City of Excelsior City Council Closed Session MINUTES Monday, May 16, 2022 5:30 P.M. 1. CALL TO ORDER/ROLL CALL Mayor Carlson called the closed session to order at 5:32 P.M. City Council: Mayor Carlson and Councilmembers Dierking, Hersman, and Kurschner Absent: Councilmember Caron Also Present: Monte Mills and Katherine Swenson of Greene Espel, City Manager Luger, and City Attorney/ Assistant City Manager Staunton 2. AGENDA APPROVAL Hersman moved, Kurschner seconded, to approve the May 16, 2022 City Council Closed Session Agenda. Motion carried 4/0. 3. MOTION TO CLOSE THE MEETING PURSUANT TO MINN. STAT. § 13D.05, SUBD. 3(C) Hersman moved, Dierking seconded, to enter the closed session to consult with legal counsel regarding pending litigation, David Miller v. City of Excelsior. Motion carried 4/0. 4. CLOSED SESSION TO CONSULT WITH LEGAL COUNSEL REGARDING PENDING LITIGATION, DAVID MILLER V. CITY OF EXCELSIOR  Minutes City Council Closed Session May 16, 2022 Page 2 5. MOTION TO RETURN TO OPEN SESSION Dierking moved, Hersman seconded, to return to open session. Motion carried 4/0. 6. ADJOURNMENT The closed session was adjourned at 5:55 P.M.
