July 19, 2017 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., July 19, 2017, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Tuohy presiding. Upon roll call, it was found that Council Members Roberts, Moore, Murphy, Franklin, Bader, Stonecipher, and Tuohy were present. Mayor Stephanson was excused. Council Member Franklin led the Pledge of Allegiance. The minutes of the July 12, 2017, City Council meeting were approved as printed. MAYOR Mayor Stephanson was excused. COUNCIL Council Member Franklin reminded the public that the Project Homeless Connect event will happen on Thursday. She stated she attended the Junior Police Academy graduation and she provided an update on the Safe Streets Plan and the timeline for the supportive housing facility. Council Member Roberts stated that the Transportation Advisory Committee ( TAC) will meet on Thursday. Council MemberMurphy provided a liaison report from the Lowell neighborhood meeting and announced Lowell Days will take place on August 12 from 10 a. m. to 3 p. m. ADMINISTRATION UPDATE ON PRIOR BUSINESS Debra Bryant, Administration, asked Police Chief Dan Templeman to provide an update on police staffing. Chief Templeman provided an update on current staffing levels and a recruitment update. 234  July 19, 2017 CITY ATTORNEY City Attorney Iles had no comments. CITIZEN COMMENTS Sean Renfro, Everett, spoke about gang related issues and crime. Jackie Minchew, Everett, spoke about climate change. COUNCIL BREIFING AGENDA: COUNCIL BILL 1707- 30 FIRST AND SECOND READING: AN ORDINANCE of the Everett City Council concerning a vote on the issue of creating districts to elect five of seven Everett City Council members and requesting that the Snohomish County Auditor place this measure on the ballot of the November 2017 ballot Presented by Jim Iles, Legal Discussion took place regarding a petition to amend the City Charter to provide for council district elections, which is being circulated by Everett Districts Now ( EDN). If the petition obtains sufficient verified signatures, then by ordinance the petition would be transmitted to the County for inclusion on the ballot. The deadline for the County to receive the transmittal is August 1 , 2017 for inclusion on the November 2017 ballot. By combining the 1st and 2nd ordinance readings on July 19, Council will be able to adopt the ordinance on third reading on July 26, 2017, if prior to that date, the County informs the City that the petition has sufficient verified signatures. Liz Vogeli, Greg Lineberry, Megan Dunn, Mary Rollins, Michael Trujillo, and Jonathan Peebles, all of Everett, spoke in favor of districting and of the Everett Districts Now ballot measure. 235  July 19, 2017 Considerable Council discussion ensued regarding the petition including the possibility of various Council initiated districting ballot measure possibilities,a Council advisory ballot, district boundaries, number of at large positions versus district positions, uniqueness of 2017 for initiative petition validation, number of validated signatures EDN acquired, districting commission, interest in additional community possibilities of a engagement including a public hearing, County submittal deadline for the November ballot, and scheduling subsequent discussion on this issue at a night meeting when all Council members are present. In accordance with Council Member Stonecipher' s request that was supported by President Tuohy, Legal was asked to prepare language for Council' s consideration that can be incorporated into the proposed 3rd ordinance by amendment on reading placing EDN' s districting measure on the upcoming November ballot by Council action rather than the initiative process. It was clarified that the proposed ordinance is on for 3rd reading at Council' s next meeting at which time language revisions could be considered. Because of the County's August 1 deadline and the need to accommodate schedules, President Tuohy indicated a special Council meeting would be 3rd held before August 1 for the reading of this ordinance. She will coordinate scheduling with council members. COUNCIL BILL 1707- 31 FIRST READING: AN ORDINANCE relating to Lewd Conduct, amending Ordinance No. 1145- 85 as amended. ( Chapter 10. 24 EMC) Presented by Leslie Tidball, Prosecutor' s Office COUNCIL BILL 1707- 32 FIRST READING: AN ORDINANCE concerning the regulation of Quick Service Facilities including Barista Stands Presented by Ramsey Ramerman, Legal 236  July 19, 2017 Lena Reedy, Everett; Schyler Lifschultz; Ed Archer, Edmonds; and Sean Renfro, Everett; all spoke in opposition to the proposed ordinance. Fontelle Jones and Donna Konier, both of Everett, spoke in favor of the proposed ordinance. PROPOSED ACTION ITEMS: COUNCIL BILL 1707- 27 SECOND READING: AN ORDINANCE extending the termination of the Multiple Family Property Tax Exemption Program until January 1 , 2019, amending Section 16 of Ordinance No. 2347- 98, as amended ( EMC Chapter 3. 78) COUNCIL BILL 1707- 28 SECOND READING: AN ORDINANCE creating a special improvement project entitled, Grand Avenue Park Pedestrian Bridge," Fund 303, Program 103, to accumulate all costs for the improvement project and repealing Ordinance No. 3413- 14 COUNCIL BILL 1707- 29 SECOND READING: AN ORDINANCErelating to Parking, amending Section 2 of Ordinance No. 2180- 96, as amended. ( EMC 46. 28. 020) Cletus Skrabak, Everett, spoke in opposition to the proposed ordinance. Debra Bryant, Administration, stated this item will be discussed on Thursday's TAC meeting and returned back to Council for review. 237  July 19, 2017 CONSENT ITEMS: Moved by Council Member Bader, seconded by Council Member Franklin, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7143 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 978, 093. 78 for the period of July 1, 2017, through July 7, 2017. RESOLUTION — ELECTRONIC TRANSFER CLAIMS To adopt Resolution No. 7144 acknowledging payment of audited and approved electronic claims against the City of Everett in the amount of$ 6, 630, 621. 84 for the period of May 1, 2017, through May 31, 2017. ACTION ITEMS: PURCHASE — CATERPILLAR 311F RR EXCAVATOR Moved by Council Member Moore, seconded by Council Member Bader, to authorize the purchase of one Caterpillar 311F RR Excavator from National Joint Powers Alliance contract in the amount of 194, 717. 50, including Washington State sales tax. Motion carried. 238  July 19, 2017 RESOLUTION — LOCUTION FIRE STATION ALERTING SYSTEM Moved by Council Member Franklin, seconded by Council Member Bader, to adopt Resolution No. 7145 waiving public bidding requirements and approving a sole source purchase of Locution Fire Station Alerting System from Locution Systems, Inc., in the amount of 194, 336. 84, including Washington State sales tax and authorize the Mayor to sign Agreement No. EVERE- 6ST- 170703. Roll was called with all council members voting yes. Motion carried. AGREEMENT AMENDED —INMATE HOUSING Moved by Council Member Bader, seconded by Council Member Franklin, to authorize the Mayor to sign Amendment # 2 to the agreement for inmate housing with South Correctional Entity( SCORE) regarding an increase to the daily bed rate effective January 1, 2018. AGREEMENT — 2016 COMMUNITY HOUSING IMPROVEMENT PROGRAM HOME FUNDS Moved by Council Member Franklin, seconded by Council Member Roberts, to authorize the Mayor to sign Contract Amendment HCS- 16- 42- 1601- 198 ( 1) for the Everett - 2016 Community Housing Improvement Program ( CHIP) HOME Funds Agreement between Snohomish County and the City of Everett. 239  July 19, 2017 Roll was called with all council members voting yes. AGREEMENT —LAKE CHAPLAIN TRACT Moved by Council Member Roberts, seconded by Council Member Franklin, to authorize the Mayor to sign Washington Department of Fish and Wildlife Law Enforcement Services contract for services at the Lake Chaplain Tract. Michael Rainey, representative of AFSCME, requested this item be tabled until the August 2 meeting for a review by AFSCME' s labor management committee. Moved by Council Member Stonecipher, seconded by Council Member Murphy to table this item. Roll was called with all council members voting yes. Motion carried. AGREEMENT —FIRE AND EMERGENCY MEDICAL SERVICES Moved by Council Member Murphy, seconded by Council Member Franklin, to authorize the Mayor to sign the Mutual Aid Agreement between Commander, Navy Region Northwest, the City of Everett, the City of Marysville and Snohomish County Fire District 21 for the provision of fire and emergency medical services.
