City of Excelsior Regular Council Meeting MINUTES Monday, August 2, 2021 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:34 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Caron, Dierking, Hersman, and Kurschner Absent: None Also Present: City Manager Luger, City Attorney Staunton, City Engineer Dawley, Public Works Superintendent Amundsen, Interim Planner Mullin and City Clerk Williams 3. APPROVAL OF MINUTES (a) July 19, 2021 City Council Work Session Minutes (b) July 19, 2021 City Council Minutes Caron moved, Dierking seconded, to approve the July 19, 2021, City Council Work Session Minutes and July 19, 2021, City Council Minutes. Motion carried 5/0. 4. OPEN FORUM Peter Hartwich, 186 George Street, addressed the Council about the development at 511 Second Street and the purchase of 106 Center Street. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Excelsior-Lake Minnetonka Chamber of Commerce Update Jen Weiss, Excelsior-Lake Minnetonka Chamber of Commerce, gave an update on Crazy Days, upcoming events, and the Executive Director job posting at the Excelsior-Lake Minnetonka Chamber of Commerce. (b) Construction Updates Tim Amundsen, Public Works Superintendent, gave an update on current construction projects. (c) Drought Update Tim Amundsen, Public Works Superintendent, gave an update on the current drought situation. (d) Excelsior Fire District Update Councilmember Dierking gave an update on the Excelsior Fire District’s recent hires, fundraising efforts, training, and funding available for firefighters with physical and mental health symptoms. (e) Jenny Palmer/Finance Director Introduction (Amended) Jenny Palmer introduced herself as the new Finance Director of Excelsior. (f) Commission Update (Amended) Mayor Carlson stated that he will be conducting interviews for the Heritage Preservation Commission and Councilmember Hersman stated that she will be conducting interviews for the Park and Recreation Commission. 6. MEET EXCELSIOR (a) None Minutes City Council Meeting August 2, 2021 Page 3 7. AGENDA APPROVAL (a) Meeting Agenda Hersman moved, Dierking seconded, to approve the August 2, 2021 Meeting Agenda. Motion carried 5/0. (b) Consent Agenda 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approve Verified Claims over $20,000. 2. 2022-2023 Street & Utility Improv. Project Feasibility Study Proposal and Authorization Action – Adopted Resolution 2021-55 Resolution Ordering Preparation of Report on Improvement for Water Street Overlay Improvements Project and 2022-2023 Street & Utility Improvements Project. 3. June Building Permit Report Action – Accepted June Building Permit Report. 4. July Building Permit Report Action – Accepted July Building Permit Report. 5. 2021 Goal Report – Second Quarter Action – No Action . Minutes City Council Meeting August 2, 2021 Page 4 6. Grant Application Authorization Action – Adopted Resolution 2021-53 Resolution Authorizing Submission of Brownfield Gap Program Financing Application for Environmental Assessment and Clean-Up of Property in Hennepin County. 7. Approve Pay Voucher No. 3 East Parking Lot Improvements Project Action – Approved Construction Pay Voucher No. 3 for the East Parking Lot Improvement Project and Authorize Payment in the amount of $1,495.11 to GMH Asphalt Corporation. 8. Approve Pay Voucher No. 1 2021 Street & Utility Improvements Project Action – Approved Construction Pay Voucher No. 1 for the 2021 Street & Utility Improvements Project and Authorize Payment in the amount of $58,965.82 to Northdale Construction Co, Inc. 8. PUBLIC HEARINGS (a) 770 Excelsior Boulevard CUP Amendment Peter Hartwich, 186 George Street, addressed the Council with concerns about the proposed CUP amendment. Paul Ostergaard, Applicant, answered questions regarding the CUP Amendment. Kurschner moved, Dierking seconded, to adopt Resolution 2021-52 Resolution Approving an Amendment to the Conditional Use Permit to Add a Second Drive- Thru for McDonald’s Restaurant at 770 Excelsior Boulevard. Motion carried 5/0. 9. PETITIONS, REQUESTS and COMMUNICATIONS Minutes City Council Meeting August 2, 2021 Page 5 (a) 511 Second Street Extension Request Kurschner moved, Dierking seconded, to approve the 511 Second Street Extension Request. Motion carried 3/2. Councilmembers Caron and Hersman voted no. (b) 2022 Excelsior Fire District Budget Caron moved, Dierking seconded, to approve the 2022 Excelsior Fire District operating budget and capital improvement project. Motion carried 5/0. (c) 2022 South Lake Minnetonka Police Department Budget Kurschner moved, Hersman seconded, to approve the 2022 South Lake Minnetonka Police Department budget. Motion carried 5/0. 10. ORDINANCES and RESOLUTIONS (a) Emergency Ordinance for Water Restrictions and Emergency Water Usage Caron moved, Hersman seconded, to approve Emergency Ordinance No. 634 An Emergency Ordinance for Seasonal Water Restrictions and Water Emergencies and Resolution No. 2021-54 Resolution of the Excelsior City Council Approving Publication of Ordinance Number 634 by Title and Summary. Motion carried 5/0. 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) None 12. UNFINISHED BUSINESS (a) None 13. NEW BUSINESS (a) Wheeler Wetland Flood Improvements Feasibility Review No Action.
