MINUTES
Tuesday, January 19, 2021
6:30 P.M.
1. CALL TO ORDER
Mayor Carlson called the meeting to order at 6:39 P.M. This meeting was a remote
meeting conducted via Zoom.
2. ROLL CALL
City Council: Mayor Carlson and Councilmembers Caron, Dierking, Hersman,
and Kurschner
Absent: None
Also Present: City Manager Luger, City Attorney Staunton, City Engineer
Dawley, Finance Officer Potter, and City Clerk Williams
Attorney Staunton stated in accordance with the requirements of Minnesota
Statues Section 13D.021, the Mayor, the City Manager and the City Attorney have
determined that an in-person meeting is not practical or prudent because of the
“COVID-19 Health Pandemic” emergency declared under Chapter 12 of the
Minnesota Statues. All staff and City Council members will be participating by
telephone or other electronic means. All actions votes will be recorded as roll call
votes.
3. APPROVAL OF MINUTES
(a) January 4, 2021 Work Session Minutes
Kurschner moved, Caron seconded, to approve the January 4, 2021 Work
Session Minutes. On a roll call vote, Dierking, Caron, Hersman, Kurschner and
Carlson voted yes. Motion carried 5/0.

Kurschner moved, Hersman seconded, to approve the January 4, 2021 City
Council Minutes. On a roll call vote, Dierking, Caron, Hersman, Kurschner and
Carlson voted yes. Motion carried 5/0.
(c) January 9, 2021 Goal Setting Session Minutes
Kurschner moved, Dierking seconded, to approve the January 9, 2021 Goal
Setting Session Minutes. On a roll call vote, Dierking, Caron, Hersman,
Kurschner and Carlson voted yes. Motion carried 5/0.
4. CERTIFICATE OF APPRECIATION GREG MILLER
Mayor Carlson presented a Certificate of Appreciation to Greg Miller.
5. OPEN FORUM
Peter Hartwich, 186 George Street, appeared before the Council in support
of the long-term goals of the City Council and the renovation ideas of City Hall.
6. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS
(a) Excelsior-Lake Minnetonka Chamber of Commerce Update
Jen Weiss, Excelsior-Lake Minnetonka Chamber of Commerce, gave an
update on funding and upcoming programs for businesses.
(b) Service Day in May Update
Mayor Carlson gave an update on Service Day. The Council will revisit
Service Day later this year.
(c) South Lake Minnetonka Police Department Update
Mayor Carlson gave an update on police services and South Lake
Minnetonka Police Department’s response to current events.

Hersman moved, Dierking seconded, to approve the January 19, 2021 Meeting
Agenda. On a roll call vote, Dierking, Caron, Hersman, Kurschner, and Carlson
voted yes. Motion carried 5/0.
(b) Consent Agenda
Caron moved, Kurschner seconded, to approve the January 19, 2021 Consent
Agenda. On a roll call vote, Caron, Kurschner, Hersman, Dierking, and Carlson
voted yes. Motion carried 5/0.

$20,000
Action – Reviewed verified claims under $20,000 and approve verified
claims over $20,000.
2. Approve 688 Glencoe Road – Storm Sewer Ownership and Easement

3. Acknowledge 10% Gambling Donations

4. Resolution 2021-07 Designating Annual Polling Place
Action – Adopted Resolution 2021-07 Designating Annual Polling Place.
5. Utility Billing Ordinance Change Regarding Landlords

Action – Waived the first reading of Ordinance No. 624 – An Ordinance to
Amend Chapter 34, Article IV, Section 91 of the Excelsior City Code.
6. Approve Contract with Event Coordinator

(a) Limiting Delivery Fees
Caron moved, Kurschner seconded, to adopt Ordinance No. 622 – An
Emergency Ordinance to Impose Caps on Third-Party Delivery Service Fees
During the COVID-19 Pandemic Local Emergency. On a roll call vote,
Hersman, Dierking, Kurschner, Caron, and Carlson voted yes. Motion carried
5/0.

Caron moved, Kurschner seconded, to appoint Mark Stang to the Park and
Recreation Commission. On a roll call vote, Dierking, Kurschner, Hersman,
Caron, and Carlson voted yes. Motion carried 5/0.
(b) Strategy Session Schedule
The Council directed staff to work with the Mayor on creating an agenda for
the next strategy session that will be scheduled on a later date.
15. ADJOURNMENT
Dierking moved, Kurschner seconded, to adjourn the meeting at 7:56 P.M. On a roll
call vote, Kurschner, Dierking, Hersman, Caron, and Carlson voted yes. Motion carried
5/0.
