Approval of Minutes - January 22, 2019 Councilmember Oettel moved to approve the minutes of the January 22, 2019 Council Meeting, seconded by Councilmember Remy. Motion carried with unanimous approval. 5-0. AUDIENCE PARTICIPATION a.) Leslie Gesner, 411 E. Main St., inquired when we will start moving on Ramstead Park? She had heard the Community Garden is going to be located at the Ramstead Park Property and is excited about that. Dave Schoonover said it will be going there and will be placed on the east side of the building. The building is going to be removed. b.) Shannon Buckley, 407 W. View Place, is a P.E. Teacher at Nooksack Middle School and also coaches cross country. She would like to see more connected trails and trails with low impact on joints. The trails in Bellingham have gravel on them. The middle school and high school kids would use the trails to "get healthy" and possibly use trails as a safe route to bike/walk to school. Having a larger trail system could bring business to local businesses from people coming to use the trails. Mayor Perry responded we put an application in with the state via Doug Erickson and Luane Van Werven last week for capital projects. There is a possibility to obtain some state funding for these projects. We put in for $1 million for Phase I of a stormwater facility at Ramstead Park and $500,000 for the design and construction of trails/bathrooms at Ramstead Park. Currently, we are working with a Landscape Design Architect. The trail will be the easiest to begin regardless of additional funding. There are other grant options we can look into as well. Dave Schoonover said public works will continue mowing current trail at Ramstead Park. It might be difficult to connect the trail at Ramstead Park to the Nooksack Middle School property as the property between the two is owned privately and in the county. COMMITTEE REPORT a.) Finance Committee Councilmember Lautenbach gave the Finance Committee Report. They reviewed bank reconciliations for December and January and there were no discrepancies. They discussed reinvestment options for our Bond that is maturing February 15, 2019. The decision was made to reinvest bond for 2 years yielding 2.45% interest. John Perry, Mayor Melanie Dickinson, Clerk/Treasurer Page 2 of 2 Page 3 of 41  CITY OF EVERSON PLANNING DEPARTMENT Rollin Harper, City Planner MEMO DATE: February 21, 2019 TO: Everson City Council FROM: Rollin Harper, City Planner RE: Turner Minor Plat Amendment Request Request On January 31, 2019, the City received a letter-style request from Richard and Katie Turner for a minor plat amendment to remove, in part, a restriction on access to their undeveloped property (816 Sisters Court) from Mead Avenue. The subject property is legally described as Lot 7A of the Nooksack Trail Development Lot Line Adjustment. Background In 2017, the City Council granted final plat approval for the Nooksack Trail Development (subdivision). As some Council members may recall, the original design of the Nooksack Trail Development included buildable areas outside of the 100-year floodplain within all lots, thereby minimizing impacts within the floodplain and avoiding the need for additional assessment and mitigation under the federal Endangered Species Act (ESA). Through the plat approval process, the City established a restriction on access from Mead Avenue to those portions of lots in the floodplain so that all such access would be through Sisters Court consistent with the design of the plat. See attached lot line adjustment map that includes vehicular access prohibition markings along Mead Avenue and the following statement: “NO VEHICULAR ACCESS TO LOTS FROM MEAD AVE.” Due to an unforeseen need for modifications to the plat’s stormwater treatment facilities, much of the buildable area within the original Lot 7 became unavailable. As a result, the developer completed a lot line adjustment that resulted in a modified Lot 7A that could still be accessed from Sisters Court, but which would very likely require the new home site to be partially within the 100-year floodplain, thereby adding the need for further ESA-related impact and assessment prior to any new construction. Page 4 of 41 More recently, the Turners purchased their undeveloped residential property within the Nooksack Trail Development with full understanding regarding the need for additional review prior to construction. Although the property has substantial frontage on Mead Avenue, the property was originally assigned the address of 816 Sisters Court because primary access to the future home site was intended to be by way of an easement running to the north and east of the Sisters Court cul-de-sac. The Turners have now come to the conclusion that it makes better sense for them to access their future building site directly from Mead Avenue rather than coming the long way around through Sisters Court. However, the access restriction included on the initial plat and carried forward with the recent lot line adjustment prohibits such access. Analysis Section 18.01.070 EMC does provide a pathway for the City Council to approve minor plat amendments under certain circumstances. Given the fact that, regardless of the routs of access, development of Lot 7A will require building within the 100-year floodplain and will require additional ESA-related review, it would be more efficient and less expensive to access the future building site directly from Mead Avenue. To allow such access, the City Council would need to pass a motion approving the Turners’ request for a minor plat amendment to remove the access restriction along a portion of Mead Avenue. If the minor plat amendment is approved, then the Turners would work with their surveyor to prepare an amended lot line adjustment that would eliminate a portion of the access restriction markings and adjust the content and location of any related text. Recording of the amended lot line adjustment with the County Auditor would formally modify the access restriction and allow limited access to this property from Mead Avenue. Recommendation The staff recommendation is for the City Council to approve the Turners’ request by passing a motion, such as: To approve the Turner minor plat amendment and remove the restriction on access to 816 Sisters Court from Mead Avenue to the least extent necessary to allow direct access to the designated future building site. It may also be appropriate for the City to assign the property a new address on Mead Avenue rather than the current address on Sisters Court. We acknowledge that with the original plat, lot 7 had be 50% out of the flood plain and access to the north driveway easement off Sister Court was in the best interest ofthe neighborhood. This was prior to our purchasing lot 7a. 7a runs along Mead Ave to Nolte, instead of along lots 8 and 9. Please see the original plat drawing attached and the amended plat attached. We have enclosed our drawings of the lot and where we would like to place the shop at and the future house site. Our current plan is to build a shop for our personal use and when the property is removed from the flood plain per the FEMA maps that are pending approval, we may eventually build a house on there as well. The map shows our plan ofa future house site just north ofthe shop. This is a much shorter driveway and we would not need to place as much nonpervious surface in the neighborhood. We also feel this will allow for easier ?re access in the event of an emergency. The lay out of the lot fits this design much better than if we must work around the current driveway restrictions. We would be willing to put sidewalks in from the driveway access onto Mead Ave south to Sisters Ct if or when a house is to be built on the property, and the property is no longer in the flood plain. The Everson Police Department takes great pride in the services we provide to our communities of Everson and Nooksack. The goals and objectives of the Everson Police Department are clear as represented in our mission statement. The challenges of providing a safe environment for the public are ever increasing. We currently have a department of six full time officers, two reserve officers and one civilian staff member. We were very excited to have Chad Pleadwell join us in August. In 2018, the Everson Police Department received requests for educational talks, crime prevention talks and community safety presentations. Public talks and information dissemination covered several topics including, but not limited to: Home Security, Stranger Danger, Internet Safety and Awareness and Reporting Practices. We continue to share information and inform the public through the City of Everson Newsletter. The Everson Police Department has maintained a great working relationship with our communities. In 2018, the Department was awarded grant funds from different sources. These funds were used to purchase equipment, and there was also money secured for overtime expenses and training. By seeking out and pursuing grant funding, we have been able to keep up with the ever changing and increased demands on public safety. Page 29 of 41  Sex Offenders / Kidnapper Offenders 2018 The Everson Police Department maintains the responsibility of monitoring registered sex offenders and registered kidnappers within our community in cooperation with the Whatcom County Sheriff’s Office. Officer Charlton is responsible for the sex offender / kidnapper program. This function is overseen by the Chief of Police. There are currently four (4) level 1 sex offenders living in Everson, and no level 1 sex offenders living in Nooksack. There is one (1) level 2 sex offender living in Everson. Currently there are no level 3 sex offenders or registered kidnappers living within either city. Page 30 of 41 2018 Year in Review: Everson Police Department Reserve Program The Everson Police Department’s Reserve Officer Program was an invaluable asset to the Cities of Everson and Nooksack in 2018. The program is comprised of two sworn and commissioned Reserve Officers, who aid the department in several ways. The Washington Administrative Code defines Reserve Officers in the following manner: "Reserve peace officer” … means any officer who does not serve as a law enforcement officer of this state on a full-time basis, but who, when called by such agency into active service, is fully commissioned on the same basis as full-time officers to enforce the criminal laws of this state. Everson’s reserve officers work on an unpaid, volunteer basis. In 2018, Officers Smit and Sterk served the cities of Everson and Nooksack on countless shifts, serving when coverage was thin, or as special needs arose. Officers Smit and Sterk aided full-time officers during calls for service, and participated in proactive policing on a wide variety of incidents, including, but not limited to: traffic stops, domestic violence incidents, drug crimes, warrant arrests, property crimes, checks of welfare, security checks, suspicious circumstances, extra patrol, specialized details, and more. In 2018, Officers Smit and Sterk combined for a total of over 600 hours of volunteer service, as well as 100 hours of training. The Everson Police Department is tremendously grateful for the service Officers Smit and Sterk provided, shift after shift, week in and week out, throughout this past year. Simply put, the department would not have been able to provide the same level of service to the communities of Everson and Nooksack without their efforts. For 2019, it is the department’s hope that it can continue to rely on the exceptional dedication to community, pride of service, and donation of time, our volunteer Reserve Officers have provided in the past. Each Officer fulfilled the state mandated training for 2018. These trainings consisted of, but were not limited to: Community Oriented Policing, Crime Prevention, Firearms Training, Taser Certification, Less Lethal Shotgun, CPR and First Aid, Critical Incident Response, Patrol Procedures, Crisis Intervention, Hazardous Materials and Lexipol Policy Manual Daily Training Bulletins. The Everson Police Department has consistently met and maintained this high level of training and will continue to do so.
