December 15, 2021 The regular meeting of the Everett City Council was called to order on Wednesday, December 15, at 6: 30 p. m., Council President Stonecipher presiding. President Stonecipher announced that the Council is still abiding by Governor Inslee' s Healthy Washington guidelines, City Council meetings will and as a result, continue to be held remotely with all meetings scheduled at 6: 30 p. m. each Wednesday, except the fourth Wednesday of the month when the meeting is scheduled at 12: 30 p. m. He stated the City Council is prepared to open the Council chambers when public health considerations indicate it is safe to do so. Council President Stonecipher announced that citizens are encouraged to view meetings live on Comcast Channel 21, Frontier Channel 29, and on the City website at www. everettwa. gov/ citycouncil. Individuals may also call in to listen to the live meeting at any point by dialing 425. 616. 3920, Conference ID 724 887 726#. He stated the public is welcome to provide comments on any matter via email at council@everettwa. gov. He also provided instructions for community members wishing to participate live during a future meeting. He asked that comments be respectful, and remarks limited to three minutes. He added that the Council does not allow comments on certain issues such as: campaigning of any kind —whether for or against ballot measures or candidates running for office— is legally prohibited at the meeting, and comments focused on personal matters that are unrelated to City business. Upon roll call, it was found that Mayor Franklin and Council Members Roberts, Moore, Murphy, Bader, Stonecipher, and Tuohy were present. Council Member Vogeli was excused. On behalf of the City council, Council Member Moore acknowledged the original inhabitants of this place, the sduhubs people and their successors, the Tulalip Tribes. Council Member Bader led the Pledge of Allegiance. APPROVAL OF MINUTES: The minutes of the December 8, 2021, City Council meeting were approved as printed. 1  December 15, 2021 MAYOR Mayor Franklin congratulated Sharon Fuller, City Clerk, on her upcoming retirement. She also reminded citizens that the Holidays at The Gipson Center event will be held at the VOA Carl Gipson Center on Saturday and Sunday, December 18- 19, 2021, from 2 p. m. to 5 p. m. for age 50 and over, and open to everyone from 5 p. m. to 8 p. m. She added that Council Member Bader will make an appearance as Santa. Mayor Franklin noted that under the Administration Update, staff would address Council Member Murphy' s questions relating to Clare' s Place. COUNCIL Council Member Bader introduced and read into the record the following proposed resolution. He thanked Administration and City Attorney David Hall for drafting the resolution in response to a request from him and Council Member Murphy. RESOLUTION — POTENTIAL COMMUNITY IMPACTS OF EMERGENCY SHELTER AND/ OR TEMPORARY HOUSING FACILITY Moved by Council Member Bader, seconded by Council Member Murphy, to adopt Resolution No. 7723 concerning Potential Community Impacts of an Emergency Shelter and/ or Temporary Housing Facility. Council Members thanked Council Members Bader and Murphy for bringing forward a well- structured resolution that provides reassurance to residents and a means for information to come back to the Council from Snohomish County. Mayor Franklin stated she appreciate the willingness of Council Members Bader and Murphy to work with Administration to make sure this is something positive and allows Administration to bring information back to Council should issues arise in the future. She stated the goal would be to work with Snohomish County to ensure there is a tight management plan that will provide positive impacts on the community. 2  December 15, 2021 Roll was called with all council members voting yes, except Council Member Vogeli who was excused. Motion carried. Council Member Roberts wished everyone Happy Holidays. He encouraged citizens to shop locally. ADMINISTRATION UPDATE Julie Willie, Community Development Director, provided an update regarding Council Member Murphy' s inquiry about the calls for emergency service at Clare' s Place. Council Member Bader thanked Julie for providing statistics and requested she provided statistics in written form. He stated he looks forward to receiving a comparison of these statistics to other hotels in Everett. Council Member Roberts noted the information is only useful if it can be put into a context that shows the service calls are helping to provide needed services and not allowing those concerns to be collateral issues for the community. Council Member Tuohy stated it would be helpful to receive statistics that show whether any of the calls for emergency service were placed by the neighborhood regarding residents, or if the calls were made strictly inhouse. She added it would be helpful to see the history of impacts in the neighborhood. Council Member Moore spoke about the positive impacts of Clare' s Place the importance in pursuing avenues to get the help it needs. Council Member Murphy noted the request for information was in response to Snohomish County' s proposed purchase of a hotel to shelter the homeless population. He also added that seeing the statistics in writing on emergency calls to Clare' s Place would be helpful. He spoke about his visit the Catholic Community Services facility in Bellingham and suggested a request to Catholic Community 3  r December 15, 2021 Services for data from some of their other facilities would be helpful in providing comparisons of call volume. President Stonecipher requested a copy of the original study. She also requested an analysis on the change in the number of calls. President Stonecipher stated she looked forward to receiving information in writing. Julie Willie stated she would follow up on requests for information. CITY ATTORNEY City Attorney David Hall requested a 40- minute Executive Session regarding two labor matters pursuant to RCW 42. 30. 140( 4)( a) and three legal matters pursuant to RCW 42. 30. 110( 1)( i)( 3) with possible action to follow on two of the matters. PUBLIC COMMENTS: Deb Williams, Council, stated the City received one written comment from Katrina Lindahl regarding Action Item No. 18. She noted there were no individuals registered to speak this evening. CONSENT ITEMS: Moved by Council Member Roberts, seconded by Council Member Bader, to approve the following consent items: RESOLUTION — CLAIMS To adopt Resolution No. 7724 authorizing claims against the City of Everett in the amount of $ 1, 181, 092. 45 for the period of November 27, 2021, through December 3, 2021. f 4  December 15, 2021 JOB COMPLETE— 2020 TRICKLING FILTER MEDIA REPLACEMENT PROJECT Accept the 2020 Trickling Filter Media Replacement Project as complete with Stellar J. Corporation and Authorize the Mayor to sign the Certification of Completion. AGREEMENT AMENDED — IMPLEMENT CP CIVICENGAGE PLATINUM HOSTING AND SECURITY To authorize the Mayor to sign Amendment # 5 with CivicPlus in the amount of 3103. 90. CONSTRUCTION AWARD— ROTARY PARK RENOVATION To award construction contract for the Rotary Park Renovation to Specialty Equipment/ Neptune General Construction in the amount of$ 460, 775. 70. AGREEMENT — FY22 RECREATIONAL BOATING SAFETY FEDERAL ASSISTANCE GRANT To authorize the Mayor to sign all necessary documents and agreements with the Washington State Parks and Recreation Commission regarding the acceptance and utilization of the FY22 Recreational Boating Safety( RBS) Federal Financial Assistance Grant in the amount of$ 15, 477. 90. COUNCIL BRIEFING AGENDA: Authorize the Mayor to sign the Promulgation Memorandum for the City of Everett Comprehensive Emergency Management Plan ( CEMP). Presented by Brent Stainer and Sarah LaVelle, Fire EMS Emergency Medical Services staff presented an overview of the Comprehensive Emergency Management Plan ( CEMP), including the contents of the CEMP, the framework for how the City intends to handle emergencies and disasters and a review of the Playbook format, and next steps. Council Member Roberts noted the Northwest Clean Air Agency is referenced in the CEMP relating to air quality; however, the City of Everett serves under the Puget Sound Clean Air Agency. He inquired whether the Playbook would be populated with links or bookmarks and contact information for the different organizations, and he noted the word " heat" was missing from the list of events. 11  December 15, 2021 EXECUTIVE SESSION: The City Council recessed at 7: 47 p. m. for a 40- minute Executive Session. President Stonecipher reconvened the meeting at 8: 28 p. m. and called for a time extension of the executive session not to exceed 10 minutes with no action to follow. The meeting was reconvened at 8: 39 p. m. City Attorney Hall requested Council authorize the Mayor to sign a settlement agreement relating the Workers' Compensation claim of a former employee who was involved in a rollover accident while driving a vactor truck. Moved by Council Member Moore, seconded by Council Member Bader, to authorize the Mayor to sign the settlement agreement with Mr. Guluarte in the amount of$ 300, 000. Discussion took place regarding the previous announcement that no action would follow the executive session. City Attorney Hall suggested the postponement of action until next week.
