Councilmember Hammond made a motion to approve the minutes of the April 27th meeting, seconded by
Councilmember Lautenbach. Motion carried with unanimous approval. 5-0.

PUBLIC HEARING
a.) Comprehensive Plan Map Amendments and Site Specific Rezone
Rollin Harper presented the two components of the comprehensive plan map amendments. The first is the
property which is owned by the LDS church and would be changed from commercial to residential. This
property was actually residential previously. The second is roughly 26 acres of commercial property owned by
Sister Vista LLC within the West Everson annexation that would change to mostly residential with a small
portion remaining commercial. This public hearing marks the end of the 60 day comment period. Public
Comment: Gary Loving, 215 Kale St. asked what is planned for the LDS property. Mayor Perry responded that
we do not know of any plans at this point. Craig Parkinson stated that he is representing Sister Vista LLC and is
available for questions. Bill Geyer, representing Josh McConnell, Kari Gardner and Chad Simmons, all property
owners in Downtown Everson, voiced support for the zoning of the Sister Vista property but presented the
idea of a new designation of highway commercial property that would limit the kind of commercial
development allowed. Council Discussion: Council is in favor of the change of the LDS property to residential.
Council is not in favor of limiting the type of commercial business allowed in the portion of commercial
property at the Sister Vista property. Council would like to look into placing parameters on the mix between
single family homes and multi-family homes.
NEW BUSINESS/COUNCIL ACTION
a.) Falcon Landing - Request for Final Plat Approval
Rollin Harper introduced Falcon Landing for final approval. Staff recommends Council to approve the Mayor to
sign with the completion of punch list items. As-Builts are under review and a tree planting plan has been
discussed. The maintenance bond requirement has been set at ten percent.

RE: 2020 Docket of Comprehensive Plan Map and Zoning Map Amendments
Introduction
At the January 26, 2021 council meeting, the Everson City Council considered the
proposals included in the 2020 Docket of comprehensive plan map amendments and site-specific
rezones. Following Council discussion, the Council decided to docket the following two
proposals:
2020-01 Sister Vista Comprehensive plan map amendment of Abutting
LLC approximately 26 acres to change the future property to
zoning designation of a group of parcels located in retain future
the City’s urban growth area (outside City limits) zoning
from Commercial to Residential-Multiple Use designation of
(RMU). Commercial.
2020-02 City of Comprehensive plan map amendment and site- Prior to 2016,
Everson specific rezone of approximately seven acres to the area was
change the current zoning of a portion of the zoned
property owned by the LDS Church from Residential.
Commercial to Residential.
Public Process
On or around March 10, 2021 the City provided public notification to the State Department of
Commerce, potentially affected and neighboring property owners, and the public regarding the
City’s 2020 Docket of proposed comprehensive plan map amendments and site-specific rezones.

These notifications sated that a 60-day comment period was open from March 10 through May
10, 2021, that the City Council would hold a public hearing regarding the 2020 Docket on May
11, 2021, and that information regarding the docketed proposals was available from the City’s
website. No comments were received during the advertised comment period. One comment was
received from Mr. Bill Geyer on May 11th and was included in the public record.
On May 10, 2021, the City SEPA Official issued a Determination of Nonsignificance (DNS)
with respect to the City’s 2020 Docket of comprehensive plan map amendments and site-specific
rezones. A 14-day SEPA comment period was open from May 10 through May 24, 2021.
On May 11, 2021, the City Council opened the public hearing regarding the 2020 Docket
proposals. Opportunity for public comment was provided and public testimony was received. At
that meeting, the Council decided to continue the hearing to the May 25, 2021 city council
meeting and keep the public record open until that time. Thus far, no additional comments have
been received regarding the 2020 Docket proposals. The public hearing will be re-opened on
May 25, 2021 and additional opportunity for public testimony will be provided.
Public Comments
One comment has been received regarding the 2020 Docket proposals. The comment letter from
Mr. Bill Geyer expressed support for the proposed Sister Vista future zoning map amendment
based on several factors, including consistency with the City’s comprehensive plan policies,
market factors affecting the availability of housing, and support for a strong commercial area in
downtown Everson. The letter also urged the City Council to consider establishing a new
Highway-oriented Commercial zoning district that would include allowed uses distinct from
those uses allowed in the existing Commercial District located primarily in the downtown area of
Everson. Once established, the new zoning designation could be utilized to rezone certain
commercial properties located outside the downtown area, including the adjacent corner property
that was not included in the subject application.
Staff Analysis
Sister Vista LLC
The Sister Vista LLC proposal would change the future zoning designation from Commercial to
Residential-Multiple Use for six parcels totaling approximately 26 aces. These parcels are
located outside of the current City limits to the west of the Everson-Goshen Road (SR 544) in the
vicinity of the Everson Livestock Auction. Five of the parcels are owned by the proponents,
Todd and Michelle Beld. The sixth parcel is owned by Robert Sharp and Kathryn Libbbert and
comprises approximately one acre.
The proponents have provided written and oral support for the proposal based on consistency
with the City’s comprehensive plan policies, the need for additional housing, including
affordable housing, limited demand for new commercial sites, and support for maintaining a
viable downtown commercial area.

The adjacent approximately 2.5-acre corner property with frontage onto both SR 544 and Van
Dyk Road would retain its current future zoning designation of Commercial. Any change to that
designation would need to be pursued through a future amendment or rezone process.
As part of the public hearing, the Council discussed the possibility of establishing a requirement
that a minimum percentage of the proposed RMU area be developed for single-family units. A
minimum single-family percentage of sixty percent was discussed. This would correspond to a
maximum of forty percent of the units being multifamily (duplex, triplex and four-plex).
LDS Rezone
The City has proposed rezoning a portion of the property owned by the LDS Church that is
located in the southeast corner of the intersection of Kale Street and Mead Avenue (SR 544). The
LDS Rezone property includes an approximately 7-acre portion of the larger property that
includes the LDS Church and ball field. The same area that is currently proposed to be rezoned
from Commercial to Residential was previously zoned Residential until that zoning was changed
to Commercial in 2016. City staff have been in contact with the real estate agent representing the
LDS Church and have been told that the Church does not oppose the proposed rezone.
Council Action
Following the closing of the public hearing, the City Council will have the opportunity to
provide direction to City staff regarding preparation of an adopting ordinance to approve one or
both of the 2020 Docket items. The adopting ordinance would be prepared and brought back for
consideration by the Council at a future council meeting.

RE: Flint West Everson Annexation – Final Public Hearing

MEMORANDUM
On December 20, 2018, the City received a Notice of Intent to Commence Annexation from Mr.
Michael Flint. The proposed annexation, referred to as the Flint West Everson Annexation,
included approximately 103 acres of land located to the west o the existing City limits (west of
Sable Terrace to the Livestock Auction). See attached map of the proposed annexation area. At
the January 8, 2019 city council meeting, the Council voted to accept the Notice of Intent with
no change to the geographic area of the proposed annexation. That action authorized the
proponents to circulate and submit a Petition for Annexation signed by the owners of not less
than sixty percent of the assessed valuation of the annexation area for general taxation
purposes.
On February 1, 2021, the City received a Petition for Annexation signed by owners of over sixty-
two percent of the total valuation of the annexation area, along with other supporting
documentation. The Petition included a statement that upon annexation the annexed properties
will assume their fair share of general City indebtedness and that upon annexation said
properties will be assigned City zoning designations consistent with the future zoning
designations shown in the City comprehensive plan.
An initial public hearing regarding the proposed annexation was held on February 23, 2021. At
the following council meeting, the City Council passed Resolution No. 868-21, resolving to
annex the proposed annexation area, subject to review and approval of the annexation by the
Whatcom County Boundary Review Board and final approval by ordinance of the Everson City
Council.
On March 19, 2021, the City’s complete annexation packet (referred to as the Notice of
Intention) was received by the County Boundary Review Board (BRB) and assigned the file
number BRB 2021-01. A minimum 45-day review period was open from March 19 through May
2, 2021. No government agency or interested party requested full review by the BRB, and the
BRB’s approval letter (dated May 3, 2021) was received by the City on May 6, 2021. See
attached BRB letter.
A final public hearing regarding the proposed annexation has been scheduled for May 25, 2021.
Notification regarding the public hearing was provided in the Lynden Tribune and to potentially
affected and neighboring property owners on May 12, 2021. No comments either in support of
or in opposition to the proposed annexation have been received thus far. Interested parties will
have the opportunity to provide testimony at the public hearing.
Following the closing of the final public hearing, the City Council will have the opportunity to
approve the annexation by passing an ordinance annexing the proposed area. The ordinance
will include the following requirements:

1. That upon annexation the annexed properties will assume their fair share of general City
indebtedness; and
2. That upon annexation said properties will be assigned City zoning designations
consistent with the future zoning designations shown in the City comprehensive plan.
Copies of the final ordinance, once adopted, will then need to be provided to the County BRB
and other County agencies to complete the local annexation process. An additional submittal to
the state office of financial management is also required.
City staff will be available at the public hearing to answer any questions from the Mayor or
Council regarding the proposed annexation or the annexation process.
