Page 1 of 3  RESOLUTION NO. 574-21 AN EMERGENCY DECLARATION OF THE MAYOR - REQUEST FOR PUBLIC ASSISTANCE DUE TO NOVEMBER 2021 FLOOD EVENT CITY OF EVERSON, WASHINGTON WHEREAS, Whatcom County experienced a significant flood event on or about November 14, 2021, where there was severe flooding from the Nooksack River; and WHEREAS, as a result, the City of Everson (“City” or “Everson”) suffered severe and damaging flooding within its limits; and WHEREAS, the flooding caused damage to City owned roadways and infrastructure in multiple locations, and WHEREAS, the Governor for the State of Washington issued an emergency proclamation on or about November 15, 2021, proclaiming a State of Emergency in Whatcom and other counties due to severe weather damage, including the extensive flooding, and WHEREAS, the event threatens injury to both persons and property, creating an emergency within the City which demands immediate action; and WHEREAS, the emergency resources of the City of Everson will likely be insufficient to meet the requirements of the situation and the City desires to take steps to exercise any necessary statutory powers pursuant to RCW 38.52.070(2) and the City’s own emergency operations plans; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Everson, State of Washington, as follows: 1. City of Everson hereby declares an emergency as a result of the heavy rainfall event that occurred and that such an emergency is declared to have commenced November 14, 2021. 2. That because of the declared emergency, the City of Everson management personnel are authorized to use emergency purchasing procedures pursuant to RCW 39.04.280 without regard to time consuming procedures and formalities required by law for non-emergency purchases of goods and services related to response from this event, except those mandated by Constitutional requirements. 3. Documentation of all damage, repairs, and the decision making for any contracting of purchases shall be thorough. NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Everson ratifies the Mayor’s declaration of emergency existing effective November 14, 2021 and RESOLUTION 574-21 Page 2 of 3 hereby does authorize the expenditure of funds as required to meet the emergency. This action is in accordance with RCW 38.52.070(2). DATED this day of December 2021.
