SUBJECT: Park District Development – Street vacation/dedication
OVERVIEW
The Park District is a master planned development in north Everett proposed by the Everett Housing
Authority on the site of the former Baker Heights housing project around 1300 Hemlock St. The
proposed phased development will include, at buildout, up to 1,500 mixed-income homes,
neighborhood-oriented retail/commercial space, park and open space, and supporting infrastructure.
Procedurally, the development process includes:
1. A right-of-way vacation and dedication (RCW 35.79), which will allow the streets within the
development to be reconfigured, with a slight net gain of area within public right-of-way.
2. A comprehensive plan amendment (EMC 15.03.400, RCW 36.70A.130) to allow buildings up to
fifteen floors within master planned developments when reviewed under a planned
development overlay.
3. A planned development overlay (EMC 19.29), which is a mechanism for a development that is
innovative or otherwise beneficial to the community but which does not strictly comply with the
provisions of the zone in which the property is located. A planned development overlay
approval is equivalent to a rezone, and like a rezone must be consistent with the comprehensive
plan.
4. A development agreement (EMC 15.03.200 and RCW 36.70B.170-.210), which is a contractual
agreement between the city and a property owner that fixes the development standards and
other provisions that will apply to, govern, and vest the development, use, and mitigation of the
development for the duration specified in the agreement.
RIGHT-OF-WAY VACATION AND DEDICATION
At the city council’s built environment committee meeting on July 12, 2023, Everett Housing Authority
staff and consultants and Everett city staff will provide a briefing and overview of the proposed right-of-
way vacation.
Under RCW 35.79.010, property owners abutting a public right-of-way may petition the city council for
vacation of an established public right-of-way. Upon receipt of a petition, the city council must fix, by
resolution, a time for a public hearing (required between 20 and 60 days from the approval date of the
resolution). After the public hearing, the city council may approve the vacation by ordinance.
Under sections 2 and 3 of Everett City Council Resolution 3147, as amended by Resolutions 5083 and
7397, the city may accept a property swap in lieu of payment for the assessed value of the right-of-way.

PARK DISTRICT PROPOSAL
The proposed design of the Park District development will require reconfiguring the internal streets to
better support the development and its interface with the surrounding neighborhood. This
reconfiguration will be processed as a vacation and dedication, requiring council approval by ordinance
after a public hearing.
REQUEST OF THE BUILT ENVIRONMENT COMMITTEE
Review this memo, participate in the briefing, and provide any feedback on the process and substance
of the right-of-way vacation and dedication proposal. A decision on the vacation/dedication petition will
not be requested of the council until around winter 2023-24, but it would be helpful to hear of any
concerns or suggestions as soon as possible so that staff and the design team can take those into
account as the design is refined.
