January 27, 2016 The regular meeting of the Everett City Council was called to order at 12: 30 p. m., January 27, 2016, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Murphy presiding. President Murphy announced that the Public Hearing, Agenda Item No. 5, had been pulled from the agenda. He welcomed anyone in the audience who wished to speak on this item to do so under citizen comments. Upon roll call, it was found that Mayor Stephanson and Council Members Moore, Murphy, Franklin, Bader, and Tuohy were present. Council Members Roberts and Stonecipher were excused. Council Member Bader was expected to be a few minutes late. Council Member Moore led the Pledge of Allegiance. The minutes of the January 20, 2016, City Council meeting were approved as printed. MAYOR APPOINTMENTS / REAPPOINTMENTS Moved by Council Member Moore, seconded by Council Member Franklin, to concur with the following appointment: Animal Shelter Advisory Committee Appointment of Nathan Shelby to Position 3 for a six- year term, ending December 31, 2021. Roll was called with all council members voting yes, except Council Members Roberts and Stonecipher who were excused, and Council Member Bader who was expected to be a few minutes late. Motion carried. 28  January 27, 2016 COUNCIL Council Member Franklin provided a report on the first Lodging Tax Advisory meeting that was held this morning. She stated the committee would be reviewing grants at their next meeting, which is scheduled for February 10, 2016, 10: 00 a. m. She encouraged the public to attend the next Everett Housing Forum scheduled for February 1, 2016, 6: 30 p. m., at the Historic Everett Theatre. Council Member Franklin also reported on her attendance yesterday at the Poverty Immersion workshop hosted by the Puget Sound Clean Air Agency. Council Member Tuohy provided a liaison report on her attendance at the Historical Commission meeting last night. She also noted that the Public Safety Subcommittee has been postponed and a date will be announced when confirmed. ADMINISTRATION UPDATE ON PRIOR BUSINESS Debra Bryant, Administration, had no report. CITY ATTORNEY City Attorney Iles had no report. CITIZEN COMMENTS Council Member Bader entered the Council Chambers at 12: 37 p. m. Gail Chism, Everett, spoke about maintenance responsibilities on the Polygon Riverfront project site. She also spoke about permitting for a safe house in the Lowell neighborhood. Dave Davis, Public Works, provided an update on the Riverfront Development project. 29  January 27, 2016 COUNCIL BRIEFING AGENDA: Approve the 2016 Cultural Arts Commission Capital and Programming Grant Awards as designated, in an amount not to exceed$ 40, 000. 00. Presented by Carol Thomas, Cultural Arts Council Member Tuohy recused herself from the discussion on this item. She stated that she is employed by the Arts Council of Snohomish County, dba Schack Art Center. She remarked that although she has a fixed salary, which is unrelated to any grant award, she is recusing herself to avoid any appearance of conflict. Council Member Tuohy left the council chambers and returned following the briefing at 12: 44 p. m. Authorize Mayor to sign Amendment No. 1 to the Professional Services Agreement with HDR Engineering, Inc. to provide engineering and construction management services for the Water Pollution Control Facility Diversion Structure Zero Project in an amount not to exceed$ 821, 038. 00. Presented by Dave Davis, Public Works PROPOSED ACTION ITEMS: COUNCIL BILL 1601- 01 SECOND READING: AN ORDINANCE creating a Special Improvement Project entitled, South Everett Forest Preserve Recreation Improvements," Fund 354, Program 047, to accumulate all costs for the improvement project 30  January 27, 2016 CONSENT ITEMS: Moved by Council Member Bader, seconded by Council Member Tuohy, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 6942 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 5, 510, 539. 68 for the period of January 9, 2016, through January 15, 2016. Roll was called with all council members voting yes, except Council Members Roberts and Stonecipher who were excused. Motion carried. PUBLIC HEARING: This item was pulled from the agenda. ACTION ITEMS: RESOLUTION —2016 HUMAN NEEDS FUNDS Adopt Resolution for expenditure of 2016 Human Needs funds in the amount of$ 423, 200. 00. Council Member Tuohy recused herself from any discussion or action on this item. She stated that she is employed by the Arts Council of Snohomish County, dba Schack Art Center. She remarked that although she has a fixed salary, which is unrelated to any grant award, the Schack Art Center is one of the grant recipients. 31  January 27, 2016 Council Member Franklin recused herself from any discussion or action on this item. She stated that she is employed as the CEO of Cocoon House, which is also one of grant recipients. Council Members Tuohy and Franklin left the council chambers. Under the direction of the City Attorney, no action was taken due to lack of afull quorum. President Murphy stated this item will be moved to next week' s agenda. Council Members Tuohy and Franklin returned to the council chambers at 12: 47 p. m. DONATION — MUNICIPAL ART COLLECTION Moved by Council Member Franklin, seconded by Council Member Bader, to accept the donations of James Arrabito and Jessica Pavish adding the artworks to the Municipal art Collection. Council Member Tuohy thanked James Arrabito and Jessica Pavish for this donation. Roll was called with all members voting yes, council except Council Members Roberts and Stonecipher who were excused. PURCHASE —JOHN DEERE BACKHOE LOADER Moved by Council Member Bader, seconded by Council Member Tuohy, to approve the purchase of a John Deere 710K Backhoe Loader from Washington State Contract 00410 in the amount of 179, 907. 00 including Washington State sales tax. 32  January 27, 2016 Roll was called with all council members voting yes, except Council Members Roberts and Stonecipher who were excused. AGREEMENT —SUPERVISION OF DIVERSION PROGRAMS Moved by Council Member Bader, seconded by Council Member Moore, to authorize the Mayor to sign the Professional Services Agreement with Friendship Diversion Services for supervision of diversion programs in an amount not to exceed $ 80, 000. 00. Roll was called with all voting yes, except Council council members Members Roberts and Stonecipher who were excused. Motion carried. AGREEMENT AMENDED — KRONOS SOFTWARE LICENSING Moved by Council Member Franklin, seconded by Council Member Bader, to authorize the Mayor to sign the Addendum to the Kronos Sales, Software Licensing and Services Agreement for an additional cost of$ 35, 180. 00 with no Washington State sales tax. Roll was called with all council members voting yes, except Council Members Roberts and Stonecipher who were excused. Motion carried. AGREEMENT AMENDED — KASCH PARK SYNTHETIC TURF REPLACEMENT Moved by Council Member Bader, seconded by Council Member Tuohy, to authorize the Mayor to sign the Amendment No. 1 to Project Agreement with the Washington State Recreation and 33  January 27, 2016 Conservation Office for the Kasch Park Synthetic Turf Replacement Project.
