October 12, 2016 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., October 12, 2016, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Murphy presiding. Upon roll call, it was found that Council Members Moore, Murphy, Franklin, Bader, Stonecipher, and Tuohy were present. Mayor Stephanson and Council Member Roberts were excused. Council Member Franklin led the Pledge of Allegiance. The minutes of the October 5, 2016, City Council meeting were approved as printed. The minutes of the October 1, 2016, City Council workshop were approved as printed. Council Member Stonecipher abstained from the vote. MAYOR Mayor Stephanson was excused. COUNCIL Council Member Franklin reminded the public that nominations for the Richard Wendt Award of Excellence and Mayor' s Arts Awards are due October 25, 2016. She also invited the public to attend the Community Streets Initiative task force forum to be held on October 25, 6: 30 p. m., at the Historic Everett Theatre. Council MemberTuohy provided a recap of the Public Safety Subcommittee meeting held earlier this evening. Council Member Bader reminded the public that the annual Monte Cristo Awards event will be held on Thursday, October 13, 6: 30 p. m., at the Everett Performing Arts Center. He also provided a liaison report on his attendance at the Puget Sound Regional Council Growth Management Policy Board meeting last week. 321  October 12, 2016 Council Member Stonecipher provided a liaison report on her attendance at the Parks Board meeting last evening. She also announced that Green Everett Day, originally scheduled for Saturday, October 15, was rescheduled to Saturday, October 22, due to stormy weather. President Murphy reported on his attendance at the groundbreaking and tree planting ceremony of the MTorres Innovation Center for Advanced Manufacturing. He also provided a liaison report on his attendance at the Snohomish Health District Board meeting yesterday. ADMINISTRATION UPDATE ON PRIOR BUSINESS Debra Bryant, Administration, had no report. CITY ATTORNEY City Attorney Iles requested an executive session, anticipated to last no longer than 15 minutes, concerning a labor/ legal matter pursuant to RCW 42. 30. 110( 1)( i)( c) and RCW 42. 30. 140( 4)( b) with no announcement to follow. CITIZEN COMMENTS Jackie Minchew, Everett, spoke about climate change. J. T. Dray, Everett, commented on the General Government Subcommittee meeting and the Charter Review Committee' s recommendation to establish a committee separate from the Transportation Advisory Committee ( TAC) that would be devoted exclusively to Everett Transit. Aaron Powell, Everett, spoke in opposition to the proposed location for the low-barrier housing project and encouraged Council to look for another site. 322  October 12, 2016 PROPOSED ACTION ITEMS: COUNCIL BILL 1609- 42 SECOND READING: AN ORDINANCE levying the general taxes for the City of Everett for fiscal year commencing January 1, 2017, on all taxable property, both real and personal, subject to taxation thereon, for the purpose of raising a portion of the revenue to carry on City operations for the ensuing year, as required by the Charter of the City of Everett and the laws of the State of Washington CONSENT ITEMS: Moved by Council Member Bader, seconded by Council Member Stonecipher, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7037 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 1, 399, 593. 10 for the period of September 24, 2016, through September 30, 2016. RFP - 2016- 077 FOR PARKS DEPARTMENT CLASS AND FACILITY REGISTRATION AND SCHEDULING SYSTEM To authorize the Request for Proposals 2016- 077 for Parks Department Class and Facility Registration and Scheduling System. JOB COMPLETE —TRANSMISSION LINE 5 CROSSING PILCHUCK RIVER PROJECT To accept the Transmission Line 5 Crossing Pilchuck River Project as complete and authorize the Mayor to sign the Certificate of Completion with Frank Coluccio Construction Company allowing the release of the retainage bond. 323  October 12, 2016 JOB COMPLETE — EVERGREEN WAY PEDESTRIAN WALKWAY PROJECT To accept the Evergreen Way Pedestrian Walkway Project as complete and authorize the Mayor to sign the Certificate of Completion with Kamins Construction allowing the release of the retainage bond. PUBLIC HEARING — COUNCIL BILL 1609- 38: President Murphy opened a public hearing regarding Council Bill No. 1609- 38, a proposed ordinance pertaining to the State Environmental Policy Act Categorical Exemption Thresholds for Minor New Construction, amending Ordinance No' s 2534- 01, 1348- 87 and 3272- 1 ( EMC Chapter 20. 04), as amended, and including a Special Public Notice Procedure amending Ordinance No' s. 3185- 10 and 2530- 01 ( EMC Chapter 15. 24), as amended. Council Member Franklin stated that as CEO for Cocoon House, the proposed legislation may impact a potential Cocoon house development. After discussing and reviewing with the city attorney, this SEPA amendment applies to the city as a whole and was made independent of any possible impacts on Cocoon House or any other specific projects, so there is no conflict of interest to prevent her from voting. President Murphy invited public comment.
