January 29, 2020 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., January 29, 2020, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Tuohy presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Vogeli, Bader, and Tuohy were present. Council Members Moore and Murphy were excused. Council Member Roberts led the Pledge of Allegiance. The minutes of the January 22, 2019, City Council meeting were approved as printed. Council Member Bader abstained from the vote. MAYOR Mayor Franklin provided a report from her attendance at the United States Conference of Mayors held in Washington D. C. last week. Fire Chief Dave DeMarco introduced new firefighters Becca Benoit, Mike Dove, Ilya Grishchenko, Thomas Holert, William Powers, and Jacob Jones. APPOINTMENTS/ REAPPOINTMENTS Moved by Council Member Bader, seconded by Council Member Stonecipher, to concur with the following appointment: Animal Shelter Advisory Board Reappointment of Kara Langus to Position 1 for a six- year term ending December 31, 2025. Roll was called with all council members voting yes, except Council Members Moore and Murphy who were excused. Motion carried. 18  January 29, 2020 Moved by Council Member Roberts, seconded by Council Member Stonecipher, to concur with the following appointments: Transportation Advisory Committee Appointment of Hal Gausman to Position 1 for a six- year term ending December 31, 2025. Appointment of Richard Smith to Position 3 for the remainder of a six- year term ending December 25, 2021. Appointment of Michael Thomas to Position 7 for the remainder of a six- year term ending December 31, 2024. COUNCIL Council Member Roberts provided an update from the Association of Washington Cities meeting held Wednesday afternoon. He also stated that the Puget Sound Clean Air Agency is hosting a public hearing for clean transportation at the Everett Public Main Library on Thursday, January 30, at 4 p. m. Council Member Vogeli provided a report from the Casino Road Stakeholders meeting. She also stated there is a March in Solidarity scheduled for February 2, at the Walter Hall Soccer Fields. Council Member Vogeli stated the first Community Police Academy is accepting applications through the city website. She provided a report from the Historical Commission meeting held Tuesday evening. Council Member Bader provided reports from the Snohomish County Health District meeting and the Animal Shelter Advisory Board meeting. Council Member Stonecipher provided a report from the Parks Board retreat held on Saturday. President Tuohy provided a report from the Council of Neighborhoods and the Pinehurst Neighborhood meetings. President Tuohy thanked Council Member Bader for his leadership as Council President in 2019. 20  January 29, 2020 ADMINISTRATION UPDATE ON PRIOR BUSINESS Chief of Staff Lyle Ryan stated that Council Bill 1911- 60, which would establish an Everett Station District Business Improvement Area ( BIA), has been referred back to the Everett Station District Business Alliance for additional information. They have been given a deadline of February 26 to provide the requested information. CITY ATTORNEY City Attorney David Hall had no report. PUBLIC COMMENT Jean Rittmann, Everett, spoke about a legal and land use issue. Paula Townsell, Everett, reminded the public to register to vote prior to the primary election. William Parent, Everett, spoke about affordable housing and jobs. Youth Advisory Board update Presented by Terra Pilch- Bisson, Ethan Shettlesworth, and Lianne Kniest of the Youth Advisory Board Mayor Franklin and council members thanked the Youth Advisory Board for their service and stated they look forward to working with the Board. JOB COMPLETE- NORTH BROADWAY TRANSIT IMPROVEMENT PROJECT To accept the North Broadway Transit Improvement Project with McCann Construction as complete and authorize the Mayor to sign the Certificate of Completion allowing the release of retention bond. JOB COMPLETE- WATERMAIN REPLACEMENT" S" PROJECT To accept the Watermain Replacement " S" Project with Reese Construction Company as complete and authorize the Mayor to sign the Certificate of Completion allowing the release of retention bond. BID CALL— BROADWAY 10T" STREET TO 19T" STREET INTERSECTION SAFETY PROJECT To authorize Call for Bids for the Broadway 10th Street to 19th Street Intersection Safety Project. AGREEMENT— SNOHOMISH COUNTY REGIONAL TRAINING CONSORTIUM To authorize the Mayor to sign the Snohomish County Regional Training Consortium Interlocal Agreement to share fire training resources. AGREEMENT — WATER TRANSMISSION LINE REPLACEMENT AT 91sT AVENUE SE To authorize the Mayor to sign the Interlocal Agreement with the City of Lake Stevens regarding Water Transmission Line Replacement at 91st Avenue SE, in substantially the form provided. 22  January 29, 2020 AGREEMENT AMENDED — FIRE ADMINISTRATION BUILDING TENANT IMPROVEMENTS PROJECT To authorize the Mayor to sign Amendment No. 1 to the Professional Services Agreement with Botesch, Nash & Hall Architects, P. S. to provide additional architectural and engineering services for the Fire Administration Building Tenant Improvements Project in the form substantially provided. AGREEMENT AMENDED— SMITH ISLAND HABITAT RESTORATION PROJECT To authorize the Mayor to sign the Amendment No. 4 to the Professional Services Agreement with ICF Jones and Stokes, Inc. for a one year, no cost, time extension for the Smith Island Habitat Restoration Project. PUBLIC HEARING— COUNCIL BILL 1912- 70 President Tuohy opened a public hearing regarding Council Bill 1912- 70, a proposed ordinance changing the maximum building heights in the Metro Everett Subarea Plan, amending Section 1 of Ordinance No. 3613- 18 and amending maximum building heights in Metro Everett in the Zoning code, amending Ordinance No. 1671- 89 as amended by Section 1 of Ordinance No. 3615- 18. Moved by Council Member Roberts, seconded by Council Member Bader, to close the public hearing. Motion carried. 24  January 29, 2020 AGREEMENT— MEDICAL PROGRAM DIRECTOR Moved by Council Member Stonecipher, seconded by Council Member Bader, to authorize the Mayor to sign the Professional Services Agreement with North Sound Emergency Medicine for the Medical Program Director of Emergency Medical Services at the annual cost of $ 55, 440 in 2020, $ 57, 108 in 2021, and 58, 824 in 2022. RESOLUTION — NAMING OF PARK AT 4730 COLBY AVENUE Pam Kepford, Laura Reed, Paula Townsell, Deb Fox, Steve Fox, and Mary Rollins, all of Everett, spoke in favor of naming the park after Emma Yule. Bryan Partington, Everett, spoke about having a new park in the neighborhood. Gail Chism, Everett, who was not in attendance, called prior to have on record her recommendation to name the park after Emma Yule. Moved by Council Member Vogeli, seconded by Council Member Stonecipher, to adopt Resolution No. 7474 naming the park adjacent to the YMCA located at 4730 Colby Avenue after Emma Yule. Motion carried. 25  January 29, 2020 RESOLUTION — CLIMATE ACTION PLAN Moved by Council Member Roberts, seconded by Council Member Stonecipher, to adopt Resolution No. 7475 adopting the Planning Commission' s recommended Climate Action Plan. Dylan Sluder, Bellevue, and Johnathan Witte, Everett, spoke in favor of the resolution. Robert Knoll, Everett, spoke about the use of natural gas. Roll was called with all council members voting yes, except Council Members Moore and Murphy who were excused. Motion carried. RESOLUTION — CLIMATE EMERGENCY Discussion ensued regarding the current state of the climate, legislative initiatives to address climate issues, carbon fees, and the need for local action. The following people spoke in favor of the proposed resolution: Robert Creamer, Everett Kevin Phan, Everett Pam Kepford, Everett Raven Campbell, Everett Paula Townsell, Everett Jonathan Witte, Everett Spring Petta, Everett Mary Rollins, Everett Moved by Council Member Vogeli, seconded by Council Member Bader, to change the verbiage from climate emergency to climate crisis. 26  January 29, 2020 Roll was called with all council members voting yes, except Council Member Roberts who voted no and Council Members Moore and Murphy who were excused. Council Member Vogeli moved to amend the parking requirements. The motion died for lack of a second. RESOLUTION - COMMUNITY RENEWAL AREA Moved by Council Member Bader, seconded by Council Member Vogeli, to adopt A Resolution No. 7477 designating a portion of the Metro Everett Area a Community Renewal Area suitable for community renewal projects and directing that a Community Renewal Plan be prepared. Dan Eernissee, Economic Development, stated there will be future council agenda items for the Community Renewal Plan, which includes a public hearing.
