EVANSTON CITY COUNCIL First Regular Meeting September 3rd, 2024 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of September was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded and streamed live. A student from Horizon High School led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members, Tim Lynch, Jesse Lind, Evan Perkes, Dave Welling, Mike Sellers and Jen Hegeman. Staff members present at the start of the meeting were: City Attorney/Prosecutor, Mark Harris; City Clerk, Diane Harris; Police Chief, Mike Vranish; Police Lieutenant, Ken Pearson; City Treasurer, Trudy Lym; Director of Parks and Recreation, Kim Larson; City Engineer, Damon Newsome; Public Works Director, Gordon Robinson; and Community Development Director, Rocco O’Neill. Information Technology Coordinator, Preston Sheets was excused. A group of interested citizens was also present. Approve Agenda Council member Welling moved, Council member Perkes seconded to approve the agenda. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Council Comments The Mayor and Council members spoke regarding the Wyoming Cowboy Joe Block Party, the Labor Day Rotary Breakfast, the Suicide Prevention Safe2Tell Program and the nice weather. Public Hearing/Liquor License Renewals Council member Hegeman declared a Conflict of Interest regarding the renewal application of JoeCo, LLC and abstained from discussion and voting Council member Sellers moved, Council member Welling seconded a motion to table the liquor license renewal application by JoeCo, LLC, license 25-09 to September 17, 2024 at 5:30 pm on the request of the applicant The motion passed with 6 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers. Hegeman abstained A public hearing was conducted by City Attorney, Mark Harris, for all the applicants that filed for the renewal of their liquor licenses within the City of Evanston. Mr. Harris stated that all the applications have been reviewed by the City Clerk and the Wyoming Liquor Division. Notice for the hearing has been advertised for two consecutive weeks in the local newspaper. Mr. Harris asked if there was any opposition or comments regarding any of the liquor license renewals. Public Hearing Set Council member Welling moved, Council member Perkes seconded to set a Public Hearing for October 1, 2024 at 5:30 pm to consider the lease to, and grant of an option to purchase of real property located at 196 Bear River Drive, Evanston, Wyoming, to AGN, LLC. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Public Hearing Set The Council had discussion and heard comments from Tom Farrens, Rick Eskelsen and Shane Wright regarding the Water Tower located in Wahsatch, Utah. After discussion, Council member Perkes moved, Council member Sellers seconded to set a Public Hearing for September 17th, 2024 at 5;30 pm to receive public input concerning amending the City of Evanston 2024-2025 Fiscal Year Budget by increasing general fund expenditures by $84,000 for relocation of a Union Pacific Railroad Water Tower from Wahsatch, Utah to the Evanston Roundhouse and Railyards, as requested by Roundhouse Restoration Incorporated, a Wyoming nonprofit corporation. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Consent Agenda Council member Welling moved, Council member Lind seconded, to approve the following Consent Agenda items: 3 Limited Malt Beverage Permit requested by JP Marketing & Events, LLC, dba Mountain Force MMA for the Mix Martial Arts Competition to be held at Machine Shop on Saturday, September 21st, 2024, from 6:00 pm to 10:00 pm. Limited Malt Beverage Permit requested by the Evanston Chamber of Commerce for the “Light up the Night” Water Lantern Festival to be held at Bear Ponds on Saturday, September 7th, 2024, from 5:00 pm to 9:00 pm. Street Closure Permit requested by the Evanston Chamber of Commerce for the “Light up the Night” Water Lantern Festival to be held at Bear Ponds on Saturday, September 7th, 2024 to close the road at the overpass to the Bear Ponds from 4:00 pm to 10:00 pm. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Ordinance 24-07 Council member Welling moved, Council member Lynch seconded, to pass Ordinance 24-07 on second reading. AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING PROVISIONS OF ARTICLE III, REGULATIONS AND RESTRICTIONS, OF CHAPTER 11 OF THE CODE OF THE CITY OF EVANSTON, WYOMING RELATING TO PAWNS AND PAWNSHOPS, PROVIDING FOR ADOPTION OF PROVISIONS OF WYOMING STATUTES REGULATING PAWN FINANCE CHARGES AND MATURITIES. The motion passed unanimously with 7 yes votes: Williams, Lynch, Lind, Perkes, Welling, Sellers, Hegeman. Discussion Regarding Machine Shop Air Conditioning Councilmember Hegeman requested an update on the Machine Shop Air Conditioning. Mr. O’Neill provided information to the Council. Staff indicated information will be provided at the next regular meeting relating to structural engineers and energy efficiency grants. Resolution 24-59 Council member Lynch introduced Resolution 24-59. Council member Lynch moved, Council member Lind seconded, to adopt Resolution 24-59. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING REPEALING RESOLUTION 23-26, RELATING TO ADOPTION OF COUNCIL RULES OF PROCEDURE AND ORDER. BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: Resolution 23-26 of the City of Evanston, Wyoming is hereby repealed. Williams, Perkes and Welling voting No. Public Comments Gina Morrow presented ideas for fund raising for Machine Shop air conditioning and possible favorable tax treatment for energy efficiency projects. Shelley Horne, Shane Wright and Tom Farrens presented information on the Water Tower and the request of Roundhouse Restoration Inc. and Historic Preservation Commission regarding the Tower.
