W ednesday, October 02, 2013 The regular meeting of the Everett City Council was called to order at 6:30 p.m., October 2, 2013 in the City Council Chambers of the Everett City Hall, Council President Moore presiding. Upon roll call it was found that Mayor Stephanson and Council Members Roberts, Moore, Murphy, Gipson, and Bader were present. Council Members Stonecipher and Affholter were excused. Council President Moore led the Pledge of Allegiance. The minutes of the September 25, 2013, City Council meeting were approved as printed. Council Member Bader abstained from the vote. CITY ATTORNEY The City Attorney had no comments. MAYOR Mayor Stephanson announced that the Seattle-based company Saltchuk has signed a purchase and sales agreement to buy the Everett Kimberly-Clark site. The Mayor introduced Saltchuk Chairman Mark Tabbutt and President Tim Engl who expressed their commitment to the project and plans to redevelop the site as a shipyard and maritime complex, which will initially bring 250 family-wage jobs to the community. Jay Manning, Cascadia Law Group, provided information about site development and cleanup, which will require working closely with the state Department of Ecology. COUNCIL Council Member Bader expressed his excitement for the new opportunities related to the Everett waterfront and gratitude for the hard work that will bring this project to fruition. Council Member Murphy stated he attended the 8 th Annual Governor’s Aerospace Summit where Governor Inslee recognized Mayor Stephanson for his leadership in streamlining the regulatory process to secure the Boeing 777X jet in Washington State. Council Member Roberts stated he also attended the annual Governor’s Aerospace Summit and thanked the Mayor for his leadership on the 777X search. Council Member Roberts stated he had an opportunity to share with the Snohomish County Sheriff and County Executive Lovick the concerns expressed by Council Member Gipson regarding jail release issues. President Moore thanked Council Member Gipson for bringing the jail release issues to the City Council’s attention last week. He stated that Deputy Chief Templeman is currently working with the sheriff’s office. Mayor Stephanson stated that the Sheriff’s Department has already renegotiated a number of contracts that require prisoners that are housed here be returned to their community of origin. CITIZEN COMMENTS Dorian Kostelyk, Everett, spoke regarding second-hand smoke originating from a ground-floor unit in her condominium complex. City Attorney Iles stated that there is no enforcement mechanism under Washington State law; therefore, the City of Everett has no jurisdiction or authority in this area. He stated that the condominium constitutes a private residence and that the issue is a matter for the condominium association. COUNCIL BRIEFING AGENDA COUNCIL BILL NO. 1309-33 FIRST READING: AN ORDINANCE levying the general taxes for the city of Everett for fiscal year commencing January 1, 2014, on all taxable property, both real and personal, subject to taxation thereon, for the purpose of raising a portion of the revenue to carry on city operations for the ensuing year, as required by the charter of the city of Everett and the laws of the State of Washington. BID CALL – CITYWIDE GUARDRAIL IMPROVEMENTS To authorize a call for bids for the Everett Citywide Guardrail Program project. BID CALL – EVERGREEN WAY AND PECKS DRIVE To authorize a call for bids for the Evergreen Way and Pecks Drive – Intersection Safety project. JOB COMPLETE – 2013 BIOSOLIDS REMOVAL To accept the 2013 Biosolids Removal project as complete and authorize the Mayor to sign the certificate of completion with Tervita/American Process Group allowing the release of the city held retainage. Roll was called with all council members voting yes, except Council Members Stonecipher and Affholter who were excused. Motion carried. ACTION ITEMS: AGREEMENT AMENDED – 2012 COMPREHENSIVE SEWER PLAN Moved by Council Member Roberts, seconded by Council Member Murphy, to authorize the Mayor to sign Supplemental Agreement No. 2 to the professional services agreement with HDR Engineering, Inc. to provide additional engineering services for the 2012 Comprehensive Sewer Plan in the amount of $72,000.00. Roll was called with all council members voting yes, except Council Members Stonecipher and Affholter who were excused. Motion carried. AGREEMENT AMENDED – LEASE/ANTENNA SPACE Moved by Council Member Bader, seconded by Council Member Roberts, to authorize the Mayor to execute the First Amendment to the lease agreement with T-Mobile West, LLC for antenna space on the roof of the Wall Street Building. Roll was called with all council members voting yes, except Council Members Stonecipher and Affholter who were excused. Motion carried. AGREEMENT – BRIDGE INSPECTION Moved by Council Member Roberts, seconded by Council Member Bader, to authorize the Mayor to sign Bridge Inspection Agreement #GCB 1315 with the Washington State Department of Transportation for periodic inspections of city-owned bridges in an amount not to exceed $85,000.00. Roll was called with all council members voting yes, except Council Members Stonecipher and Affholter who were excused. Motion carried. AGREEMENT AMENDED – MONITORING/EVERETT MUNICIPAL COURT Moved by Council Member Bader, seconded by Council Member Murphy, to authorize the Mayor to sign Amendment No. 1 to the Monitoring Service Agreement with BI Incorporated for the Everett Municipal Court at no cost to the city. Roll was called with all council members voting yes, except Council Members Stonecipher and Affholter who were excused. Motion carried. AGREEMENT – PURCHASE REIMBURSEMENT Moved by Council Member Bader, seconded by Council Member Roberts, to authorize the Mayor to sign the Purchase Reimbursement Agreement with the Washington State Administrative Office of the Court to reimburse Everett Municipal Court. Roll was called with all council members voting yes, except Council Members Stonecipher and Affholter who were excused. Motion carried.
