Motion carried with unanimous approval. 3-0. AUDIENCE PARTICIPATION - None PUBLIC HEARING a.) Dykstra LP Rollin Harper discussed final changes to documents regarding the Dykstra LP application. This has been a two year process. Public Comment: None. Council Discussion: All Councilmembers are in favor of approving this application. Councilmember Lautenbach made a motion to approve the Dykstra Long Plat preliminary plat and Shoreline Development Plan, seconded by Councilmember Pratt. Motion carried with unanimous approval. 4-0. b.) Conditional Use Permit and Variance Application - Bourban Bar and Grill Rollin Harper introduced the Conditional Use and Variance Application for expanding their current operation to include outdoor seating and a rooftop area. Public Comment: Cole Hilton, owner, described that they will only do the outdoor dining now and will implement the other plans at a later date. Council Discussion: Councilmember Lautenbach asked how long they would have until they needed to commence the portion they plan to do later. Melanie directed her where to find all the documents on the website. Council Discussion: Councilmember Hammond asked what the lot size is. Rollin responded that it is just over 5,000 sq. ft. Mayor Perry believes we should grant the approval based on all the information. Councilmember Lautenbach has driven by and is in approval, Councilmember Pratt would like to drive by. WTA Board Appointment 2021 - Jennifer Lautenbach Councilmember Hammond made a motion to appoint Jennifer Lautenbach as the WTA representative for Sumas, Everson and Nooksack, seconded by Councilmember Brown. Motion carried with unanimous approval. 4-0. COMMITTEE REPORT a.) Finance Committee Councilmember Lautenbach said that the maturing bond was discussed. Recommendation was made for Melanie Dickinson to search rates and invest it in the best paying CD at a local bank up to a 3 year term. Councilmember Pratt made a motion to approve City Clerk Melanie Dickinson to invest the money in the best paying certificate of deposit up to a 3 year term, seconded by Councilmember Hammond. Motion carried with unanimous approval. 4-0. John Perry, Mayor Melanie Dickinson, Clerk/Treasurer Page 7 of 29 CITY OF EVERSON PLANNING DEPARTMENT Rollin Harper, City Planner MEMO DATE: January 22, 2021 TO: Everson Mayor and City Council FROM: Rollin Harper, City Planner RE: 2020 Docket of Comprehensive Plan Map and Zoning Map Amendments The City comprehensive plan and development regulations give the City Council the opportunity to consider proposed comprehensive plan amendments (including map amendments) and zoning map amendments prior to initiating formal review and then decide whether or not to “docket” such proposals. Formal docketing allows favorably considered proposals to be included in the formal review process, which includes public notice, public comment period, state review, SEPA review, public hearings, and final action by ordinance. Per the Growth Management Act, the City is only allowed to amend the comprehensive plan once per calendar year. Prior to the end of calendar year 2020, the City received only one application from a private property owner to change the future zoning map from the comprehensive plan. In addition, the City is bringing forward one proposal to change the current zoning of a portion of a property located inside City limits. The purpose of this memorandum is to identify and briefly describe each of the proposed amendments so that the Council can make its decision regarding which items to include in the 2020 docket. The table on the following page identifies the two proposals that are under consideration to be included in the 2020 docket. Staff will be available at the January 26, 2021 council meeting to answer questions from the Council. Although representatives for the non-City proposal will be in attendance to answer questions, this will not be a public hearing. Ample opportunity for public comment and public testimony on all docketed items will be provided as part of the formal review and update process. They are interested in developing the property, and have discussed this previously with neighbors, City staff, the City Council and others. In early discussions, the owners of Stoney Ridge Farm, just north of the subject parcel, voiced their concern about commercial development on the Sister Vista property detracting from their existing business. In addition, earlier discussions with the owner of two parcels east of Everson Goshen Road, one of which contains the Latin Grocery, yielded the expressed interest in commercial development on their property. Being supportive of the desires of both property owners, and being concerned about the absorption rate of commercial property in this location, Sister Vista is interested in pursuing a housing development on much of the Sister Vista property. The following narrative provides a description of the proposed “Sister Vista” City of Everson Comprehensive Plan Map 9 Amendment request, and describes the need and public benefit of the proposal. NARRATIVE The property affected by this proposal lies within the Everson Urban Growth Area, south of Van Dyk Road, and west of Everson Goshen Road (SR 544). This property is a portion of an annexation proposal currently being considered. Once annexed, the property owner is considering development options, and has determined that a mix of residential housing over the majority of the property best represents its desires once the property becomes annexed into the City. For this reason, it is requested that a Comprehensive Map change be made to the Residential Multiple Use zoning designation so that the desired zoning may take effect upon annexation. This change will affect approximately 25.35 acres. In preparation of this application, consideration was given to the Comprehensive Plan and various zoning options. In addition, it is understood that there is a desire on the part of the City that a commercial component remain on the Sister Vista property – specifically the northeastern corner between Everson-Goshen Road and Van Dyk Road, the current location of the auction barn. This particular piece of property is not included in the map amendment request, and is proposed to remain within the Commercial designation. Page 12 of 29 Comprehensive Plan Map 9 Amendment Proposal December 23, 2020 Page 2 of 6 It is requested that the City’s Comprehensive Plan Map #9 be amended from Commercial to Residential Multiple Use for the 25.35 acre portion of the property, and allow this updated zoning to be adopted upon annexation. Subsequent development of the property could provide an opportunity to generate income for the property owner while simultaneously providing increased housing supply needed in the community. As market demands improve for a commercial use, the corner parcel, together with the parcels lying east of Everson Goshen Road, will remain available for future commercial development. The following discussion provides language on how the proposed Map Amendment is in keeping with the goals and policies of the Everson Comprehensive Plan, specifically Chapter 3 - Land Use, and Chapter 5 - Housing. A draft of the proposed Map 9 amendment is included at the end of this narrative. Below is an enlarged graphic showing a portion of the current ap and proposed map for comparison: Page 13 of 29 Comprehensive Plan Map 9 Amendment Proposal December 23, 2020 Page 3 of 6 Chapter 3 – Land Use Element, of the Comprehensive Plan describes the community’s future growth policies. In the section titled “Future Conditions”, two specific references to Commercial uses are noted: 1) With regard to “Density of Intended Uses”, it is stated that, “Commercial acreage will be developed in response to market forces. It is assumed that the intensity of Commercial development will be similar to current commercial uses; and 2) A description is provided for the property (Area “8”), which states, “commercial development is discouraged until build-out and revitalization of the downtown has occurred”. Market forces do not appear to be resulting in significant expansion of commercial development in the City, with several commercial properties within the downtown core remaining underutilized. At the same time, housing needs appear to be steadily increasing, with limited properties being developed to meet that need. Providing for additional residential zoning could provide for additional housing without affecting the viability and development of downtown commercial business. Because the City has expressed interest in maintaining the Commercial zone at the intersection of Everson Goshen Road and Van Dyk Road, it is proposed to maintain the Commercial designation for this portion of the Sister Vista property as shown on the map amendment. Chapter 5 – Housing Element, includes demographics and statistics regarding existing housing stock, income levels and affordability of housing within the City of Everson. A review of the demographics and statistics suggests that housing affordability is a challenge, and is likely to remain so for the foreseeable future. This is an indicator that more affordable housing options are needed in Everson, pointing toward a need for a wider mix of housing types. Page 14 of 29 Comprehensive Plan Map 9 Amendment Proposal December 23, 2020 Page 4 of 6 GOALS AND POLICIES ANALYSIS Analysis: Considerable single-family development in Everson has occurred in recent years. To continue developing needed housing, additional land must be annexed and/or owners of available land within the City will need to be willing to develop their property. For newly annexed land, that land must be zoned to accommodate the needed housing. While the current annexation proposal affecting the subject property includes a portion of the property slated for residential development, approximately half of this land is already developed in a residential use, making further residential development on these parcels unlikely in the near future. Few of the other tracts are available for residential development, with the owner of only one parcel currently planning for future development. The willingness of a property owner to develop the land is key to actually realizing additional development. The owner of the Sister Vista property had voiced a desire to develop housing, so it is highly likely that reclassification of the property to a residential use will result in additional housing. Further, development within the context of the Residential Multiple Use zoning, will improve the chances of housing being developed that is affordable for the middle-income segment of the community, furthering this specific goal. Page 15 of 29 Comprehensive Plan Map 9 Amendment Proposal December 23, 2020 Page 5 of 6 Analysis: An increase in the available land in the Residential Multiple Use zone classification will improve the ability of land owners to develop housing at a cost more likely to be achievable by lower- and middle- income residents. Specifically, the development of duplex style structures, and fee-simple, zero-lot line homes can decrease overall housing costs, making this type of housing more achievable for fixed-income, and lower income residents. Approval of the requested zoning designation will further this goal. Analysis: Before steps taken to “reflect a high degree of pride in ownership” will yield results, housing first needs to be affordable for potential buyers. Approval of a zoning designation change to Residential Multiple Use will encourage development of multi-family housing, making it possible for a larger segment of the Everson population to move from renter status to that of home ownership. Careful planning of residential development in this newly annexed area will forward this goal while maintaining the character of existing neighborhoods. Page 16 of 29 Comprehensive Plan Map 9 Amendment Proposal December 23, 2020 Page 6 of 6 SUMMARY Approval of the requested Comprehensive Plan Map amendment will serve to help achieve the stated goals and policies of the Comprehensive Plan as they relate to housing. At the same time, retention of the key corner of Everson Goshen Road / Van Dyk Road for future commercial development will provide opportunity for a commercial use once the commercial market supports such development. In the short-term however, approval of the amendment can serve to decrease the median price of housing, and increase the percentage of home ownership. Consideration of this proposed amendment is greatly appreciated. During the period of January-June 2021, this project will support participating jurisdictions in Whatcom County in climate and resilience planning. WWU faculty member, Dr. Tammi Laninga, and upper level students in Dr. Laninga’s spring quarter Land Use Regulations course will develop draft climate change and resilience goals, objectives and policies for jurisdictions to consider including in their existing comprehensive plans. This may include, but is not limited to, disaster preparedness planning, land use considerations, and transportation planning. While the WWU students and project team will do the bulk of the work for this project, they will develop their recommendations with guidance from each participating jurisdiction. The final recommendations will be high-quality and tailored to meet the needs and preferences of each jurisdiction. Upon completion of this project, jurisdictions may consider adopting the recommendations into their comprehensive plans. Whatcom County will support facilitation of this project and hopes to build climate resilience throughout the County through effective coordination and collaboration across jurisdictions. It should be noted that engaging in this project represents a willingness to participate in a planning exercise and does not constitute a policy decision commitment. The following jurisdictions are invited to participate in this effort: Ferndale, Lynden, Blaine, Everson, Nooksack, and Sumas. Costs to Jurisdiction The Department of Commerce grant will cover the costs of this project for each participating jurisdiction. The project team requests two-four hours of city staff time per month from January-June 2021. The project team also requests the opportunity for the student teams to present their recommendations at a June 2021 council meeting. Next Steps The city planner, or another staff member, commits to serving as the project lead for each jurisdiction, and communicates that intent to project team member, Sarah Parker, by February 2021.
