W ednesday, September 04, 2013 The regular meeting of the Ev erett City Council was called to order at 6:30 p.m., September 4, 2013, in the City Council Chambers of the Ev erett City Hall, President Moore presiding. Upon roll call it was f ound that May or Stephanson and Council Members Roberts, Moore, Murphy, Bader, Stonecipher and Af f holter were present. Council Member Gipson was excused. President Moore led the Pledge of Allegiance. The minutes of the August 28, 2013, City Council meeting were approv ed as printed. Council Member Af f holter abstained f rom the v ote. MAY OR May or Stephanson introduced Fire Chief Murray Gordon, who presented a special award to Fire Captain Dav e DeMarco f or his recent completion of the rigorous Executiv e Fire Of f icer program through the National Fire Academy in Emmitsburg, Mary land. The May or also announced that Public Works Director Dav e Dav is would be prov iding under the Council Brief ing Agenda, an ov erv iew of the City ’s f indings ov er the last week regarding the recent rain storm. COUNCIL Council Member Stonecipher congratulated Dav e DeMarco and the Ev erett Fire Department f or their excellent work and willingness to expand employ ee training. Council Member Roberts reported on a Sound Transit ST3 alignment meeting that was held today. He thanked the May or and city departments f or their support and commitment. He also commented on changes in the nature of storm ev ents and expressed interest in av ailable data. CITY ATTORNEY The City Attorney had no comments. CITIZEN COMMENTS The f ollowing Ev erett residents spoke regarding the recent f looding f rom rainstorm ev ents. Shelley Wey er and Bob Lev y distributed photographs to council members. City Attorney Iles rev iewed the claim process. Claim f orms and clean-up inf ormation is av ailable f rom the Ev erett City Clerk’s of f ice. “Let it Rain” Program Presented by Dav e Dav is, Public Works Department Council Member Stonecipher stated she would like to see the city become a leader in the installation of stormwater best management practices and inquired about construction retrof itting on the new Municipal Court building. Debra Bry ant, CAO/CFO, stated she would seek additional inf ormation f rom the Facilities Department. Authorize the May or to sign Amendment No. 4 to the Agreement with the State of Washington’s Recreation and Conserv ation Of f ice f or Sulliv an Park Ref urbishment Presented by Paul Kaf tanski, Parks Department Authorize the May or to sign the Washington Wildlif e and Recreation Program Project Agreement with the Washington State Recreation and Conserv ation Of f ice f or Senator Henry M. STREET CLOSURE – DERBY DAY S Authorize the closure of Wall Street, Hoy t to Colby, on September 21 and September 22, 2013, 9 a.m. to 5 p.m., f or Derby Day s – The Great Outdoors Adv enture sponsored by the Imagine Children’s Museum. STREET CLOSURE – 5K RUN/WALK Authorize the closure of Wall Street, Rockef eller to Wetmore, and a rolling street closure f rom the Snohomish County Plaza north v ia Colby to 13th Street on October 20, 2013, 7 a.m. to 12:30 p.m., f or a 5K Run/Walk sponsored by the American Cancer Society. Roll was called with all council members v oting y es except Council Member Gipson who was excused. Motion carried. ACTION ITEMS: COUNCIL BILL NO. 1308-27 THIRD AND FINAL READING: AN ORDINANCE approv ing the appropriations of the 2013 rev ised city of Ev erett budget and amending Ordinance No. 3327-13 Mov ed by Council Member Roberts, seconded by Council Member Bader, that this is declared to be the third and f inal reading of Council Bill No. 1308-27 and the City Clerk is directed to call the roll f or the f inal disposition of the ordinance. AY ES: Roberts, Moore, Murphy, Bader, Stonecipher, Af f holter NAY S: None EXCUSED: Gipson Ordinance No. 3338-13 adopted. COUNCIL BILL NO. 1308-28 THIRD AND FINAL READING: AN ORDINANCE approv ing the appropriations of the 2013 rev ised City of Ev erett budget and amending Ordinance No. 3327-13 Council Member Murphy disclosed that he serv es as a v olunteer member of the board of directors and treasurer of the Greater Ev erett Community Foundation. He recused himself f rom the discussion and v oting on this action item and lef t the council chambers. Mov ed by Council Member Roberts, seconded by Council Member Bader, that this is declared to be the third and f inal reading of Council Bill No. 1308-27 and the City Clerk is directed to call the roll f or the f inal disposition of the ordinance. AY ES: Roberts, Moore, Bader, Stonecipher, Af f holter NAY S: None EXCUSED: Gipson Ordinance No. 3339-13 adopted. AGREEMENT – PARATRANSIT SPECIAL NEEDS FORMULA Mov ed by Council Member Af f holter, seconded by Council Member Bader, to authorize the May or to sign the Paratransit Special Needs Formula Agreement – GCB1603 with Washington State Department of Transportation at no cost to the city. Roll was called with all council members v oting y es, except Council Member Gipson who was excused. Motion carried. PLAT APPROVAL – THOMPSON SUBDIVISION Mov ed by Council Member Bader, seconded by Council Member Roberts, to grant f inal approv al of the plat of Thompson Subdiv ision. Council Member Stonecipher stated that the indiv idual requesting the subdiv ision is a f amily member. Upon adv ice f rom the City Attorney, she recused herself f rom the v ote and lef t the council chambers. Roll was called with all council members v oting y es, except Council Member Gipson who was excused. Motion carried. BID AWARD – WATER MAIN REPLACEMENT “M” Mov ed by Council Member Murphy, seconded by Council Member Roberts, to award contract f or the construction of the Water Main Replacement “M” Project to SRV Construction, Inc. in the amount of $1,204,423.04, including Washington State Sales Tax. Roll was called with all council members v oting y es, except Council Member Gipson who was excused. Motion carried. AGREEMENT AMENDED – RIVERFRONT DEVELOPMENT Mov ed by Council Member Bader, seconded by Council Member Af f holter, to authorize the May or to sign Amendment No. 9 to Prof essional Serv ices Agreement with MacLeod Reckord to extend the Agreement completion date to December 31, 2013, at no cost to the City. Roll was called with all council members v oting y es, except Council Member Gipson who was excused. Motion carried.
