July 11, 2016

Chairperson Thompson called the meeting to order at 6:01 p.m.
Chairperson Thompson asked for a motion to approve the agenda for the July 11, 2016
meeting. A motion was made by Commissioner Beaudry, seconded by Commissioner
Smith. Motion carried.
Chairperson Thompson asked for a motion to approve the minutes for the June 6, 2016
meeting. A motion was made by Commissioner Adams, with a change that the
Commissioners never reviewed the petition submitted by Mr. Davis. All Commissioners
agreed and the motion was seconded by Commissioner Beaudry. Motion carried.
With no old business to address, Chairperson Thompson proceeded to new business.
Attorney Boal opened the hearing with CP 16-05 A request by Bear River Veterinary
Clinic for a Conditional Use Permit to allow an animal hospital and kennels on property
located along the east side of Highway 89 North and within the ½ mile jurisdictional
boundary of the City of Evanston corporate limits which is zoned Industrial-Established
(I-E). More specifically, this property is described as being located within the SE ¼ SE
¼ of Section 8 and the SW ¼ SW ¼ of Section 9, Township 15 N., Range 120 W. of the
6th Principal Meridian. The applicant is proposing to construct a new veterinary hospital.
(Section 24-15 C.(3))
CP 16-06 A request by Bear River Veterinary Clinic for a Conditional Use Permit to
allow a dwelling unit for a caretaker person overseeing the industrial use of the property
which is located along the east side of Highway 89 North and within the ½ mile
jurisdictional boundary of the City of Evanston corporate limits. More specifically, this
property is described as being located within the SE ¼ SE ¼ of Section 8 and the SW ¼
SW ¼ of Section 9, Township 15 N., Range 120 W. of the 6th Principal Meridian. This
property is zoned Industrial-Established (I-E). The applicant is proposing to construct a
cottage structure as part of a new veterinary hospital development. (Section 24-15
C.(15))
Attorney Boal explained the legalities of the hearing stating that the applicant(s) would
be heard from first, followed by those who were in favor of the applicant(s), and finally,
from those who were opposed. He explained that this public hearing was a contested
case hearing and that anyone who wished to contest the Commission’s decision must
make it known to him at the closing of the hearing.
Mr. Ben Ledford of Myers and Anderson Architecture, who resides at 849 Front Street
#202, was sworn in. Mr. Ledford explained that Bear River Veterinary Clinic will be
north of town and outside of City limits. The land is not developed and is primarily used
as agriculture. The clinic will treat Large and small animals. There will be the main
clinic and a barn structure for larger animals. All utilities are currently available and the
sewer would be a septic system. They are only able to have one access point from the
highway as per WYDOT. The opening of this will be 40 feet wide and shouldn’t add
extra traffic.
Mr. Ledford address the second request, stating that it will not be a primary residence
but to be used by students while under their study. The location of this will be above the
barn in the loft area.
Commissioner Adams questioned why only one access point on to the highway?
Commissioner Beaudry how did they estimate 55 patients per day?
Mr. Ledford said he would defer the questions to the veterinarian’s.
Mr. Sam Neilson co-owner of Bear River Veterinary Clinic, who resides at 619 Almy
Road #107 was sworn in. Mr. Neilson explained that WYDOT bases the access on
highway by volume. Currently they see about 40 patients per day and have 4
veterinarians on staff. They are hoping with the new larger facility, they will see more
patients.
Attorney Boal had questioned when was the construction of the facility supposed to be
complete?
Mr. Neilson said they were hoping to move in within a year, be fully staffed and
equipped.
Commissioner Adams asked when they were planning on starting construction.
Mr. Neilson said as soon as they are approved.
Commissioner Adams asked will the living quarters be used full time.
Mr. Neilson stated that the students would stay 2-4 weeks max at the most. This clinic
provides actual hands on training for students and would only be 6 months out of the
year. The school sends 6 students at a time and they would rotate. Local students
would stay with their families.
Commissioner Smith can they increase the regress and egress from 40 feet to 60 feet?
Mr. Neilson was told that 40 feet was the max but would ask for 60 feet. He also
explained that between the buildings was a strait shot and patients with long trailers
would have room to turn around by driving around the buildings.
Mr. Neilson explained that the building would be a nice addition to the community and
that they had outgrown the current facility.
Attorney Boal, with no one in the audience, he asked if the Commissioners had any
more questions for the veterinarians. With no further questions, Attorney Boal closed
the hearing.
Chairperson Thompson asked the commissioners if they wanted to include the staff
recommendations. Commissioner Beaudry made a motion to approve the application
with staff recommendations, Commissioner Dean seconded the motion. Chairman
Thompson called for a vote. The motion carried unanimously.
Chairperson Thompson asked about future meetings. Future meetings are scheduled
for August 1st, and Commissioner Adams said he would not be able to make the
meeting. The next meeting was scheduled for September 12th Chairperson Thompson
would not be able to attend this meeting. The following meeting was scheduled for
October 3rd and Commissioner Beaudry said that he would not be able to make that
meeting.
With no further business Chairperson Thompson adjourned the meeting at 6:23 p.m.
