a copy of which is attached hereto; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to sign, and the City Clerk is hereby authorized to attest, the Operating Agreement, a copy of which is attached hereto, with the Evanston Parks and Recreation District.
