EVANSTON CITY COUNCIL Second Regular Meeting August 20th, 2024 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of August was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Council member Welling led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Tim Lynch, Jesse Lind, Evan Perkes, Dave Welling, Mike Sellers and Jen Hegeman. Staff members present at the start of the meeting were: City Attorney/Prosecutor, Mark Harris; City Clerk, Diane Harris; Police Chief, Mike Vranish; Police Lieutenant, Ken Pearson; City Treasurer, Trudy Lym; Director of Parks and Recreation, Kim Larson; City Engineer, Damon Newsome; Public Works Director, Gordon Robinson; and Senior Planner, DuWayne Jacobsen. Information Technology Coordinator, Preston Sheets and Community Development Director, Rocco O’Neill were excused. A group of interested citizens was also present. Approve Agenda Council member Perkes moved, Council member Welling seconded to approve the agenda. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Revenue & Expenditure Report Council member Perkes moved, Council member Welling seconded, to approve the Revenue and Expenditure Report for June 2024. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Council Comments Councilmember Lind read a statement approved by himself and three members of the Council (Councilmembers Lynch, Sellers and Hegeman) regarding a “vote of no confidence” of Mayor Williams. No action was brought before the Council. Ordinance 24-06 2 Council member Sellers moved, Council member Perkes seconded, to pass Ordinance 24-06 on third and final reading. AN ORDINANCE APPROVING AND AUTHORIZING THE FINAL PLAT FOR THE RIDGECREST 6TH ADDITION, LOCATED IN THE CITY OF EVANSTON, WYOMING, BEING MORE PARTICULARLY DESCRIBED HEREIN. WHEREAS, the subdivider, Yellow Creek Ranch Co., Inc., has made application to the governing body of the City of Evanston, Wyoming for approval and authorization of the proposed subdivision entitled the Ridgecrest 6th Addition, located within the City of Evanston, Wyoming; and WHEREAS, the City of Evanston finds that all of the requirements of Chapter 22, "Subdivision Regulations" of the Code of the City of Evanston, have been complied with, including notice of hearings and hearings thereof; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, THAT: Section 1. The final plat of the Ridgecrest 6th Addition is hereby approved, accepted and authorized and described in particularity as follows, to-wit: A parcel of land located in the NE1/4 SE1/4 of Section 29, T15N, R120W, 6th P.M., City of Evanston, Uinta County, Wyoming, said parcel being more particularly described as follows: COMMENCING at the Southeast corner of said Section 29 and running thence N 0°05'35" W, 2071.10 feet along the East line thereof; thence S 89°54'25" W, 898.57 feet to the POINT OF BEGINNING, said point lying on the Southeasterly boundary of Twin Ridge Subdivision No. 1 to the City of Evanston, as said Subdivision is platted and of record in the Office of the Uinta County Clerk; thence S 16°19'15" E, 116.84 feet; thence S 12°11'10" W, 147.98 feet; thence S 63°21'33" W, 208.09 feet to a point on said Southeasterly boundary of Twin Ridge Subdivision No. 1; thence N13°08'39" W, 38.09 feet along said Southeasterly boundary; thence N 27°58'39" W, 190.00 feet along said Southeasterly boundary to a corner thereof; thence N 62°46'21" E, 317.36 feet along said boundary to the POINT OF BEGINNING. Said parcel containing 63,164 square feet or 1.450 acres, more or less. Section 2. The Mayor and City Clerk of the City of Evanston are hereby authorized and directed to enforce the mandates of Chapter 22 of the Code of the City of Evanston, referring to the payment of necessary fees and land dedication requirements by the subdivider and the filing of the final plat with the County Clerk of Uinta County, Wyoming as by law required. Ordinance 24-07 Council member Lynch sponsored Ordinance 24-07. Council member Lind moved, Council member Sellers seconded, to pass Ordinance 24-07 on first reading. AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING PROVISIONS OF ARTICLE III, REGULATIONS AND RESTRICTIONS, OF CHAPTER 11 OF THE CODE OF THE CITY OF EVANSTON, WYOMING RELATING TO PAWNS AND PAWNSHOPS, PROVIDING FOR ADOPTION OF PROVISIONS OF WYOMING STATUTES REGULATING PAWN FINANCE CHARGES AND MATURITIES. WHEREAS, in 1982, the City of Evanston adopted Part 3 to Chapter 11 of the Evanston City Code relating to pawnshops and pawn regulation; and WHEREAS, in 1983, the Wyoming legislature adopted provisions of the Uniform Consumer Credit Code which dealt with regulating pawn finance charges and maturities; and WHEREAS, the Wyoming legislature preempted regulation of pawn finance charges and maturities by cities and towns, but left cities and towns with the power to determine other pawn and pawnbroker 3 regulation; and WHEREAS, there is a need to amend Section 11-37 of the City Code to mirror and incorporate state statutes relating to pawn finance charges and maturities; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: Section 11-37 of the Evanston City Code is amended and re-enacted to provide as follows § 11-37 Rates Regulated. A. No pawnbroker may contract for, charge or receive an amount as a charge in connection with a pawn transaction other than a pawn finance charge. B. The amount financed in any one (1) pawn transaction to any one (1) customer shall not exceed three thousand dollars ($3,000.00). C. The maturity date of a pawn transaction shall be one (1) calendar month. The period shall expire on the same date in the succeeding month if there is such a date, otherwise on the last day of the succeeding month. If the expiration date is not a business day, the period expires on the next business day. D. Pawn finance charges are fully earned on the day the loan is made. E. Pawn transactions may be renewed from month to month without additional disclosures provided: (1) There is no change in the original terms; and (2) Pawn finance charges are not compounded. F. A pawnbroker may contract for and receive a minimum pawn finance charge of not more than five dollars ($5.00). Resolution 24-58 Council member Welling introduced Resolution 24-58. Council member Welling moved, Council member Lynch seconded, to adopt Resolution 24-58. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF A JOINT FUNDING AGREEMENT WITH THE U.S. GEOLOGICAL SURVEY, UNITED STATES DEPARTMENT OF THE INTERIOR, FOR THE OPERATION AND MAINTENANCE OF A STREAM GAUGE STATION ON THE BEAR RIVER. WHEREAS, the City of Evanston obtains useful water flow information regarding the Bear River from a stream gauge station located on the Bear River near County Road; and WHEREAS, the U.S. Geological Survey has requested the City assist in funding the maintenance and operation of the Bear River stream gauge for 2024-2025 fiscal year; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor or Director of Public Works is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Joint Funding Agreement with the U.S. Geological Survey, United States Department of the Interior, for the operation and maintenance of a stream gauge station on the Bear River, a copy of which is attached hereto as Appendix “1”.
