October 11, 2017 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., October 11, 2017, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Tuohy presiding. Upon roll call, it was found that Mayor Stephanson and Council Members Roberts, Moore, Murphy, Franklin, Bader, Stonecipher, and Tuohy were present. Lars Hjorten, member of Boy Scout Troop No. 137, led the Pledge of Allegiance. The minutes of the October 4, 2017, City Council meeting were approved as printed. MAYOR Mayor Stephanson announced that the 2017 Monte Cristo Awards ceremony would take place tomorrow at the Snohomish County PUD Auditorium at 6: 30 p. m. The Mayor also invited Police Chief Templeman to provide an update regarding a recent shooting and gang activity. Police Chief Templeman addressed youth violence that is impacting the community. COUNCIL Council members thanked Chief Templeman for his commitment to the community. Council Member Moore commented on the Public Safety Subcommittee meeting held earlier this evening. Council Member Franklin provided a recap from the Public Safety Subcommittee meeting. She also reported on her attendance at the Riverside Neighborhood meeting. Council Member Bader provided a liaison report on his attendance at the Puget Sound Regional Council Growth Management Policy Board meeting. 339  October 11, 2017 Council Member Murphy asked about staffing levels at the Everett Police Department. Police Chief Templeman provided an update on Police Department staffing levels. Council Member Murphy reported on his attendance at the Snohomish Health District Board meeting. He also provided a liaison report on his attendance at the Parks Board meeting. Council Member Murphy announced that the next Budget and Finance Subcommittee meeting is scheduled for October 18 at 5: 15 p. m. Council Member Stonecipher apologized for missing the Public Safety Subcommittee meeting. Council Member Roberts announced that next General Government Subcommittee meetings are scheduled on November 1 and December 6. He also reported on his attendance at the Port Gardner Neighborhood meeting. Council Member Roberts announced that the Everett Office of Emergency Management and the University of Washington are hosting an Open House on October 17, 5: 30- 7: 30 p. m., at the Everett Main Library Auditorium. Council Member Roberts also spoke about the funding for the police academy and announced that the Snohomish County Cities Board will meet on November 16. President Tuohy spoke about the agenda for the upcoming Council Retreat. ADMINISTRATION UPDATE ON PRIOR BUSINESS Debra Bryant, Administration, had no report. CITY ATTORNEY City Attorney Iles requested an executive session, anticipated to last no longer than 30 minutes, concerning two legal matters pursuant to RCW 42. 30. 110( 1)( i)( c) with no announcement to follow. 340  October 11, 2017 CITIZEN COMMENTS Sean Renfro, Everett, spoke about a police matter. Jean Rittmann, Everett, spoke about code violations committed by the McDonald' s restaurant that is located next to her property. Debra Bryant, Administration, stated that a contact was made by City staff with McDonald' s representative. Steve Oss, President of Amalgamated Transit Union 883, spoke about the workers' compensation insurance program provided by the city. Debra Bryant, Administration, provided a clarification regarding the process for workers' compensation insurance program administered by the City. She also stated a request for proposal for a workers' comp. administrator will be presented to the Council in the next couple of weeks. Council Member Moore asked if labor representatives will be part of the RFP process. Debra Bryant, Administration, stated she will verify with Human Resources and get back to the Council. Jackie Minchew, Everett, spoke about the Pledge of Allegiance and the flag. Aaron Powell, Everett, spoke about gang violence in Everett and the low- barrier housing project. COUNCIL BRIEFING AGENDA: Council Member Franklin stated that she consulted with City Attorney Iles, and it is appropriate for her to participate in today' s briefing. City Attorney Iles stated that he had conversations with Council Members Franklin and Bader and concluded that there is no legal conflict for Council Members Franklin and Bader to participate in a discussion and / or action regarding the following agenda items: proposed system development fee 341  October 11, 2017 waiver for affordable housing development and the reallocation of$ 400, 000 in 2017 budgeted dollars to support the Housing Hope Hopeworks Station II Project. Proposed System Development Fee Waiver for Affordable Housing Development Presented by Becky McCrary, Planning Considerable discussion ensued. Information regarding the following questions will be presented to the Council at a later date: subsidy programs availability, the property tax abatement program and the traffic impact fee waiver total costs in prospective, comparison to the programs offered by neighboring jurisdictions, fee waivers used by other jurisdictions. CONSENT ITEMS: Moved by Council Member Bader, seconded by Council Member Murphy, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7171 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 1, 052, 735. 95 for the period of September 23, 2017, through September 29, 2017. BID CALL —2018 BIOSOLIDS REMOVAL To authorize the call for bids for the 2018 Biosolids Removal. BID CALL — ANNUAL SUPPLY OF WATER TREATMENT CHEMICALS To authorize Bid Call 2017- 054 for the annual supply of water treatment chemicals. 342  October 11, 2017 Roll was called with all council members voting yes. ACTION ITEMS: RESOLUTION — NEW HOLLAND TRACTOR AND US MOWER MOVING ARM Moved by Council Member Bader, seconded by Council Member Franklin, to adopt Resolution No. 7172 declaring one New Holland Tractor and one US Mower Moving Arm surplus and authorizing the sale at public auction. Roll was called with all council members voting yes. Motion carried. COUNCIL BILL 1709- 48 THIRD AND FINAL READING: AN ORDINANCE approving the reallocation of $ 400, 000 in 2017 budgeted dollars to support the Housing Hope Hopeworks Station II Project and amending Ordinance No. 3569- 17 Moved by Council Member Franklin, seconded by Council Member Moore, that this is declared to be the third and final reading of Council Bill No. 1709- 48. Mayor Stephanson provided an overview of the affordable housing project. Council Member Murphy clarified the steps the City Council took to review this item. Council Member Moore assured the public of an existing control mechanism. 343  October 11, 2017 Bob Creamer, Everett, expressed his concerns regarding the transparency of the process. Aaron Powell, Everett, spoke against the low- barrier housing project and reallocation of dollars to support Housing Hope. Fred Safstrom, CEO Housing Hope, thanked Mayor Stephanson for his leadership and thanked city council members for careful consideration. He also provided an update on the status of the project. Considerable discussion ensued. The City Clerk was directed to call the roll for the final disposition of the ordinance. QUIT CLAIM DEED — PROPERTY ADJACENT TO WEST MARINE VIEW DRIVE Moved by Council Member Bader, seconded by Council Member Moore, to authorize the Mayor to sign the Quit Claim Deed to the Port of Everett for title clearing purposes for property adjacent to West Marine View Drive. Roll was called with all council members voting yes. Motion carried. 344  October 11, 2017 AGREEMENT AMENDED — HILLSIDE RUNOFF IN THE MARSHLAND BASIN Moved by Council Member Roberts, seconded by Council Member Franklin, to authorize the Mayor to sign Amendment No. 1 to the Interlocal Agreement regarding increased hillside runoff in the Marshland Basin due to upland development, providing a one- year extension. Roll was called with all council members voting yes. Motion carried. AGREEMENT —2018 INMATE HOUSING Moved by Council Member Moore, seconded by Council Member Murphy, to authorize the Mayor to sign the Interlocal Agreement with the Yakima County Jail for 2018 inmate housing. Roll was called with all council members voting yes. Motion carried. LEASE AGREEMENT ( RECONSIDERATION) — THE UNITED STATES FOREST SERVICE - DEPARTMENT OF AGRICULTURE Authorize the Mayor to sign Agreement No. 12 to the Lease Agreement with the United States Forest Service - Department of Agriculture to extend lease an additional five years. LEASE AGREEMENT ( RECONSIDERATION) — THE UNITED STATES FOREST SERVICE PUGET SOUND INTERAGENCY COMMUNICATION CENTER Authorize the Mayor to sign Agreement No. 4 to the Lease Agreement with the United States Forest Service Puget Sound Interagency Communication Center to extend lease an additional five years. 345  October 11, 2017 Mike Palacios, Real property, provided an update on the structure of the contract and term of the lease. Considerable discussion ensued including whether to provide the Forest Service leases for both Agreements No. 12 and No. 4 for a five year period, subject to the City' s right to terminate the leases upon 18 months' notice if the City deems it needs the space for its own use or to permit the leases to continue on a month- to- month basis while staff secures additional information. Moved by Council Member Moore, seconded by Council Member Murphy to act on reconsideration of these two leases by tabling Council' s prior action on Item 10, Agreement No. 12 to the Lease Agreement with the United States Forest Service - Department of Agriculture to extend lease an additional five years, and Item 11, Agreement No. 4 to the Lease Agreement with the United States Forest Service Puget Sound Interagency Communication Center to extend lease five years, and instead, to authorize an extension of the current leases on a month- to- month basis at the current rate while staff secures additional information, including possible leases ( for both Agreements No. 12 and No. 4) for a 5 year period with a rate escalation, subject to the City' s right to terminate the leases upon 18 months' notice if the City deems it needs the space for its own use.
