December 16, 2015 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., December 16, 2015, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Bader presiding. Upon roll call, it was found that Mayor Stephanson and Council Members Roberts, Moore, Murphy, Bader, Stonecipher, and Tuohy were present. Council Member Gipson was excused. Council Member Tuohy led the Pledge of Allegiance. The minutes of the December 9, 2015, City Council meeting were approved as printed. MAYO R Mayor Stephanson complimented Council Member Tuohy for a well- run Public Safety Subcommittee meeting, which was held earlier this evening. COUNCIL Council Member Roberts reported on his recent attendance at the Mental Health Alternatives ( MAP) court, and complimented Everett Municipal Court Judge Van Slyck and her team for their great work. He asked President Bader to schedule a brief meeting on January 6, 2016, of the General Government Subcommittee. Additionally, Council Member Roberts expressed a desire to move forward with the next steps for a climate action plan sometime in January. Council Member Murphy followed up with a reminder that the Budget Subcommittee has earmarked $ 30, 000 for a climate action plan proposal. Council Member Tuohy provided a liaison report on her attendance at the Library Board meeting last evening. She thanked everyone who contributed to this evening' s Public Safety Subcommittee meeting and announced that the next meeting of the subcommittee will be held on January 13, 2016. 404  December 16, 2015 Council Member Moore complimented Council Member Tuohy for a well- structured meeting of the Public Safety Subcommittee. He provided a liaison report on his attendance today at the Public Facilities District Board meeting and open house. He also announced that Board Member Tom Gaffney will not be returning to the PFD Board. Council Member Murphy requested a resolution be drafted to honor Tom Gaffney for his 12 years of service on the PFD Board. Debra Bryant, Administration, stated she would look into it. President Bader confirmed the next meeting of the General Government Subcommittee will be held on January 6, 2016. The Public Safety Subcommittee will meet on January 13, 2016, and February 10, 2016. ADMINISTRATION UPDATE ON PRIOR BUSINESS Debra Bryant, Administration, had no report. CITY ATTORNEY Assistant City Attorney Benedict requested an executive session, anticipated to last no longer than 45 minutes, concerning a potential litigation matter pursuant to RCW 42. 30. 110( 1)( i)( b)( c) with no announcement to follow. CITIZEN COMMENTS Jackie Minchew, Everett, spoke about climate change and the COP 21 climate conference held in Paris. Dana Ray Nelson, Washington State University, introduced WSU Puget Sound students who assisted in preparing a statistical report related to the Fitch & Associates fire efficiency study. Council Member Roberts requested a copy of the work completed by the WSU students. 405  December 16, 2015 Megan Dunn, Everett, spoke about public safety, and she encouraged council members to invest in public safety. Gary Watts, Everett, spoke about the conditions created by street people congregating on Smith Avenue. Police Chief Dan Templeman provided an update in response to Mr. Watts' concerns. COUNCIL BRIEFING AGENDA: Riverfront Update Presented by Dave Davis, Public Works; Gary Young and Nick Abdelnour, Polygon Northwest COUNCIL BILL 1512- 52 FIRST READING: AN ORDINANCE directing the Chief of Police to request the Washington State Liquor and Cannabis Board recognize the Core Commercial Areas Alcohol Impact Areas adopted pursuant to Ordinance No. 3430- 15 and impose mandatory restrictions on off- premise alcohol sales Debra Bryant, Administration, stated a briefing on this item was held on December 9, 2015. Police Lt. Bruce Bosman was available to answer questions. COUNCIL BILL 1512- 53 FIRST READING: AN ORDINANCE assuming the rights, powers, functions, and obligations of the Everett Transportation Benefit District Presented by Richard Tarry, Public Works 406  December 16, 2015 Authorize the Mayor to sign the Interlocal Agreement with South Correctional Entity for inmate housing services in the form substantially as provided. Presented by Hil Kaman, Prosecutor' s Office CONSENT ITEMS: Moved by Council Member Murphy, seconded by Council Member Roberts, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 6929 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 1, 004, 513. 30 for the period of November 28, 2015, through December 4, 2015. RESOLUTION - PAYROLL To adopt Resolution No. 6930 acknowledging payment of audited and approved payroll claims against the City of Everett in the amount of$ 3, 606, 313 for the period ending December 4, 2015. JOB COMPLETE —STORMWATER FACILITY ACCESS RETROFIT PROJECT To accept the Stormwater Facility Access Retrofit Project as complete and authorize the Mayor to sign the Certificate of Completion with Taylor' s Excavators allowing the release of the City held retainage. PUBLIC HEARING — AMENDMENTS TO SNOHOMISH COUNTY CONSOLIDATED PLAN President Bader opened a public hearing regarding a resolution concerning amendments to the Snohomish County 2015- 2019 Consolidated Plan. Becky Ableman McCrary, Planning, provided a brief presentation to council members. President Bader invited public comment. There was no response. RESOLUTION — AMENDMENTS TO THE SNOHOMISH COUNTY 2015- 2019 CONSOLIDATED PLAN Moved by Council member Roberts, seconded by Council Member Moore, to adopt Resolution No. 6931 concerning amendments to the Snohomish County 2015- 2019 Consolidated Plan. AGREEMENT AMENDED —TULALIP WATER PIPELINE EASEMENT Moved by Council Member Moore, seconded by Council Member Murphy, to authorize the Mayor to sign Amendment No. 1 to the Tulalip Water Pipeline Easement from the Port of Everett, through the Riverside Business Park, substantially in the form attached. AGREEMENT —TULALIP WATER PIPELINE LICENSE SEGMENT 2 Moved by Council Member Murphy, seconded by Council Member Moore, to authorize the Mayor to sign the Tulalip Water Pipeline Segment 2 — Burlington Northern Sante Fe Pipeline License in the amount of $ 91, 401. 00 to allow the pipeline to cross the Railroad right-of-way. Motion carried. 413  December 16, 2015 AGREEMENT— SAFE HARBOR- COOPERATIVE HABITAT ENHANCEMENT Moved by Council Member Roberts, seconded by Council Member Murphy, to authorize the Mayor to sign the Safe Harbor-Cooperative Habitat Enhancement Agreement with the United States Fish and Wildlife Service and Washington State Department of Natural Resources to protect listed wildlife.
