Planning & Zoning Commission Board of Adjustment Evanston, Wyoming www.evanstonwy.org Board of Adjustment/Planning & Zoning Commission Meeting Minutes February 3, 2020 6:00 PM at City Hall Board Members Present: Maryl Thompson – Chairperson Tim Ridenour Rowdy Dean Robert Smith Michael Day Kimberly Begalla Staff Present: DuWayne Jacobson, Senior Planner Dean Barker, Evanston City Engineer Dawn Worley, Administrative Assistant III Chairperson Thompson called the meeting to order at 6:02 p.m. Chairperson Thompson asked for a motion to approve the agenda for the February 3, 2020. A motion was made by Commissioner Begalla, seconded by Commissioner Day. The motion carried unanimously. Chairperson Thompson asked for a motion to approve the minutes from the November 4, 2019 meeting of the Planning Commission/Board of Adjustment. A motion was made by Commissioner Begalla, seconded by Commissioner Day. The motion carried unanimously. Old Business: With none heard, Chairperson Thompson moved on to new business. New Business: Attorney Boal began the public hearings by explaining the legalities of the hearing, and how it would be conducted. Applicants would be heard from first, followed by those in favor of the proposal and finally hearing from those who are opposed to the proposal. He asked each person speaking to clearly state their name and home address for the record prior to being sworn in to testify. Mr. Boal additionally explained that public hearings are contested case hearings and that anyone who wishes to contest the Commission’s decision must make it known to him at the closing of the hearing. Attorney Boal opened the hearing with MPA 45, A request by Bart Hutchinson for an Amendment to the Evanston 2010 Comprehensive Plan to change land use from Rural Residential (RR) to Low Density Residential (LR) for the adjusted lot line boundary of Lot 1, Block 1 of the Pioneer Subdivision, which street address is 59 City View Drive, Evanston, Wyoming and for an Amendment to the Evanston 2010 Comprehensive Plan to change land use from Low Density Residential (LR) to Rural Residential (RR) for the adjusted lot line boundary of Lot 2, Block 1 of the Pioneer Subdivision, which street address is 57 City View Drive, Evanston, Wyoming. (Section 24-107) Also including ZC 43, A request by Bart Hutchinson for a Zone Change from Rural Residential (RR) to Low Density Residential-Developing (LR-D) for the adjusted lot line boundary of Lot 1, Block 1 of the Pioneer Subdivision, which street address is 59 City View Drive, Evanston, Wyoming and for a Zone Change from Low Density Residential- Developing (LR-D) to Rural Residential (RR) for the adjusted lot line boundary of Lot 2, Block 1 of the Pioneer Subdivision, which street address is 57 City View Drive, Evanston, Wyoming. (Section 24-107) Both requests presented by Senior Planner DuWayne Jacobsen. Chairperson Thompson asked if the recommendation would allow for continued use of the barn. Senior Planner Jacobsen advised it would. Chairperson Thompson also asked for clarification of property ownership surrounding the properties. Commissioner Smith asked if a residence could be added inside the barn if the owners choose to. Senior Planner Jacobsen advised that is an option. Commissioner Ridenour asked if other buildings or structures will be added to the property. Senior Planner Jacobsen advised not at this time. Commissioner Smith asked if there were plans for subdivision of the surrounding property. Senior Planner Jacobsen advised not at this time. Roy Landes addressed the commission as the property owner. He stated there are no planned changes to the buildings on the property and that the intended use of the property was as a horse pasture and barn. Attorney Boal asked if anyone else wanted to speak either for or against the application. Hearing none, the hearing was closed. Chairperson Thompson asked for a motion to recommend approval of MPA 45 and ZC 43 to the City Council, Commissioner Ridenour moved to recommend approval of MPA 45 and ZC 43 to City Council. Seconded by Commissioner Day. Chairperson Thompson called for a vote. The motion passed unanimously. Attorney Boal continued the hearing with CP 46, A request by Tammey Marcure, representing Sapporo Japanese Steak House, for a Conditional Use Permit to allow an additional ground or pole sign to be constructed along Harrison Drive for property located at 1932 Harrison Drive, Evanston, Wyoming, which is zoned Highway Business- Established (HB-E). The applicant is proposing to construct a ground sign (sumo wrestler figure) that is approximately 6 feet in height. (Section 24-94 D. (2)) Tammy Marcure, 160 County Road, Evanston, WY, was sworn in and spoke on behalf of the application. Ms. Marcure explained the request was to add a large red sumo wrestler figure as an identifier of the restaurant. The sumo wrestler will be placed in a smaller sized parking spot located near the restaurant entrance. Chairperson Thompson asked if this restaurant is affiliated with similar restaurants she has seen in Utah. Ms. Marcure advised it is not. This specific restaurant is affiliated with those located in Rock Springs and other places in Wyoming. Commissioner Day asked if the figure was plastic. Ms. Marcure advised the figure is made of fiberglass. Commissioner Begalla asked if all the associated restaurants have this same figure. Ms. Marcure advised all of the affiliated restaurants do. Attorney Boal asked if anyone else wanted to speak either for or against the application, hearing none, the hearing was closed. Chairperson Thompson asked for a motion to approve CP. Commission Smith moved to approve CP 46, seconded by Commission Ridenour. Commissioner Begalla expressed concern regarding the bright color of the figure and if it would be attractive. Commissioner Ridenour stated he has seen the one in Rock Springs and that it is not a large figure or an eye sore. Commissioner Day stated that it will serve as confirmation of the location and restaurant. Chairperson Thompson called for a vote. The motion passed with 4 Commissioners voting for approval, 1 (Commissioner Begallal) dissenting. Other Business: Attorney Boal proceeded with a major subdivision initial review of the Riverbirch Addition Subdivision. Senior Planner DuWayne Jacobsen presented the request, detailing the staff report. Commissioner Day asked if the lot sizes in the area would be different as a result of the changes to the original plat. Attorney Boal advised that could be a result of vacating the plat and re-platting to accommodate the currently proposed lot size changes. Chairperson Thompson asked if there would be a land conveyance with the proposed change. Senior Planner Jacobsen advised it had already occurred with the previous plat. Hearing no other business, Chairperson Thompson announced future meeting dates of March 4, April 6 and May 4. The meeting adjourned at 6:45 PM. Respectfully Submitted, Dawn Worley
