EVANSTON CITY COUNCIL First Regular Meeting August 1st, 2023 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of August was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Evan Perkes, David Welling, Mike Sellers and Jen Hegeman. Tim Lynch and Jesse Lind were excused. Staff members present at the start of the meeting were: City Attorney/Prosecutor, Mark Harris; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Public Works Director, Gordon Robinson; Director of Parks and Recreation, Kim Larson; Director of Engineering and Planning, Dean Barker; Community Development Director, Rocco O’Neill and Police Lieutenant Ken Pearson. Information Technology Coordinator, Preston Sheets and Police Chief, Mike Vranish were excused. A group of interested citizens was also present. Approve Agenda Council member Welling moved, Council member Sellers seconded to approve the agenda with addition of Resolution 23-58. The motion passed unanimously with 5 yes votes: Williams, Perkes, Welling, Sellers, Hegeman. Approve Minutes The official record of proceedings for the City Council Meeting held July 18th, 2023, was approved as presented. Council Comments Council member Sellers recognized the Uinta County Start Up Challenge provided by Impact 307 and what a wonderful job everyone did. He also stated that it will be good to get the Chip Seal done. Council member Hegeman reminded everyone to support the businesses on Lincoln Highway. She commented that they will be struggling due to the cancellation of the Rodeo Series this summer. She also shared an inspiring story about a participant in the Tevis Cup competition. Mayor Williams also mentioned what a great event the Uinta County Start Up Challenge was. He recognized and congratulated all the participants. Consent Agenda Council member Welling moved, Council member Sellers seconded, to approve the following Consent Agenda Item: Limited Malt Beverage Permit requested by Gabriela Blevins for VFW Softball Tournament at the Overthrust Ballfields for the following dates and times: Friday, August 18th, 2023 12:00 pm to 11:00 pm Saturday, August 19th, 2023 8:00 am to 11:00 pm Sunday, August 20th, 2023 8:00 am. to 5:00 pm The motion passed unanimously with 5 yes votes: Williams, Perkes, Welling, Sellers, Hegeman. Resolution 23-56 Council member Sellers introduced Resolution 23-56. Council member Sellers moved, Council member Perkes seconded, to adopt Resolution 23-56. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF AN EASEMENT PURCHASE AGREEMENT AND EASEMENT AGREEMENT WITH QWEST CORPORATION D/B/A CENTURY LINK QC. WHEREAS, the City is the owner of property described as Lot 1 in Block 2 of the Union Center Addition to the City of Evanston, Wyoming; and WHEREAS, Qwest constructed and installed a communication system on the City’s property without obtaining consent or an easement from the City; and WHEREAS, Qwest has offered to purchase an easement from the City and enter into an agreement regarding the location and use of its communication system; and WHEREAS, it is in the best interests of the City to enter into an easement purchase agreement and easement agreement with Qwest for use of an easement over the City’s property and for the City to receive reasonable compensation for the easement; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The Mayor is authorized to execute and the City Clerk attest, on behalf of the City an Easement Purchase Agreement and Easement Agreement with Qwest Corporation d/b/a Century Link QC under the terms and conditions of Appendix “1” and “2” attached hereto. Resolution 23-57 Council member Welling introduced Resolution 23-57. Council member Welling moved, Council member Sellers seconded, to adopt Resolution 23-57. RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF A SERVICE AGREEMENT ADDENDUM WITH iWORQ TO PROVIDE THE CITY WITH SOFTWARE SERVICES FOR THE PUBLIC WORKS DEPARTMENT. WHEREAS, the City of Evanston has a need to acquire software services which will enhance citizen engagement in online application, permitting and licensing activities with the City=s Public Works Department and permit the Department to update address and ownership information of parcels receiving City services; and WHEREAS, iWorQ has submitted a quote to provide the software necessary to enable the City to provide the online services at an attractive price; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Service Agreement Addendum with iWorQ, a copy of which is attached hereto as Appendix “1”, to provide software services which will enable citizens to engage in online application, permitting and licensing activities with the City=s Public Works Department. Resolution 23-58 Council member Perkes introduced Resolution 23-58. Council member Perkes moved, Council member Sellers seconded, to adopt Resolution 23-58. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH CPCO, LLC DBA CONSOLIDATED PAVING & CONCRETE FOR THE COMPLETION OF ALL WORK REQUIRED FOR THE CITY OF EVANSTON STREET CHIP SEAL PROJECT 2023. WHEREAS, the City of Evanston has a need to maintain its streets; and WHEREAS, CPCO, LLC dba Consolidated Paying & Concrete (“Consolidated”) submitted the lowest responsible bid for the City of Evanston Street Chip Seal Project 2023; and WHEREAS, the City of Evanston and Consolidated are prepared to enter into an agreement whereby Consolidated will provide all materials and labor specified in the plans and specifications and the proposed contract documents for the City of Evanston Street Chip Seal Project 2023 in Evanston, Wyoming; and NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Agreement between the City of Evanston, as Owner, and CPCO, LLC dba Consolidated Paying & Concrete, as Contractor, a copy of which is attached as Appendix “1”, for completion of all work necessary for the City of Evanston Street Chip Seal Project 2023 in Evanston, Wyoming. Department Comments Parks & Rec Director, Kim Larson thanked Gordon and Public Work for helping with drain issues. Public Works Director, Gordon Robinson congratulated Wastewater employee, Daniel Sowers for passing the Level IV Certification test. City Attorney, Mark Harris mentioned Municipal Court was functioning fully on Monday and Tuesday after the transition of the new Judge and City Attorney.
