January 22, 2020 The regular meeting of the Everett City Council was called to order at 12: 30 p. m., January 22, 2020, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Tuohy presiding. Upon roll call, it was found that Council Members Roberts, Moore, Murphy, Vogeli, Stonecipher, and Tuohy were present. Mayor Franklin and Council Member Bader were excused. Council Member Moore led the Pledge of Allegiance. The minutes of the January 8, 2020, City Council meeting were approved as printed. Council Member Moore abstained from the vote. MAYOR Mayor Franklin was excused. COUNCIL Council Member Moore thanked public works crews and first responders for their work last week during the snow. Council Member Roberts provided a liaison report on his attendance at the Snohomish County Cities meeting. He also provided an update from the Delta Neighborhood meeting. Council Member Roberts spoke about a draft resolution that declares a climate emergency. Council Member Vogeli commented on the Planning Commission meeting. She also spoke about two new businesses in Everett: Everett Pet Nutrition and Jag ArtWorks. Council Member Murphy announced that the next Lodging Tax Advisory Committee meeting is scheduled forJanuary 27, at 3 p. m. in the council chambers. He also announced that Serena Williams is scheduled to join the Fed Cup team on February 7 and 8 at the Angels of the Winds Arena. 8  January 22, 2020 President Tuohy, on behalf of the Mayor, recommended the following appointment: APPOINTMENT Moved by Council Member Roberts, seconded by Council Member Stonecipher, to concur with the following appointment: Civil Service Commission Appointment of Ethel McNeal to Position 2 for a six- year term ending December 31, 2025. Roll was called with all council members voting yes, except Council Member Bader who was excused. Motion carried. President Tuohy provided a liaison report on her attendance at the Cultural Arts Commission meeting, and she announced that the 27th annual Mayor' s Arts Awards Ceremony is scheduled for February 13. President Tuohy also announced that agenda item No. 14, related to formation of the Everett Station District BIA, has been pulled from the agenda. ADMINISTRATION UPDATE ON PRIOR BUSINESS Chief of Staff Lyle Ryan had no report. CITY ATTORNEY Assistant City Attorney Flora Diaz had no comments. 9  January 22, 2020 PUBLIC COMMENT Robert Creamer, Everett, spoke about the death of Samiu " Sam" Bloomfield. Peter Newland, Alan Mizuta, and Carm Pierce, all of Everett, provided a presentation related to the formation of the Everett Station District BIA and potential lack of accuracy in the information provided to council in December. Considerable discussion ensued regarding the need for an audit of the supporters, the proposed administrative cost of the BIA, and data showing who was in support and changed the vote later. C. J. Ebert, Everett, spoke in opposition to the proposed formation of the Everett Station District BIA. CONSENT ITEMS: Moved by Council Member Murphy, seconded by Council Member Roberts, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7466 acknowledging the payment of audited and approved claims against the City of Everett in the amount of $ 1, 400, 271. 93 for the period of December 28, 2019, through January 3, 2020. RESOLUTION - CLAIMS To adopt Resolution No. 7467 acknowledging the payment of audited and approved claims against the City of Everett in the amount of $6, 062, 424. 56 for the period of January 4, 2020, through January 10, 2020. RESOLUTION — PAYROLL To adopt Resolution No. 7468 authorizing payroll claims against the City of 10  January 22, 2020 Everett in the amount of $ 4, 055, 835. 56 for the period ending December 21, 2019. RESOLUTION — PAYROLL To adopt Resolution No. 7469 authorizing payroll claims against the City of Everett in the amount of$ 5, 345, 364. 76 for the period ending January 4, 2020. AGREEMENT— DESIGN OF THE EDGEWATER CREEK BRIDGE REPLACEMENT To authorize the Mayor to sign the Local Agency A& E Professional Services Consultant Agreement with TranTech Engineering, Inc. for the design of the Edgewater Creek Bridge Replacement Project in the amount of$ 1, 803, 078. RFP— PARKING MANAGEMENT SERVICES — EVERPARK GARAGE To authorize release of Request for Proposal # 2019- 124 Parking Management Services— Everpark Garage. JOB COMPLETE— LEGION GOLF COURSE STORMWATER DETENTION PROJECT To accept the Legion Golf Course Stormwater Detention Project with Rodarte Construction, Inc., as complete, and authorize the Mayor to sign the Certificate of Completion allowing the release of the retainage bond. PER CAPITA CONTRIBUTION — SNOHOMISH HEALTH DISTRICT SERVICES To authorize the Mayor to sign an Interlocal Agreement with Snohomish Health District for a per capita contribution by the City for Health District Services. APPLICATION - NORTH CASCADES COMMERCIAL USE AUTHORIZATION To authorize the Mayor to sign the North Cascades Commercial Use Authorization application. 11  January 22, 2020 BID CALL— 2020 BIOSOLIDS REMOVAL PROJECT To authorize call for Bids for the 2020 Biosolids Removal Project. RFP — CONCESSION SERVICES FOR EVERETT STATION AND PARK LOCATIONS To authorize release of Request for Proposal # 2019- 103 Concession Services for Everett Station and Park locations. RESOLUTION — RECOVERY OF ABATEMENT COSTS To adopt Resolution No. 7470 authorizing recovery of abatement costs pursuant to EMC 1. 20. 090 at 1712 19th Street. Council Member Vogeli requested before and after pictures of the property. Eileen Hinkley, Code Enforcement, stated she will provide the requested photographs. DONATION — SCULPTURE FROM EVERGREEN ARBORETUM & GARDENS To concur with the recommendation of the Cultural Arts Commission and accept the sculpture donation from Evergreen Arboretum & Gardens into the City of Everett' s Public Art Collection. Council Member Tuohy recognized members of Evergreen Arboretum & Gardens and thanked them for the donation. Motion carried. 12  January 22, 2020 PUBLIC HEARING - COUNCIL BILL 1611- 60: COUNCIL BILL 1911- 60 THIRD AND FINAL READING: AN ORDINANCE establishing an Everett Station District Business Improvement Area ( BIA); providing for the levy of a special assessment upon real property ( and the owners thereof) within the area; the deposit of revenues in a special account and expenditures therefrom; and providing for an implementing agreement with an Everett Station District property owners association or similar organization This item was pulled from the agenda. ACTION ITEMS: AGREEMENT AMENDED— DEVELOPMENT OF THE EVERETT EVENTS CENTER. Council Member Murphy recused himself from any discussion and action on this item due to his current appointment to the PFD Board. Council Member Murphy left the council chambers at 1: 01 p. m. Moved by Council Member Roberts, seconded by Council Member Stonecipher, to authorize the Mayor to sign Addendum # 2 to Interlocal Agreement for development of the Everett Events Center. Roll was called with all council members voting yes, except Council Member Murphy who was recused and Council Member Bader who was excused. Motion carried. Council Member Murphy returned to the Council Chambers at 1: 02 p. m. 13  January 22, 2020 RESOLUTION — PROHIBITED AREAS Moved by Council Member Murphy, seconded by Council Member Vogeli, to adopt Resolution No. 7471 establishing prohibited areas regarding court orders in prostitution related criminal cases. Roll was called with all council members voting yes, except Council Member Bader who was excused. Motion carried. GRANT AWARDS— 2020 CULTURAL ARTS CAPITAL& PROGRAMMING GRANT AWARDS Council Member Tuohy stated that she is currently employed by an organization that is on the recommended list for grant awards, and although she has a fixed salary that is unaffected by this award, she recused herself from any discussion or action related to this item. Council Member Tuohy left the council chambers at 1: 03 p. m. Moved by Council Member Stonecipher, seconded by Council Member Vogeli, to concur with the recommendation of the Cultural Arts Commission and approve the 2020 Cultural Arts Capital & Programming Grant Awards as designated, in an amount not to exceed $ 40, 000. Roll was called with all council members voting yes, except Council Member Bader who was excused and Council Member Tuohy who was recused. Motion carried. Council Member Tuohy returned to the Council Chambers at 1: 06 p. m. 14  January 22, 2020 COUNCIL BRIEFING AGENDA: Planning Commission' s recommended Climate Action Plan. Presented by Bob Bolerjack, Administration; Christy Shelton, Cascadia Consulting Group Troy Olsen, Lake Stevens, spoke about a ban of natural gas and the need for a responsible alternative. Laura McMurray, Everett, spoke about green spaces and urban forestry expansion. She also encouraged council to adopt the proposed plan. Adopt a Resolution for Expenditures of 2020 Human Needs Funding. Presented by Becky McCrary, Community, Planning, and Economic Development Council Member Stonecipher requested that programs be listed based on priorities. COUNCIL BILL 2001- 01 FIRST READING: AN ORDINANCE vacating the east/ west alley in the 3100 block of Rockefeller Avenue adjacent to Lot 1, Block 739, plat of Everett Land Company' s First Addition to Everett Presented by Paul McKee, Real Property PROPOSED ACTION: Council Member Moore stated that as the chief financial officer with Everett Public Schools, he must recuse himself from any discussion on Council Bill 1911- 54. Council Member Moore left the council chambers at 1: 46 p. m. 15  January 22, 2020 COUNCIL BILL 1911- 54 SECOND READING: AN ORDINANCE removing " Supportive Housing" as a Permitted Use in Single- Family Zones, repealing Ordinance No. 3500- 16 ( EMC 19. 39. 155), and revising Parking Standards for Supportive Housing, amending Section 2 of Ordinance No. 3616- 18 ( EMC 19. 34. 020) Fred Safstrom stated that Housing Hope will not make an application under this ordinance and suggested Council look at the proposed ordinance in general and not related to the Norton project only.
