January 23, 2019 The regular meeting of the Everett City Council was called to order at 12: 30 p. m., January 23, 2019, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Bader presiding. Upon roll call, it was found that Council Members Roberts, Moore, Murphy, Vogeli, Bader, Stonecipher, and Tuohy were present. Mayor Franklin was excused. Council Member Tuohy led the Pledge of Allegiance. The minutes of the January 16, 2019, City Council meeting were approved as printed. MAYOR Mayor Franklin was excused. COUNCIL Council Member Murphy provided a liaison report from the Twin Creek- Cascade View and the Pinehurst- Beverly Park Neighborhood meetings. Council Member Vogeli provided a liaison report from the Senior Center Advisory Board. She stated she attended the Casino Road Stakeholders meeting and the Historical Commission meeting on Tuesday. Council Member Roberts stated that Sound Transit has asked to brief Council on the ST3 Lynnwood expansion. He also thanked staff for the installation of the crosswalk at Alverson Boulevard and West Marine View Drive. Council Member Tuohy also thanked Ryan Sass and staff for the installation of the crosswalk at Alverson Boulevard and West Marine View Drive. Council Member Bader, on behalf of Mayor Franklin, presented a recommendation for an appointment to the Lodging Tax Advisory Board. 29  January 23, 2019 APPOINTMENT Moved by Council Member Roberts, seconded by Council Member Stonecipher, to concur with the following appointment: Lodging Tax Advisory Board Appointment of Brian Harmon to Position 3 for the remainder of a four- year unexpired term expiring December 31, 2022. Roll was called with all council members voting yes. Motion carried. ADMINISTRATION UPDATE ON PRIOR BUSINESS Lyle Ryan, Administration, had no report. CITY ATTORNEY City Attorney Iles had no comments. CITIZEN COMMENTS Kathy Christensen, Everett; Riall Johnson, Lynnwood; and Ben Young, Everett, all spoke about the staff memo sent to the Mayor regarding juvenile justice. Dennis Hacker, Everett, spoke about right- hand turn lanes and bus lanes on Evergreen Way. Council Member Roberts suggested this recommendation be forwarded to the Transportation Advisory Committee. 30  January 23, 2019 COUNCIL BREIFING AGENDA: Award Request for Proposals # 2018- 038 Open Data Platform to Socrata Inc. and authorize the Mayor to execute a two- year contract with three one- year options. Presented by Steven Hellyer, Information Technology, and Zachary Mathews, Library Discussion ensued regarding data collection and annual data, security of the data, staff time and costs, updating of the data, public records requests associated with data, and assisting citizens with the open data portal. CONSENT ITEMS: Moved by Council Member Murphy, seconded by Council Member Roberts, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7331 authorizing claims against the City of Everett in the amount of $ 4, 276, 385. 27 for the period of January 5, 2019, through January 11, 2019. RESOLUTION — PAYROLL To adopt Resolution No. 7332 acknowledging the payment of payroll claims against City of Everett in the amount of $ 5, 141, 555. 65 for the the period ending January 5, 2019. ACTION ITEMS: AGREEMENT - EVERETT PERFORMING ARTS CENTER MANAGEMENT Moved by Council Member Murphy, seconded by Council Member Vogeli, to authorize the Mayor to sign the agreement with the Village 31  January 23, 2019 Theatre for the management of the Everett Performing Art Center through December 31, 2025, in the amount of $ 150, 000 for the first year, with annual CPI adjustments based on the Consumer Price Index. Council Member Murphy thanked staff for working on the contract. Council Member Stonecipher requested that staff provide a brief cost savings clarification contained in the contract. Kimberly Shelton, Parks, provided clarification on the net savings and incentives for community groups to use the Everett Performing Arts Center. Roll was called with all council members voting yes. GRANT AWARDS — CULTURAL ARTS CAPITAL AND PROGRAMMING Moved by Council Member Roberts, seconded by Council Member Moore, to approve the 2019 Cultural Arts Capital and Programming Grant Awards as designated, in an amount not to exceed $ 40, 000. Council Member Tuohy recused herself from the discussion on this item. She stated that because her employer is a potential recipient of the grant and although she has a fixed salary, which is unrelated to any grant award, she is recusing herself to avoid any appearance of conflict. Council Member Tuohy left council chambers at 1: 21 p. m. Council Member Stonecipher stated she appreciated the broad spectrum of award recipients. Council Member Murphy thanked the Cultural Arts Commission. 32  January 23, 2019 Roll was called with all council members voting yes, except Council Member Tuohy who was recused. Motion carried. Council Member Tuohy returned to council chambers at 1: 23 p. m. PURCHASE — TWO AMBULANCES Moved by Council Member Moore, seconded by Council Member Stonecipher, to authorize the purchase of two ambulances from Braun Northwest utilizing Marysville Fire contract in the amount of Inc., 403, 688. 64, including Washington State sales tax and motor vehicle excise taxes. Roll was called with all council members voting yes. Motion carried. COUNCIL BILL 1901- 01 THIRD AND FINAL READING: AN ORDINANCE extending Fund 336 " Water and Sewer System Improvements Fund," to accumulate all design and construction costs for critical Water and Sewer System Capital Improvements, amending Sections 2 and 4 of Ordinance No. 3213- 11 Matt Welborn, Public Works, provided clarification regarding the costs. He stated that the funds are already allocated, and the proposed ordinance allows for spending authority. He stated that any new projects would be presented to Council for consideration in the future. COUNCIL BILL 1901- 02 THIRD AND FINAL READING: AN ORDINANCE extending Fund 338 " Solid Waste Improvement Fund," to accumulate design and construction costs for Solid Waste infrastructure improvements, amending Section 4 of Ordinance No. 2989- 07 Matt Welborn stated that the proposed ordinance is required to balance Fund 338. Moved by Council Member Roberts, seconded by Council Member Tuohy, that this is the declared to be the third and final reading of Council Bill No. 1901- 02 and the City Clerk was directed to call the roll for the final disposition of the ordinance.
