City of Excelsior Regular Council Meeting MINUTES Monday, March 1, 2021 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:39 P.M. This meeting was a remote meeting conducted via Zoom. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Caron, Dierking, Hersman, and Kurschner Absent: None Also Present: City Manager Luger, City Attorney Staunton, City Engineer Dawley, City Planner Becker, Public Works Superintendent Amundsen, Finance Officer Potter, and City Clerk Williams Attorney Staunton stated in accordance with the requirements of Minnesota Statues Section 13D.021, the Mayor, the City Manager and the City Attorney have determined that an in-person meeting is not practical or prudent because of the “COVID-19 Health Pandemic” emergency declared under Chapter 12 of the Minnesota Statues. All staff and City Council members will be participating by telephone or other electronic means. All actions votes will be recorded as roll call votes. 3. APPROVAL OF MINUTES (a) February 16, 2021 Closed Session Minutes Caron moved, Dierking seconded, to approve the February 16, 2021 Closed Session Minutes. On a roll call vote, Dierking, Caron, Hersman, Kurschner, and Carlson voted yes. Motion carried 5/0. (b) February 16, 2021 City Council Minutes Hersman moved, Dierking seconded, to approve the February 16, 2021 City Council Minutes. OPEN FORUM Peter Hartwich, 186 George Street, addressed the Council about the residential review process. Andrew Punch, 561 Third Street, addressed the Council about the parking contract and the residential review process. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Excelsior-Lake Minnetonka Chamber of Commerce Update No update, Jen Weiss, Excelsior-Lake Minnetonka Chamber of Commerce, was not in attendance. (b) Excelsior Fire District (Amended) Councilmember Dierking provided an update on the training event that recently took place. (c) Lake Minnetonka Cable Commission (Amended) Councilmember Kurschner provided an update on tv services. (d) Construction hours (Amended) Mayor Carlson addressed the Council about requests from residents regarding construction hours. This item will be added to a future agenda for further discussion. 6. MEET EXCELSIOR Christina Newton, The Waters of Excelsior Senior Living, 723 Water Street, addressed the City Council. 7. AGENDA APPROVAL (a) Meeting Agenda Dierking moved, Kurschner seconded, to approve the March 1, 2021 Meeting Agenda. On a roll call vote, Dierking, Caron, Hersman, Kurschner, and Carlson voted yes. Motion carried 5/0. Minutes City Council Meeting March 1, 2021 Page 3 (b) Consent Agenda Caron moved, Kurschner seconded, to remove item 7(b)5 from the consent agenda and continue this item to the April 5, 2021 City Council Meeting. On a roll call vote, Dierking, Caron, Hersman, Kurschner, and Carlson voted yes. Motion carried 5/0. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed verified claims under $20,000 and Approved Verified Claims over $20,000. 2. February Building Permit Report Action – Accepted the February Building Permit Report. 3. Approve 2021 Business License Renewals Action – Approved 2021 Business License Renewals. 4. Resolution 2021-19 Policy Regarding Assessment Deferrals Action – Adopted Resolution 2021-19 Policy Regarding Assessment Deferrals. 5. Approve Purchase of Vehicle Hoist Action – Remove from the Consent Agenda and continue to the April 5, 2021 City Council Meeting. 6. Approve Community for The Commons’ Donor Recognition Approach for the Pavilion Action – Approve Community for The Commons’ Donor Recognition Approach for the Pavilion. 8. PUBLIC HEARINGS Minutes City Council Meeting March 1, 2021 Page 4 (a) 173 Second Street Minimum Lot Size Variance and Preliminary and Final Plat Bill Stoddard, 440 Third Street, Applicant, commented regarding the application. John Gilles, 166 Linwood Avenue, addressed the Council about the proposed variance. Peter Hartwich, 186 George Street, addressed the Council about the proposed variance. Andrew Punch, 561 Third Street, addressed the Council about the proposed variance. Dierking moved, Kurschner seconded, to continue this item to the March 15, 2021 City Council Meeting and designate Councilmember Caron and Kurschner to work with staff on findings to bring back to Council for approval. On a roll call vote, Dierking, Caron, Hersman, Kurschner, and Carlson voted yes. Motion carried 5/0. (b) 810 Excelsior Boulevard Zoning Text Amendment, Zoning Map Amendment, Possible Variances, Conditional Use Permit, Administrative Subdivision, Lot Consolidation, and Easement Vacation Andrew Punch, 561 Third Street, addressed the Council about the proposed variance. Peter Hilger, Architect of Property, commented regarding the application. Matt Tobin, Applicant, commented regarding the application. Dierking moved, Hersman seconded, to waive the first reading of Ordinance No. 626, schedule the second reading for the March 15, 2021 City Council meeting, and update the conditions in Resolution 2021-18. On a roll call vote, Dierking, Kurschner, Hersman, Caron, and Carlson voted yes. Motion carried 5/0. 9. PETITIONS, REQUESTS and COMMUNICATIONS Minutes City Council Meeting March 1, 2021 Page 5 (a) Concession Building Project Kurschner moved, Caron seconded, to authorize the Committee to proceed with the exploration of selecting a consultant to facilitate the planning process for the concession building and to appoint a PAC and as needed advisors to the PAC for the concession building project. On a roll call vote, Dierking, Caron, Hersman, Kurschner, and Carlson voted yes. Motion carried 5/0. 10. ORDINANCES and RESOLUTIONS (a) Commercial Districts Ordinance Dierking moved, Hersman seconded, to continue this item to the April 5, 2021 Work Session Agenda. On a roll call vote, Dierking, Caron, Hersman, Kurschner, and Carlson voted yes. Motion carried 5/0. (b) Food Truck Ordinance Kurschner moved, Caron seconded, to waive the first reading of Ordinance No. 627 and schedule the second reading for the March 15, 2021 City Council Meeting. On a roll call vote, Caron, Hersman, Kurschner, and Carlson voted yes. Councilmember Dierking voted no. Motion carried 4/1. 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) None 12.
