EVANSTON CITY COUNCIL Second Regular Meeting June 18th, 2024 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of June was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Tim Lynch, Evan Perkes, Dave Welling, Mike Sellers and Jen Hegeman. Council member Jesse Lind was excused. Staff members present at the start of the meeting were: City Attorney/Prosecutor, Mark Harris; City Clerk, Diane Harris; Police Chief, Mike Vranish; City Treasurer, Trudy Lym; Director of Parks and Recreation, Kim Larson; Senior Planner, DuWayne Jacobsen; City Engineer, Damon Newsome and Public Works Director, Gordon Robinson. Community Development Director, Rocco O’Neill was excused. A group of interested citizens was also present. Council Comments The Mayor and Council members spoke regarding the cold weather and the historic Pony Express. Public Hearing Modifications 2023-2024 Budget City Attorney, Mark Harris conducted a public hearing to receive public information, input, comments, and concerns for modifications for the City of Evanston Fiscal Year 2023-2024 Annual Budget. City Treasurer, Trudy Lym, gave a summary of the modifications. No one addressed the issue and Mr. Harris closed the hearing. Public Hearing Annual Budget 2024-2025 2 City Attorney, Mark Harris conducted a public hearing to receive public information, input, comments, and concerns for the City of Evanston Fiscal Year 2024-2025 Annual Budget. City Treasurer, Trudy Lym, gave an overview and summary of the upcoming budget. Rick Eskelson commented on the Union Pacific Water Tower Project. Mr. Harris closed the hearing. Consent Agenda Council member Sellers moved, Council member Perkes seconded, to approve the following Consent Agenda item: Street Closure Permit requested by Travis Wilson for a neighborhood 4th of July Block Party on Thursday, July 4, 2024 on Summit Street between 6th Street and 7th Street, from 3:00 pm to midnight. The motion passed unanimously with 6 yes votes: Williams, Lynch, Perkes, Welling, Sellers, Hegeman. Council member Welling moved, Council member Sellers seconded, to approve the following Consent Agenda item: A modified Street Closure and Parade Route requested by the All Alumni Committee for the Noise Parade on Saturday, July 6th, 2024 at 9:00 am starting at the Library, down Main Street, ending at the Post Office. The motion passed unanimously with 6 yes votes: Williams, Lynch, Perkes, Welling, Sellers, Hegeman. Ordinance 24-04 Council member Sellers moved, Council member Perkes seconded, to pass Ordinance 24-04 on third and final reading. AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 7-112 B., AND 7- 113, THE CODE OF THE CITY OF EVANSTON, WYOMING RELATING TO STORM WATER RUNOFF PLAN REVIEW AND DRAINAGE FEES OF THE CITY OF EVANSTON, WYOMING STORM WATER RUNOFF CONTROL ORDINANCE, PROVIDING FOR SETTING OF STORM WATER PLAN REVIEW AND DRAINAGE FEES BY RESOLUTION ADOPTED BY THE EVANSTON CITY COUNCIL. WHEREAS, Section 7-112 B and Section 7-113 of the City Code currently set plan review and drainage water fees for special building permits associated with storm water drainage at four hundred dollars ($400.00) per submittal and drainage fees based on a per acre basis; and WHEREAS, other development and planning fees are set by annual resolution of the City Council as part of the annual budget process; and WHEREAS, there is a need to amend Section 7-112 B and Section 7-113 A of the City Code to permit setting of storm water plan review and drainage water fees by resolution of the City Council to be consistent with other fee setting by the City; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: Section 7-112 B. of the Evanston City Code is amended and re-enacted to provide as follows: § 7-112 B. Drainage Plan review fee-Land development. B. The following fees will be levied against the development and shall be due and payable as follows: forty percent of the fee shall be paid prior to the approval of the preliminary drainage plan, and the remaining sixty percent of the review fee shall be paid prior to the approval of the final plat and final drainage plan. The review fees shall be set and established by the governing body of the City of Evanston in its annual budget resolution. Section 2: Section 7-113 of the Evanston City Code is amended and re-enacted to provide as follows: § 7-113 Drainage water fee. This drainage water fee shall be imposed on all lands being developed within the present corporate limits and within one-half mile thereof either as a special building permit or as a land development. The revenues derived therefrom shall be used primarily, but not exclusively, for the development and construction of improvements to the existing storm water facilities and for the construction of additional needed storm water facilities, such as new, main interceptor lines, detention facilities, and disposal facilities to serve the developed areas. It is not the intent of this development fee to pay for the construction of on-site storm drainage facilities for any development, but to provide the major overall interceptor lines and detention facilities to serve the conglomeration of developments. A. Drainage water fee calculation. This drainage water charge shall be imposed upon all new developments and lands to be improved under special building permits in the City. This charge shall not be imposed upon any already developed land within the City or within one-half mile thereof at the time of the passage of this Part 7, which is November 4, 1982. The amount of said charge or fee shall be set and 3 established by the governing body of the City of Evanston in its annual budget resolution. (1) For special building permits, the fee shall be set and established by the governing body of the City of Evanston in its annual budget resolution per acre if the amount of discharge is not limited by on-site detention; (2) For special building permits, the fee shall be set and established by the governing body of the City of Evanston in its annual budget resolution per acre if the discharge of storm drainage waters for the development is limited to or less than 0.20 of a cfs per acre during a one-hundred-year design storm event. (3) For land development, the fee shall be set and established by the governing body of the City of Evanston in its annual budget resolution per acre multiplied by the "Weighted Runoff Coefficient" as determined by Section 7-104A, Rational Method, if the amount of discharge is not limited by on-site detention. The weighted runoff coefficient shall not be less than 0.2. (4) For land development, the fee shall be set and established by the governing body of the City of Evanston in its annual budget resolution per acre if the discharge of storm drainage waters for the development is limited to or less than 0.20 cfs per acre, during a one-hundred-year design storm event and provided the City engineer approves on-site detention for the development. On-site detention shall comply with the City of Evanston stormwater master plan. In computing the area of any tract of land for purposes of applying such fee, the area of any existing public street, alley way, or any canal, irrigation lateral, or natural waterway shall be deducted. The amount of said charge or fee may be changed from time to time by the governing body. Section 3: This ordinance shall be effective on passage on third and final reading. Ordinance 24-05 Council member Welling moved, Council member Lynch seconded, to pass Ordinance 24-05 on third and final reading. AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 7-71 C., THE CODE OF THE CITY OF EVANSTON, WYOMING RELATING TO GRADING PERMIT FEES OF THE GENERAL REQUIREMENTS OF THE CITY OF EVANSTON, WYOMING EROSION CONTROL ORDINANCE, PROVIDING FOR SETTING OF GRADING PERMIT FEES BY RESOLUTION ADOPTED BY THE EVANSTON CITY COUNCIL. WHEREAS, Section 7-71 C of the City Code currently sets grading permit fees at ten dollars ($10.00) per acre; and WHEREAS, other development and planning development fees are set by annual resolution of the City Council as part of the annual budget process; and WHEREAS, there is a need to amend Section 7-71 C of the City Code to permit setting of grading permit fees annually by resolution of the City Council to be consistent with other fee setting by the City; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: Section 7-71 C. of the Evanston City Code is amended and re-enacted to provide as follows: ' 7-71. General Requirements. C. Grading permit fee. A fee for each grading permit shall be paid to the City based on the size of the area undergoing earthwork. The fee shall cover the costs of the review by the City engineer of the grading plan. The fee shall be set and established by the governing body of the City of Evanston in its annual budget resolution. The fee shall be levied against the property prior to issuance of the grading permit. Section 2: This ordinance shall be effective on passage on third and final reading. Resolution 24-35 Council member Lynch introduced Resolution 24-35. Council member Lynch moved, Council member Sellers seconded, to adopt Resolution 24-35. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF A MUTUAL AGREEMENT BETWEEN THE UINTA COUNTY CONSERVATION DISTRICT AND EVANSTON TREE BOARD FOR THE “COMMUNITY FORESTRY-TREE CARE IMPROVEMENT” PROJECT. WHEREAS, the Uinta County Conservation District (“District”) is empowered to, among other things, develop comprehensive plans for conservation of soil and water resources, control and prevention of soil erosion and for flood prevention or the conservation, development, utilization and disposal of water within the District, which plans can include the specification of growing of grass and other vegetation and cropping and; and WHEREAS, the City has created a Tree Board and has previously applied for various grants regarding the Tree Board’s functions; and WHEREAS, the District and Tree Board have the common objective to provide for the conservation of soil and water resources, control and prevent soil erosion, preserve natural resources, and promote the health, safety and general welfare of the people of the City of Evanston and Uinta County; and WHEREAS, the parties recognize the need to coordinate with each other to implement their respective goals in natural resource projects and it is in the best interests of the citizens of the City of Evanston to enter into a Memorandum of Understanding with the District with respect to tree care, planting and pruning education and providing tree water bags to residents participating in the City of Evanston's tree planting program; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING AS FOLLOWS: Section 1: The Evanston Tree Board is hereby authorized to execute, and attest, if necessary, the Mutual Agreement between the Uinta County Conservation District and Evanston Tree Board for the “Community Forestry-Tree Care Improvement” Project a copy of which is attached hereto as Appendix “1”. A RESOLUTION AUTHORIZING THE CITY OF EVANSTON, WYOMING TO ENTER INTO AN OPERATING AGREEMENT WITH THE EVANSTON PARKS AND RECREATION DISTRICT FOR THE OPERATION, MANAGEMENT AND REGULATION OF RECREATION WITHIN THE CITY OF EVANSTON FOR THE 2024-2025 FISCAL YEAR. WHEREAS, the City of Evanston and the Evanston Parks and Recreation District have negotiated an agreement for the operation, management and regulation of recreation within the City of Evanston; and WHEREAS, the City and the Recreation District have set the agreement in writing, a copy of which is attached hereto; 5 NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk is hereby authorized to attest, the Operating Agreement with the Evanston Parks and Recreation District, according to the terms of Appendix “1” attached hereto. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF A CONTRACT FOR SERVICES WITH THE UINTA COUNTY INDUSTRIAL DEVELOPMENT COMMISSION (UCIDC). WHEREAS, UCIDC was formed as a non-profit corporation to strengthen the economic opportunities and improve the quality of life for Uinta County citizens; and WHEREAS, to accomplish its stated mission objectives, UCIDC meets monthly with industry and community members, offers resources to business leaders, entrepreneurs, and tourism organizations and promotes economic development, workforce development, and quality of life initiatives in Uinta County; and WHEREAS, the mission and activities of Uinta County Industrial Development Commission increases tax revenue for the City and are in the best interest of its citizens; and WHEREAS, the City desires UCIDC initiate and continue such mission and activities; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Contract for Services with the Uinta County Industrial Development Commission, a copy of which is attached hereto marked Appendix “1”. WHEREAS, the governing body has determined there is a need to amend Budget Resolution 23- 49 for fiscal year 2023-2024 by increasing fund equity for the Cemetery Fund and capital expenses for the Golf Fund and Water Fund; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING AS FOLLOWS: Section 1. Resolution 24-39 Council member Welling introduced Resolution 24-39. Council member Welling moved, Council member Sellers seconded, to adopt Resolution 24-39. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING, PROVIDING INCOME NECESSARY TO FINANCE THE BUDGET AND PROVIDE FOR AND AUTHORIZE ANNUAL APPROPRIATION OF FUNDS FOR FISCAL YEAR JUNE 30, 2025. WHEREAS, on the 1st day of May 2024, the Treasurer of the City of Evanston, Wyoming, prepared from the Department Administrators and the Mayor and submitted to the City Council, a city budget for the 2024 fiscal year, beginning the 1st day of July 2024, and ending the 30th day of June 2025: and WHEREAS the governing body has reviewed this budget in detail, and discussed with the Departmental Administrators concerning their individual budget requests and base budgets; and WHEREAS a copy thereof was made available for public inspection at the office of the City Treasurer; and WHEREAS, notice of a public hearing, as required by Wyoming State Statute, on said budget, together with the summary of said budget, was published in the Uinta County Herald, a legal newspaper, of general circulation in the City of Evanston, on the 5th day of June 2024; and WHEREAS a public hearing was held on such Budget at the time and place specified in said notice, at which time all interested parties were given an opportunity to be heard; and 7 WHEREAS the governing body has adopted the following overall mission statements to guide the execution of the budget: 1) To ensure that all rules and regulations set forth by Evanston City Government are appropriate and pertinent to the quality of life of the residents of Evanston, Wyoming. (2) To expect a strong sense of accountability and dedication by all City employees to the people of Evanston, and to officially recognize those employees whose service to the citizens of Evanston reflect this goal. (3) To improve the overall communication and line of communication within the city. (4) To recognize and cultivate the importance of small businesses within Evanston, as well as to encourage industry to explore the resources in our community. (5) To stimulate proper management techniques so that the infra-structure of our city is functioning at the highest level of productivity. WHEREAS the governing body has adopted a budget approach which encourages city employees to provide services more efficiently and cost effectively, allowing department heads discretion to transfer operational budget allocations within a division. NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The City Budget, as so revised and altered, be adopted as the official City Budget for the fiscal year ending June 30, 2025. Section 5: Upon the adoption of this resolution the Treasurer shall, pursuant to the policy established by the governing body, provide to each department instructions specifying the method and form of reallocating their budgets in conformance to the standard classification system and pursuant to the appropriations authorized. Section 6: (a) Pursuant to the policy established by the mayor, it shall be the duty of the mayor to review all requisitions and other requests for expenditures submitted by a Department or agent of the City. After said review, the Treasurer shall at the minimum ensure that: (1) The request conforms to the approved budget and corresponding appropriations. (2) Funds are available to defray the requested expenditure. (3) The request is proper, legal and is in accord with City Policy and Procedures. (b) The Treasurer is further authorized to administer procedures established by the governing body governing the form and processing of interim budget revisions provided they conform to the following criteria: (1) The department head may elect to transfer budget allocations within a division without prior approval. (2) The department head may elect to transfer budget allocations between divisions with prior approval of the mayor. (3) The department head may elect to transfer budget allocations from one department to another with the prior approval of the governing body. (4) Increases or decreases in budget allocations for personnel services require the prior approval of the mayor. (5) Inter-departmental transfers, changes in Capital Outlay Budgets and inter-fund transfers require the prior approval of the governing body. (6) No transfer shall be made which has the effect of increasing any series, class, object, or budget unless accompanied by a corresponding reduction in another series, class, object, or budget. (7) Irrespective of amounts appropriated for personnel services, the governing body shall approve, by specific motion, the creation of any new permanent positions. This subparagraph does not apply to the hiring of seasonal, temporary, or intermittent employees working part-time or full-time. However, seasonal, temporary, or intermittent employees working more than 120 calendar days must be approved by the governing body. (8) No expenditure shall be made from a contingency account for Capital Outlay without the express prior approval of the governing body. Section 7: Any unspent budget allocation and all capital outlay shall not be carried over to the following budget year. Any unspent merit pay shall not be carried over. Section 8: Pursuant to the policy established by the governing body the treasurer shall monitor revenues received and expenditures made by the City to determine the City's cash needs. When the Treasurer determines that aggregate City expenditures will exceed the total of revenues expected in any yearly, quarterly, or monthly fiscal period the Treasurer shall, to prevent a deficit cash situation from arising, institute a proportional reduction in expenditure authorized for each department to the level of expected revenues. In placing such restriction in effect, the Treasurer shall, consider as priority expenditures to preserve: (1) Commitments involving City bonded and loan indebtedness. (2) Obligations to Federal and State authorities. (3) Contractual arrangements to which the City is a party. (4) Personnel Service costs for wages and benefits. 11 The Treasurer shall advise the governing body at its next scheduled meeting of any reductions ordered and the reasons prompting that action. Section 9: Projects, activities, and programs authorized for which grants from the United States of America, State of Wyoming, Uinta County, or any other source are to be used for payment of all or a portion of the project, activity or program are conditioned upon the receipt of the appropriated grant. In the event a grant is not received the project, program or activity will be evaluated and may not be undertaken, unless specifically approved by the governing body. Section 10: By order of the governing body and for the execution and administration of the budget for this fiscal year the following policy directions shall prevail. (A) The pay of each City employee will remain the same for fiscal year 2024-2025. (B) The City will pay, on behalf of its full-time permanent employees, 100% of the specified percentages to the Wyoming Retirement Program, and for council members, a deferred compensation program. Currently, the percentage of the full-time public employee’s gross income is 18.62%. Law enforcement employee’s percentage of their gross income is currently 19.00%. (C) Each employee covered by the terms and conditions of the health/medical, dental, and optical insurance policy shall be required to contribute through a payroll deduction, an amount equal to 8.2% of the monthly insurance premium. Qualified Retiree employees who receive the retirement health insurance option shall be required to pay 80% of insurance premium as per the Personnel Policy. (D) The city will not participate financially in the payment of membership dues or fees on behalf of any employee unless the membership is granted in the name of the City of Evanston. The city will not contribute financially to the payment of any personal memberships. (E) Where statutory or job description provisions specify that certain occupational certification or professional status is required as a condition to or of employment, the City will reimburse travel and associated costs related to attendance at schools, seminars, or conferences when such attendance is for maintaining or advancing professional status or occupational certification. (F) The city will reimburse employees up to $200 for protective footwear, as determined by the Department Administrator. Section 11: Attachment A is the fee schedule for the Fiscal Year beginning July 1, 2024, and is hereby adopted and made part of the budget resolution.
