EVANSTON CITY COUNCIL Second Regular Meeting October 17th, 2023 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of October was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live. Council President Sellers led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Council President Sellers called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams (by phone); Council members, Tim Lynch, Jesse Lind, Evan Perkes, David Welling (by phone), Mike Sellers and Jen Hegeman. Staff members present at the start of the meeting were: City Attorney/Prosecutor, Mark Harris; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Director of Parks and Recreation, Kim Larson; Community Development Director, Rocco O’Neil; Police Chief, Mike Vranish; City Engineer, Dean Barker and Information Technology Coordinator, Preston Sheets. Public Works Director, Gordon Robinson was excused. A group of interested citizens was also present. Approve Agenda Council member Perkes moved, Council member Lynch seconded to approve the agenda. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Approve Minutes The official record of proceedings for the City Council Meeting held October 3rd, 2023; Special City Council Meeting held October 10th, 2023 and City Council Work Session held October 10th, 2023 was approved as presented. Council Comments Council member Sellers commented that Evanston has lost an outstanding community leader, Brian Stokes, thoughts and prayers go out to his family. Board Appointments Mayor Williams made appointments to the following boards. Council member Lynch moved, Council member Lind seconded, to confirm the following appointments: Historic Preservation Commission Kayne Pyatt - January 2026  Evanston Housing Authority Allen Kopp - January 2028 The appointments were confirmed with 6 yes votes: Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Consent Agenda Council member Perkes moved, Council member Lind seconded, to approve the following Consent Agenda Items: Street Closure Permit requested by Downtown Evanston Promotions for the Annual Hunters’ Widows Night Out on Thursday, October 19th, 2023, on Main Street, from 7th Street to 12th Street, from 5:00 pm to 8:00 pm. Street Closure Permit requested by Downtown Evanston Promotions for the Annual Downtown Trick-or- Treating on Tuesday, October 31st, 2023, on Main Street from 7th Street to Harrison, from 3:30 pm to 6:00 pm. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Resolution 23-71 Council member Lind introduced Resolution 23-71. Council member Lind moved, Council member Perkes seconded, to adopt Resolution 23-71. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF A PROPERTY USE AGREEMENT FOR AN AUTOMATIC CHANGEABLE COPY SIGN WITH THE EVANSTON CHAMBER OF COMMERCE, A WYOMING NON PROFIT CORPORATION. WHEREAS, the Evanston Chamber of Commerce located and operates an automatic changeable copy sign on property the City owns at 609 Front Street, Evanston, Wyoming under a Property Use Agreement for Automatic Changeable Copy Sign that was entered into on October 2, 2013; and WHEREAS, the sign is used primarily by the Chamber to advertise the goods and services of local businesses as well as community events and functions; and WHEREAS, the sign has been a benefit to the local economy and will provide a valuable source of community information; and WHEREAS, the term of the Property Use Agreement expired in 2018 and the Chamber and City desire to enter into a Property Use Agreement under the same terms and conditions so as to continue the benefit the local economy and provision of a valuable source of community information; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Property Use Agreement for Automatic Changeable Copy Sign between the City of Evanston and the Evanston Chamber of Commerce, a Wyoming non-profit corporation, a copy of which is attached hereto as Appendix “1”. Council member Lynch moved, Council member Perkes seconded, to adopt Resolution 23-72. A RESOLUTION AUTHORIZING THE CITY OF EVANSTON, WYOMING TO ENTER INTO AN OPERATING AGREEMENT WITH THE URBAN RENEWAL AGENCY OF THE CITY OF EVANSTON, WYOMING REGARDING THE OPERATION OF THE STRAND THEATER. WHEREAS, the Urban Renewal Agency of the City of Evanston, Wyoming (“URA”) is the owner of the Strand Theater (“Theater”), which is located in an urban renewal area, and for which a project was undertaken to rehabilitate the Theater to prevent or alleviate blight or underdeveloped properties; and WHEREAS, the URA authorizes various uses of the Theater for public and private events and receives facility use charges for the events, which events are scheduled by the City and revenues associated therewith are paid by the City and remitted to the URA; and WHEREAS, the City provides limited operational maintenance of the Theater, including custodial and snow removal services and limited IT maintenance; and WHEREAS, the City of Evanston the Urban Renewal Agency of the City of Evanston have negotiated an agreement for the operation and management of the Strand Theater; and NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to sign, and the City Clerk is hereby authorized to attest, the Operating Agreement with the Urban Renewal Agency, a copy of which is attached hereto as Appendix “1”. A RESOLUTION OF THE GOVERNING BODY OF THE CITY OF EVANSTON APPROVING CHANGE ORDER NO. 4 FOR THE 18TH, 19TH & WEST SUMMIT WATER REPLACEMENT PROJECT IN THE CITY OF EVANSTON. WHEREAS, the City of Evanston has previously authorized the 18th, 19th and West Summit Water Replacement Project, which is being constructed by Kilgore Companies, LLC dba Lewis & Lewis, and WHEREAS, the governing body has determined that it is in the public=s interest to approve Change Order No. 4 for the reasons set forth therein; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, AS FOLLOWS: Section 1. Change Order No. 4 for the 18th, 19th and West Summit Water Replacement Project, a copy of which is attached hereto as Appendix “1”, is approved. Section 2. The City Engineer and Mayor are authorized to approve Change Order No. 4 on behalf of the City.
