July 1, 2019

Chairperson Thompson called the meeting to order at 6:00 p.m.
Chairperson Thompson asked for a motion to approve the agenda for the July 1, 2019.
A motion was made by Commissioner Smith, seconded by Commissioner Begalla. The
motion carried unanimously.
Chairperson Thompson asked for a motion to approve the minutes from the May 6,
2019 meeting of the Planning Commission/Board of Adjustment. A motion was made
by Commissioner Begalla, seconded by Commissioner Beaudry. The motion carried
unanimously.
Old Business:
With none heard, Chairperson Thompson moved on to new business.
New Business:
Attorney Boal began the public hearings by explaining the legalities of the hearing, and
how it would be conducted. Applicants would be heard from first, followed by those in
favor of the proposal and finally hearing from those who are opposed to the proposal.
He asked each person speaking to clearly state their name and home address for the
record prior to being sworn in to testify. Attorney Boal additionally explained that public
hearings are contested case hearings and that anyone who wishes to contest the
Commission’s decision must make it known to him at the closing of the hearing.
Attorney Boal opened the hearing with BA 23 A request by Jimmy Selvera and Toni
Allen for a Variance to allow a principal building (house) and a detached accessory
building (garage) to encroach 6 feet and 5 feet respectively into the minimum 20-foot
front yard setback area and to allow the house to encroach 10 feet into the minimum 20-
foot rear yard setback area for property located at 701 Uinta Street, Evanston, WY,
which is zoned Low Density Residential-Established (LR-E). (Section 24-16 A. (5) and
(8)) and (Section 24-103)
Jimmy Selvera, whose mailing address is PO Box 401, Evanston, WY was sworn in and
spoke on behalf of the application. Mr. Selvera explained the old home previously
located on the lot had been removed and the lot cleared for building a new, larger
residence.
Mr. Selvera stated is he requesting to encroach into the front and rear yard setbacks.
Mr. Selvera additionally advised he has discussed the request with neighbors and has
not received any negative feedback from them.
Attorney Boal asked Mr. Selvera if the renderings provided would be consistent with the
design of the home.
Mr. Selvera advised they would with the exception that the home would be stucco on
the top portion as opposed to the siding shown.
Chairperson Thompson asked Mr. Selvera if the home would have a basement.
Mr. Selvera advised it would and that it would be used for storage, not finished at this
time. He additionally stated he plans to turn the area between the home and garage into
a patio area.
Chairperson Thompson asked Senior Planner Jacobsen if the line-of-site would be
affected for those using the alley as a result of the garage encroaching into the required
setback distance.
Senior Planner Jacobsen explained that the visibility triangle has been maintained even
with the encroachment into the required setback distance so there should not be an
issue.
Attorney Boal asked if anyone else would like to address the Commission, hearing
none, the hearing was closed.
Chairperson Thompson asked for a motion to approve BA 23. Commissioner Smith
moved to approve BA 23. Seconded by Commissioner Begalla.
Hearing no discussion, Chairperson Thompson called for a vote. The motion passed
unanimously.
Other Business:
Hearing no other business, Chairperson Thompson announced future meeting dates of
August 5, September 9 and October 7.
The meeting adjourned at 6:10 PM.
