EVANSTON CITY COUNCIL First Regular Meeting October 3rd, 2023 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of October was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Tim Lynch, Jesse Lind, Evan Perkes, David Welling, Mike Sellers and Jen Hegeman. Staff members present at the start of the meeting were: City Attorney/Prosecutor, Mark Harris; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Public Works Director, Gordon Robinson; Director of Parks and Recreation, Kim Larson; Community Development Director, Rocco O’Neil; Senior Planner, DuWayne Jacobsen: Police Chief, Mike Vranish and Information Technology Coordinator, Preston Sheets. City Engineer, Dean Barker was excused. A group of interested citizens was also present. Approve Agenda Council member Welling moved, Council member Lind seconded to approve the agenda. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Approve Minutes The official record of proceedings for the City Council Meeting held September 19th, 2023 and City Council Work Session for September 26th, 2023 was approved as presented. Revenue & Expenditure Report Council member Welling moved, Council member Sellers seconded, to approve the Revenue and Expenditure Report for July 2023. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman.  Council Comments The Council all agreed it was great to see a good turnout for the City Council meeting. Everyone also commented that it was an awesome Homecoming, including the parade and the football game. Mayor Williams congratulated the football team for a well-deserved victory. Council member Welling mentioned that the weather is changing and to be prepared. Council member Sellers commented that with the changing weather, people also can become discouraged and to remember that the U.S. National Suicide Prevention Lifeline is 988 or text “WYO” to 741-741 for the Crisis Text Line. Council member Hegeman mentioned that Kevin Kallas, a well-known citizen of Evanston has recently had health issues and reminded everyone to please keep him and his family in your thoughts. Public Hearing/Height Exception City Attorney, Mark Harris began the Public Hearing by explaining the legalities of the hearing, and how it would be conducted. Applicants would be heard from first, followed by those who have questions for the applicant, and finally those opposed to the application. He asked each person speaking to clearly state their name and home address for the record prior to being sworn to testify. Attorney Harris opened the hearing for HE 193, a request by Tina Durand for a Height Exception to allow a fence to exceed the maximum height limitation of four feet within the front yard setback area for property located at 117 Citation Lane, Evanston, WY, which is zoned Low Density Residential- Established (LR-E). Tina Durand was sworn in and spoke on behalf of the application. Gina Fackrell was sworn in and spoke on behalf of the application. There was no opposition. The hearing was closed at the conclusion of presentation of evidence and testimony, Mayor Williams asked for a motion regarding the application. Council member Sellers moved, Council member Lind seconded, to approve the Application. The motion passed with 7 yes votes (Williams, Lynch, Lind, Perkes, Welling, Sellers, Hageman). Petition for Call Up Council member Perkes moved, Council member Welling seconded to grant a petition for call up and review of the action of the Evanston Planning and Zoning Commission on September 11th, 2023, regarding CP-185, the Application of Todd Osterling, for a Conditional Use Permit to allow a detached Accessory Building at the property located at 1600 West Center Street. The motion passed with 5 yes votes: Lynch, Lind, Welling, Sellers, Hegeman. 2 no votes: Williams, Perkes The hearing regarding the call up was set for November 7th, 2023, at 5:30 p.m. at City Hall Council Chambers. Public Hearing/Liquor License City Attorney Mark Harris conducted a public hearing to receive public comment regarding an application for a transfer of ownership of a Retail Liquor License from Golden Ticket, LLC, dba: Painted Lady; to Joeco LLC, dba: Queen City Saloon. There was no public comment regarding the Transfer. . Transfer of Retail Liquor License Council member Lynch moved, Council member Sellers seconded, to approve the transfer of ownership of a Retail Liquor License from Golden Ticket, LLC, dba: Painted Lady; to Joeco LLC, dba: Queen City Saloon The motion passed unanimously with 6 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers. Council member Hegeman recused herself.  Board Appointments Mayor Williams made appointments to the following boards. Council member Perkes moved, Council member Lind seconded, to confirm the following appointments: Tree Board Peter Howard - January 2026 Human Services Joint Powers Board David Welling - January 2026 The appointments were confirmed with 6 yes votes: Lynch, Lind, Perkes, Welling, Sellers, Hegeman Consent Agenda Council member Sellers moved, Council member Perkes seconded, to approve the following Consent Agenda Items: Street Closure Permit requested by St. Mary Magdalen Church for the Blessing of the Animals event on Sunday, October 8th, 2023, on Center Street from 8th Street and 9th Street, from 1:00 pm to 5:00 pm. Parade Route Permit requested by the St. Mary Magdalen Church for the Our Lady of Guadalupe Procession on Saturday, December 9, 2023, beginning at 5:30 p.m. at the Saint Mary Magdalen Church and ending at the Machine Shop. Limited Malt Beverage Permit requested by Samuel Ottley of the Uinta County Veteran’s Board for the Veteran’s Day Dinner and Fund Raiser at the Roundhouse on Saturday, November 11th, 2023, from 5:00 p.m. to 7:30 p.m. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Change Order Council member Lynch moved, Council member Welling seconded, to approve a motion to consider Change Order Number1 for the Evanston Police Department’s Motorola Solutions in car computers Project. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman.
