City of Excelsior Regular Council Meeting MINUTES Monday, October 21, 2024 106 Center Street, Excelsior, MN 55331 – Entrance located on Center Street 6:30 P.M. 1. CALL TO ORDER Mayor Carlson called the regular October 21, 2024, council meeting to order at 6:40 P.M. 2. ROLL CALL Present: Mayor Carlson and Councilmembers Caron, Hersman, and Tyler. Absent: Councilmember Dierking. Also Present: City Manager Luger, Planning Director Mullin, Public Works Director Amundsen, City Clerk Bajda. 3. APPROVAL OF MINUTES (a) October 7, 2024, City Council Work Session Minutes (b) October 7, 2024, City Council Meeting Minutes Caron moved, Tyler seconded to approve the October 7, 2024, City Council Work Session and October 7, 2024, City Council meeting minutes with corrections communicated to staff prior to meeting. Motion carried 4/0. 4. OPEN FORUM This is the time for the public to speak on non-agenda items. Open Forum will be limited to one-half hour. No person may speak more than five (5) minutes or more than once. Each subject will have a limit of ten (10) minutes. Council members may ask questions of the speaker. With the agreement of the Council, such matters taken up during the “Open Forum” may be scheduled on the current or a future Agenda. Members of the public interested in speaking on an agenda item may direct a request to be recognized to the Mayor. Bob Bolles, 229 George Street, addressed the Council regarding new parking ramp and how the debt service would be financed. Nikki Craig, 731 Second Avenue, addressed the Council regarding E-bike usage on the crossing of Mill Street and Highway 7 bridge and the danger when they utilize the sidewalk. Council directed staff to connect with police department on sidewalk use and explore the need for additional signage. Minutes City Council Meeting Monday, October 21, 2024 Regular Meeting Page 2 Bruce Kelly, 165 Maple Street, addressed the Council and expressed concerns about asking voters for additional funding for the Commons, lack of parking enforcement and wastewater permit violations. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS (a) Met Council Project Update Public Works Director Amundsen provided the council with an update on Met Council project. (b) Parks and Recreation Commission Update Public Works Director Amundsen provided the council an update on recent meetings of the Parks and Recreation Commission. (c) South Lake Minnetonka Police Department Update Mayor Carlson provided update on recent meetings and department work. (d) Fall Cleanup on October 26 Mayor Carlson reminded residents of fall cleanup day. (e) Election Update City Clerk Bajda provided update on election activities to date for the General Election, including absentee, health care facility and equipment testing. Mayor Carlson mentioned Representative Andrew Myers that was recognized by League of Minnesota Cities as legislator of distinction for 2024 and noted Excelsior Elementary parade on October 24, 2024. 6. MEET EXCELSIOR (a) Tiffany King, Excelsior-Lake Minnetonka Chamber of Commerce Update Executive Director King provided the council an update on Chamber happenings, membership numbers, special events and networking opportunities for the business community. Discussed beautification efforts and confirmed the winter planters on Water Street will be completed soon. 7. AGENDA APPROVAL (a) Meeting Agenda Hersman moved, Tyler seconded, to approve the October 21, 2024, agenda with request to pull item 4 off the consent agenda for further discussion and approve remaining consent agenda items. Motion carried 4/0. (b) Consent Agenda 1. Review Verified Claims under $20,000 and Approve Verified Claims over $20,000 2. Third Quarter Gambling Report 3. Resolution 2024-33 Authorizing Participation in Exploring the Formation of a Transit Management Organization Highway 7 4. Ordinance 673 Amending Chapter 32 to Allow Overnight Parking in Municipal Parking Garage, First Reading 5. Variance Denial 151 Bell Street, Resolution 2024-38 6. Application to Minnesota Department of Economic Development Contamination Cleanup Grant, Resolution 2024-39 Minutes City Council Regular Meeting Monday, October 21, 2024 Page 3 7. Change Order #3 Excelsior Blvd. Lift Station 8. Pay Voucher #5 Excelsior Blvd. Lift Station (c) Ordinance 673 Amending Chapter 32 to Allow Overnight Parking in Municipal Parking Garage, First Reading Council discussion and direction to staff to amend the Ordinance as presented to maintain language that restricted overnight parking but modify other portions related to hour restrictions and Water Street residents. Hersman motioned, Caron seconded to direct staff to amend the ordinance language as presented and bring said revisions to the November 4, 2024, council meeting for a first reading. Motion carried 4/0. 8. PUBLIC HEARINGS (a) None 9. PETITIONS, REQUESTS and COMMUNICATIONS (7:15 P.M.) (a) None 10. ORDINANCES and RESOLUTIONS (a) None 11. REPORTS of OFFICERS, BOARDS, and COMMITTEES (a) None 12. UNFINISHED BUSINESS (a) None 13. NEW BUSINESS (a) Schedule special council meeting (Canvassing Board General Election) City Clerk Bajda suggested timeframe to hold meeting that met statue requirements. Tyler motioned, Caron seconded to schedule a special meeting of the City Council on November 12, 2024, at 9 A.M at Excelsior City Hall. Motion carried 4/0. 14.
