EVANSTON CITY COUNCIL First Regular Meeting April 2nd, 2024 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of April was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Tim Lynch, Evan Perkes, Dave Welling, Mike Sellers and Jen Hegeman. Jesse Lind attended by telephone. Staff members present at the start of the meeting were: City Attorney/Prosecutor, Mark Harris; City Clerk, Diane Harris; City Engineer, Damon Newsome; Information Technology Coordinator, Preston Sheets, Police Chief, Mike Vranish; City Treasurer, Trudy Lym and Community Development Director, Rocco O’Neill. Director of Parks and Recreation, Kim Larson and Public Works Director, Gordon Robinson. were excused. A group of interested citizens was also present. Approve Agenda Council member Welling moved, Council member Lynch seconded to approve the agenda. Revenue & Expenditure Report Council member Sellers moved, Council member Welling seconded, to approve the Revenue and Expenditure Report for January 2024. Council Comments The Mayor and Council members spoke regarding the road closures and traffic safety, Celtic Festival and Service members. Legislative Update Representative Jon Conrad reported on the recent Legislative Budget Session. Consent Agenda Council member Perkes requested the following be removed from the Consent Agenda for discussion: Parade Route requested by Nathan Prete of High Uinta Athletics for a Half Marathon on Saturday, June 8th, 2024. A discussion was held regarding the specifics of the request regarding traffic control and road closures and construction on City View and Highway 89. Council member Welling moved, Council member Lynch seconded, to approve the Parade Route request. The Motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Council member Welling moved, Council member Lynch seconded, to approve the following Consent Agenda items: Parade Route requested by Dustin Matthews for Evanston Cowboy Days for the Annual Cowboy Days Celebration and Labor Day Parade on Monday, September 2nd, 2024, beginning at 10:00 am. Limited Malt Beverage Permit requested by Dustin Matthews for Evanston Cowboy Days for the Annual Cowboy Days Celebration at the Uinta County Fairgrounds for the following dates and times: Friday, August 30, 2024 4:00 pm to 10:00 pm Saturday, August 31, 2024 5:00 pm to 10:00 pm Sunday, September 1, 2024 5:00 pm to 10:00 pm Monday, September 2nd, 2024 1:00 pm to 5:00 pm The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. 2  Discussion and Action on Bids Council member Lynch moved, Council member Sellers seconded to reject the bids for the Roundhouse Trailhead Access Improvement Project. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Lawful Discharge of Fireworks Council member Perkes moved, Council member Welling seconded, to approve the number of days and hours for the lawful discharge of fireworks for Thursday, July 4th; Friday, July 5th and Saturday, July 6th, 2024 – 5 p.m. to midnight. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Award Bid Councilmember Perkes moved, Councilmember Lynch seconded, to accept the apparent low bid for three new Ram 1500 Crew Cab Special Services Vehicles for the Evanston Police Department by Fremont Motor Company - Lander. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Resolution 24-16 Council member Sellers introduced Resolution 24-16. Council member Sellers moved, Council member Lynch seconded, to adopt Resolution 24-16. A RESOLUTION TO PLACE THE ONE-HALF PERCENT (1/2%) SALES AND USE TAX FOR ECONOMIC DEVELOPMENT QUESTION ON THE 2024 PRIMARY ELECTION BALLOT. WHEREAS, Title 39 Chapter 15 of the Wyoming Statutes allows for an excise tax of up to 1% be imposed for economic development if approved by the electorate; and WHEREAS, the proposition to impose an excise tax shall be at the expense of the county and be submitted to the electors of the county upon the receipt by the board of county commissioners of a resolution requesting the election signed by at least five percent (5%) of the electors of the county or of a resolution approving the proposition from the governing bodies of at least fifty percent (50%) of the incorporated municipalities within the county and a resolution approving the proposition of the board of county commissioners; and WHEREAS, a portion of the proceeds from the tax shall be used for economic development as provided by Wyo. Stat. § 39-15-203(a)(v)(C) and any ballot proposition shall contain the words “a portion (or specific percentage) of the tax proceeds shall be used for economic development” in a clear and appropriate manner; and WHEREAS, Economic Development as defined by the Wyoming Economic Development Association is “any project or activity that encourages private sector development of companies that provide higher than average wages, create primary jobs, diversify the economy, and generate tax revenue”; and WHEREAS one hundred percent (100%) of the tax generated will be allocated to the County and four Municipalities based on population to manage and invest in economic development projects of their choosing; and WHEREAS, if the tax proposed is approved in the Primary Election on August 20, 2024, the same proposition shall be submitted in the General Election in 2028 and at every subsequent general election until the proposition is defeated; and WHEREAS, if the proposition is approved by the qualified electors, the governing body shall by ordinance impose an excise tax upon retail sales of tangible personal property, admissions and services; and NOW, THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: By the passage of this Resolution, the City of Evanston requests the optional one-half percent (1/2%) sales and use tax for economic development question be placed on the 2024 Primary Election ballot, which shall be proposed as: ONE HALF PERCENT (1/2%) SALES AND USE TAX FOR ECONOMIC DEVELOPMENT PROPOSITION “Shall the Board of County Commissioners of the County of Uinta, State of Wyoming be 3  authorized to impose an excise tax for economic development of 1/2% upon retail sales of tangible personal property, admissions and services made within the county, the purpose of which is for economic development, to be allocated to the county and four municipalities based on population to manage and invest in economic development projects of their choosing. If passed, the tax would be in place until the 2028 General Election and at every other subsequent general election thereafter until the proposition is defeated” FOR THE COUNTY SALES AND USE TAX FOR ECONOMIC DEVELOPMENT AGAINST THE COUNTY SALES AND USE TAX FOR ECONOMIC DEVELOPMENT Section 2: The proposed tax be initially imposed for a four-year (4) term and if passed, be re- submitted to the electors at every other subsequent general election thereafter until the proposition is defeated. Resolution 24-17 Council member Welling introduced Resolution 24-17. Council member Welling moved, Council member Lynch seconded, to adopt Resolution 24-17. A RESOLUTION OF THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING APPROVING CHANGE ORDER NOS. 2 and 3 FOR THE ROUNDHOUSE SECTION 4 – TENANT GREY SHELL AND LOADING FACILITIES PROJECT IN THE CITY OF EVANSTON. WHEREAS, the City of Evanston has previously authorized the Roundhouse Section 4 – Tenant Grey shell and Loading Facilities Project, which is being constructed by Tanner Development, LLC, and WHEREAS, the governing body has determined that it is in the public=s interest to approve Change Order Nos. 2 and 3 for the reasons set forth therein; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, AS FOLLOWS: Section 1. Change Order Nos. 2 and 3 for the Roundhouse Section 4 – Tenant Grey shell and Loading Facilities Project, copies of which are attached hereto as Appendix “1” and “2”, are approved. Section 2. The Community Development Director or Mayor are authorized to approve Change Order Nos. 2 and 3 on behalf of the City. PASSED, APPROVED AND ADOPTED this 2nd day of April 2024. Kent H. Council member Sellers moved, Council member Perkes seconded, to adopt Resolution 24-18. 4 A RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF THE EMPLOYERS PLAN SELECTION AND NOTICE AND ACKNOWLEDGMENT REQUIRED BY WYOMING EDUCATORS BENEFIT TRUST, (WEBT) TO CONTINUE THE CITY=S MEDICAL PLAN FOR CITY EMPLOYEES. WHEREAS, the City of Evanston desires to continue providing a medical plan for its employees by executing the attached Employer Plan Selection and Notice and Acknowledgment with WEBT; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute on behalf of the City of Evanston the attached Employer Plan Selection and Notice and Acknowledgment with WEBT to continue providing a medical plan for its employees.
