EXCELSIOR CITY COUNCIL MEETING
April 16, 2018

1. CALL TO ORDER
Mayor Gaylord called the meeting to order at 5:35 p.m.
2. ROLL CALL
Present: Councilmembers Beattie, Carlson, Caron, Miller (arrived at 5:42
p.m.), and Mayor Gaylord
Absent: None
Also Present: City Manager Luger, City Attorney Staunton, Planning Director
Smith, Public Works Superintendent Amundsen, Event
Coordinator Edwards, and City Clerk Orlofsky
3. APPROVAL OF MINUTES
(a) Regular City Council Meeting Minutes, April 2, 2018
Beattie moved, Caron seconded, to approve the April 2, 2018 City Council
Minutes. Motion carried 4/0.
4. OPEN FORUM
(a) Certificate of Appreciation for 10 Years of Service to Excelsior – Kristi Luger,
City Manager.
(b) Miki Huntington, Excelsior-Lake Minnetonka Chamber, addressed the City
Council.
5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS
(a) Hennepin County Update with Jan Callison
Jan Callison, County Commissioner, provided an update.
(b) South Lake Minnetonka Police Department Update
Gaylord provided an update on the South Lake Minnetonka Police
Department.
(c) E-Cigarettes and Vape Shops
Carlson asked staff to bring this item back to a future City Council Meeting.

6. AGENDA APPROVAL
(a) Meeting Agenda
Beattie moved, Carlson seconded, to remove item 13(a) Thrive MSP Overview,
and to approve the agenda as amended. Motion carried 5/0.
(b) Consent Agenda
Beattie moved, Carlson seconded, to approve the consent agenda. Motion
carried 5/0.
1. Approve Verified Claims – Approve for Payment Manual Checks
84036-84079
Action - Approved the payment for manual checks 84036-84079.
2. March Building Permit Report
Action – Accepted for filing.
3. Closing of City Hall on December 24 and December 31
Action – Authorized staff to close City Hall on Monday, December 24th
and Monday, December 31st for the holidays.
4. St. Alban’s Bay Lake Improvement District Joint Cooperation
Agreement III
Action – Approved the St. Alban’s Bay Lake Improvement District Joint
Cooperation Agreement III and authorize the Mayor and City Manager
to sign the Agreement.
5. Approve Safe Assure Contract
Action – Authorized the City Manager to renew the agreement with Safe
Assure.
6. Memorial Day Parade
Action - Approved the American Legion Post 259 & Minnetonka VFW’s
Memorial Day parade permit and adopt Resolution 2018-10 – A
Resolution Imposing Temporary Street Closure on May 28, 2018.
7. Approve Temporary Liquor License for Art on The Lake Event
Action – Motion to Approve the Temporary Liquor License for the Art on
the Lake Event on Saturday, May 9 & 10 from 10 am – 6 pm.

7. SINGLE -FAMILY SCALE STANDARDS
(a) Acknowledging Property Owners of Houses on the Survey
Mayor Gaylord thanked the property owners that had houses on the survey.
(b) Single – Family Scale Standards
Council directed staff to schedule the First Reading of the Ordinance No. 580
at the Special Meeting on April 24, 2018.
8. PUBLIC HEARING
(a) Conditional Use Permit – 287 Water Street (PC No. 18-05)
Mayor Gaylord opened the public hearing at 7:15 p.m.
Hearing no comments from the public, Mayor Gaylord closed the public
hearing at 7:28 p.m.
Carlson moved, Beattie seconded, to Adopt Resolution No. 2018-09 approving
a Conditional Use Permit for use of the Parking Impact Fee subject to the
conditions listed in said resolution. Motion carried 5/0.
(b) Tuck-Under Garages, Measuring Building Height and Garage Setbacks
(PC No. 18-14)
Mayor Gaylord opened the public hearing at 7:24 p.m.
John Monson, Landschute, addressed the City Council.
Hearing no further comments from the public, Mayor Gaylord closed the public
hearing at 7:28 p.m.
Carlson moved, Beattie seconded, to waive the first reading and schedule the
second reading of Ordinance No. 578, an Ordinance to amend Appendix E,
Articles 14 and 41 of the Excelsior City Code regarding garage design and
measuring building height for April 24, 2018. Motion carried 5/0.
(c) Curb Cuts Along Water Street (PC No. 18-03)
Mayor Gaylord opened the public hearing at 7:37 p.m.
Hearing no comments from the public, Mayor Gaylord closed the public
hearing at 7:28 p.m.
Beattie moved, Caron seconded to waive the first reading and schedule the
second reading of Ordinance No. 579, an Ordinance to amend Appendix E,
Article 19 of the Excelsior City Code regarding curb cuts along Water Street for
May 7, 2018. Motion carried 5/0.

(a) 810 Excelsior Boulevard Proposals
Bill Stoddard, Stoddard Companies, addressed the City Council.
Todd Frostad, Frostad Development Corporation, addressed the City Council.
Ian Peterson, David Weekly Homes, addressed the City Council.
Joan Maher, 905 Excelsior Boulevard, addressed the City Council.
MaryJo Judd, 825 Hidden Lane, addressed the City Council.
Ann Hersman, 823 Hidden Lane, addressed the City Council.
Carlson moved, Caron seconded, to move forward with the proposal from Bill
Stoddard. Motion failed, 2/2 with Miller and Gaylord opposed, and
Councilmember Beattie abstained.
Carlson moved, Caron seconded, to continue this item to the next City Council
meeting on May 7th. Motion Carried 5/0.
13. NEW BUSINESS
(a) Reinstating Works Sessions and Scheduling Special City Council Meetings
Beattie moved, Caron seconded, to schedule a Special Meeting on April 24th at
5:30 p.m. and another on May 2nd at 5:30 p.m. and to continue with the
Council Work Sessions at 5:30 p.m. going forward with City Council meetings
to begin at 6:30 p.m. Motion carried 5/0.
(b) Donation Yoga Request
Tricia Thomas, 140 Maple Street, addressed the City Council.
Caron moved, Miller seconded, to approve the event with all the donations
going towards Community for The Commons and to come back at the end of
the summer and provide the City Council with a report. Motion carried 5/0.
