City of Excelsior Regular Council Meeting MINUTES Monday, August 16, 2021 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the meeting to order at 6:30 P.M. 2. ROLL CALL City Council: Mayor Carlson and Councilmembers Caron, Dierking, Hersman, and Kurschner Absent: None Also Present: City Attorney Staunton, Public Works Superintendent Amundsen, and City Clerk Williams 3. APPROVAL OF MINUTES (a) August 2, 2021 City Council Work Session Minutes (b) August 2, 2021 City Council Minutes (c) August 9, 2021 Special Work Session Minutes Kurschner moved, Hersman seconded, to approve the August 2, 2021 City Council Work Session Minutes, August 2, 2021 City Council Minutes, and August 9, 2021 Special Work Session Minutes with the changes as noted. Motion carried 5/0. 4. OPEN FORUM Peter Hartwich, 186 George Street, addressed the Council about the proposed use of City Hall at 106 Center Street, the South Lake Minnetonka Police Department Joint Power Agreement and budget, and Concession Project. Minutes City Council Meeting August 16, 2021 Page 2 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Excelsior-Lake Minnetonka Chamber of Commerce Update No Update. (b) Construction Updates Tim Amundsen, Public Works Superintendent, gave an update on current construction projects. (c) Drought Update Tim Amundsen, Public Works Superintendent, gave an update on the current drought situation. (d) 106 Center Street Purchase Process Kevin Staunton, City Attorney, gave an update on the purchase process of 106 Center Street. (e) Trail Stop Councilmember Caron gave an update on the Trail Stop. (f) Mayor Updates Mayor Carlson gave an update on the Concerts in The Commons, National Night Out, and the retirement of Police Chief Meehan. 6. MEET EXCELSIOR (a) None 7. AGENDA APPROVAL (a) Meeting Agenda Minutes City Council Meeting August 16, 2021 Page 3 Caron moved, Dierking seconded, to approve the August 16, 2021 Meeting Agenda. Motion carried 5/0. (b) Consent Agenda Hersman moved, Dierking seconded, to approve the August 16, 2021 Consent Agenda. Motion carried 5/0. 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 Action – Reviewed Verified Claims under $20,000 and Approve Verified Claims over $20,000. 2. Special Event Permit Refund Request Action – Refunded Excelsior Realty and State Farm Insurances $100 Special Event Permit Fee. 3. Business License Approval Action – Approved Business License. 4. Continue Commercial Districts Ordinance Amendment Action – Continued Commercial Districts Ordinance Amendment to the September 20, 2021 City Council Meeting. 5. Resolution 2021-58 Accepting ARPA Funds Action – Approved Resolution 2021-58 Accepting ARPA Funds. 6. Approve Pay Voucher No. 5 Bandshell Minutes City Council Meeting August 16, 2021 Page 4 Action – Approved Application and Certificate for Payment No. 5 for the Excelsior Commons Bandshell Project and authorize payment in the amount of $222,919.87 to Gardner Builders. 8. PUBLIC HEARINGS (a) None 9. PETITIONS, REQUESTS and COMMUNICATIONS (a) Concession Building/Plaza Schematic Design Hersman moved, Caron seconded, to approve the schematic design for the concession building/plaza and authorize the PAC to proceed to the design development phase with an estimated project budget of $3.21 million. Motion carried 5/0. (b) LoCorr Excelsior Flats - Second Sketch Plan Bob Sarna, LoCorr Development, presented a new application of the sketch plan review for 690 Excelsior Boulevard. The Council provided comments and no action was taken. 10. ORDINANCES and RESOLUTIONS (a) None 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) Commission Appointments Hersman moved, Dierking seconded, to accept the recommendation from the Park and Recreation Interview Committee to appoint Leigh Smith. Motion carried 5/0. Kurschner moved, Caron seconded, to continue the Heritage Preservation Commission Appointment to the September 7, 2021 City Council Meeting. UNFINISHED BUSINESS (a) 810 Excelsior Boulevard Purchase Agreement Amendment Kurschner moved, Dierking seconded, to approve the Fifth Amendment to the Purchase Agreement and authorize its execution by the Mayor and City Manager.
