March 4, 2020 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., March 4, 2020, in the City Council Chambers of the William E. Moore Historic City Hall, Council Member Stonecipher presiding. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Moore, Murphy, Vogeli, Bader, and Stonecipher were present. Council President Tuohy was excused. Council Member Moore led the Pledge of Allegiance. The minutes of the February 19, 2019, City Council meeting were approved as printed. Council Member Moore abstained from the vote. The minutes of the February 26, 2019, City Council retreat were approved as printed. Council Member Moore abstained from the vote. MAYOR Mayor Franklin provided an update on the City' s response to COVID- 19 ( Novel Coronavirus). She stated this evening she would be asking for a three- step approach, beginning with an emergency ordinance relating to the Mayor' s emergency authority, a resolution declaring an emergency waiving competitive bidding requirements, and a Mayoral proclamation of Civil Emergency. Fire Chief Dave DeMarco provided an update on the Fire Department' s response to COVID- 19. Moved by Council Member Vogeli, seconded by Council Member Roberts, to adopt the following emergency ordinance: AN EMERGENCY ORDINANCE relating to Civil Emergencies, amending Section 1 of Ordinance 43- 69 The City Clerk is directed to call the roll for the disposition of the ordinance. 61  March 4, 2020 AYES: Roberts, Moore, Murphy, Vogeli, Bader, Stonecipher NAYS: None EXCUSED: Tuohy Ordinance 3732- 20 adopted. RESOLUTION — EMERGENCY REGARDING COVID- 19 Moved by Council Member Murphy, seconded by Council Member Roberts, to adopt Resolution No. 7486, declaring an Emergency regarding COVID- 19 ( Novel Coronavirus) for the purpose of waiving competitive bidding requirements. Roll was called with all council members voting yes, except Council Member Tuohy who was excused. Motion carried. Mayor Franklin read the Mayoral Proclamation of Civil Emergency. APPOINTMENTS Moved by Council Member Roberts, seconded by Council Member Bader to concur with the following appointments: Chip Loan Review Committee Appointment of Jeannie Sears to Position 2 for a four-year term ending December 31, 2023. Appointment of John Traynor to Position 3 for a four-year term ending December 31, 2023. Motion carried. COUNCIL Council members thanked Mayor Franklin and echoed her comments to keep community members safe during the outbreak of COVID- 19. Council Member Murphy provided a liaison report from the Public Facilities District meeting. Council Member Stonecipher provided a liaison report from the Parks Board meeting. ADMINISTRATION UPDATE ON PRIOR BUSINESS Chief of Staff Lyle Ryan stated that the public hearing regarding Council Bill 2002- 7, a proposed ordinance increasing the number of permitted Recreational Marijuana retail stores, is scheduled for April 1. CITY ATTORNEY City Attorney David Hall had no comment. PUBLIC COMMENT There were no citizens who wished to speak. 63  March 4, 2020 CONSENT ITEMS: Moved by Council Member Roberts, seconded by Council Member Murphy, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 7487 authorizing claims against the City of Everett in the amount of $ 1, 158, 978. 02 for the period of February 8, 2020, through February 14, 2020. RESOLUTION - CLAIMS To adopt Resolution No. 7488 authorizing claims against the City of Everett in the amount of $ 1, 753, 650. 88 for the period of February 15, 2020, through February 21, 2020. RESOLUTION — PAYROLL CLAIMS To adopt Resolution No. 7489 authorizing payroll claims against the City of Everett in the amount of$ 4, 200,714.95 for the period ending February 15, 2020. BID AWARD— MAINTENANCE, REPAIR, AND OPERATING MATERIALS To award Bid # 2019- 123 Maintenance, Repair, and Operating ( MRO) Materials to Ferguson Enterprises, Core & Main, HD Fowler, HB Jaeger and Consolidated Supply for one year, with four additional — one- year extension options for approximately$ 750, 000 annually. RESOLUTION — FARE FREE EARTH DAY To adopt Resolution No. 7490 for the City of Everett, establishing April 22, 2020 as " Fare Free Earth Day." 64  March 4, 2020 AGREEMENT — ENERGY SAVINGS PERFORMANCE CONTRACTING PROGRAM To authorize Interagency Agreement with the Washington State Department of Enterprise Services Energy Program for an Energy Savings Performance Contracting Program in an estimated annual amount of $ 300, 000 for a period not to exceed three years. AGREEMENT— NORTH SOUTH 211 SERVICES To authorize the Mayor to sign a Professional Services Agreement with the Volunteers of America, North South 211. AGREEMENT— WORK CREW DIVERSION PROGRAM To authorize the Mayor to execute a Professional Services Agreement with Hope Works Social Enterprise. AGREEMENT- BROKERAGE AND ADVISORY SERVICES To authorize the Mayor to sign the Professional Services Agreement with Alliant Employee Benefits to provide brokerage and advisory services associate with employee benefit plans. AGREEMENT - HEALTH REIMBURSEMENT ARRANGEMENT/ VOLUNTARY EMPLOYEE BENEFIT ASSOCIATION To authorize the Mayor to sign all plan adoption agreements with Benefit Plans Administrative Services Inc. ( BPAS) for the Health Reimbursement Arrangement/ Voluntary Employee Benefit Association. JOB COMPLETE- WEST MARINE VIEW DRIVE UTILITIES PROJECT To accept the West Marine View Drive Utilities Project with KLB Construction Inc., as complete and authorize the Mayor to sign the Certificate of Completion. 65  March 4, 2020 BID CALL- TRICKLING FILTER# 2 MEDIA REPLACEMENT PROJECT. To authorize Call for Bids for the completion of the Trickling Filter # 2 Media Replacement Project. RESOLUTION - US- 2 COALITION AND CAPACITY STUDY OF US- 2 To adopt Resolution No. 7491 supporting efforts of the US- 2 Coalition and funding for a Capacity Study of US- 2. ACTION ITEMS: AGREEMENT- OPERATE SMALL CELL SITES ON CITY OWNED FACILITIES Moved by Council Member Murphy, seconded by Council Member Bader, to authorize the Mayor to execute Wireless Communications Facilities Master License Agreement with Verizon Wireless to operate small cell sites on city owned facilities. Motion carried CHANGE ORDER - EVERETT DOWNTOWN STREETSCAPE IMPROVEMENT PROJECT PHASE 2, PHASE 3, AND RUCKER WATER MAIN REPLACEMENT Moved by Council Member Bader, seconded by Council Member Moore, to authorize the Mayor to sign Change Order No. 3 to the Construction Contract with Jansen Inc. for the Everett Downtown Streetscape Improvement Project 0 66  March 4, 2020 Phase 2, Phase 3, and Rucker Water Main Replacement in the amount of 708, 861. 41. Council Member Murphy questioned the additional time, supplies, and funds needed for this change order. Ryan Sass, Public Works, provided an overview of the change order. Considerable discussion ensued regarding the funds needed, the timeline for the project, concern for residents in the project area, noise variances, and the supplies used to complete the project. Council members discussed holding an executive session to address the change order. City Attorney Hall stated an executive session would be scheduled after legal analysis and with appropriate staff in session. Moved by Council Member Roberts, seconded by Council Member Bader, to table Change Order No. 3 to the Construction Contract with Jansen Inc. for the Everett Downtown Streetscape Improvement Project Phase 2, Phase 3, and Rucker Water Main Replacement in the amount of$ 708, 861. 41. COUNCIL BRIEFING AGENDA: Local Transit Service Analysis— Phase 2 Presented by Paul Kaftanski, Administration Council Member Bader requested the December transit workshop documents. Mr. Kaftanski stated he would provide to Council. 67  March 4, 2020 Council Member Bader requested information of the funding model at Community Transit. Mr. Kaftanski stated he would inquire with Community Transit. Discussion ensued regarding service level adjustments, fare box recovery, effects to transit funds with the passage of Initiative 976, free ride areas in other transit agencies, and transit planning to 2040. Traffic Engineering Topics: Marked Crosswalks, Traffic Signal System, Traffic Safety Projects Presented by Tim Miller, Euneka Richards, and Corey Hert, Traffic Engineering Discussion ensued regarding safe routes to schools, pedestrian crosswalk signal timing, crosswalk equipment updates, and a possibility of posting traffic education videos on the City website. Council Member Bader requested briefings on traffic calming devises and stop lines at intersections.
