BOARD OF ZONING APPEALS The regular meeting of the Board of Zoning Appeals was held on February 2, 2017 at 7:00 p.m. in the Public Safety Building located at 500 Quincy Street. President Joe Manchin, Jr. called the meeting to order at 7:00 p.m. ROLL CALL OF MEMBERS Present Absent President Joe Manchin, IV Board Member Shultz Board Member Deasy Board Member Ragan Board Member Majic City Staff Present City Planner, Sandra Scaffidi Planning Dept. Secretary, Maria Cipolla APPROVAL OF MINUTES President Manchin asked for a motion to approve the minutes from December 1, 2016. Board Member Majic motioned to approve the minutes. Board Member Ragan seconded the motion. Motion carried 5-0. PUBLIC HEARINGS FOR February 2, 2017 1. Homer Hess, owner of Hess’s Fitness Gym, located at 503 Virginia Avenue is requesting a variance from Fairmont City Code 4.26.3 Neighborhood Development Standards to allow for 24 hours operation of the business. Currently the hours of operation are restricted to 8am to 10pm. The property is located in a Neighborhood Mixed Use Zoning District. (Tax Parcel 03-03-271; 03-03-272) President Manchin asked if there was anyone to speak in favor of this request. Homer Hess: My brother and I are co-owners of Hess Gym. I am here to request a variance to allow our gym to be open for 24 hours to compete with other gyms that are located just outside of the City. I did talk to the closest neighbor and she was fine with us being open 24 hours. I will be living above the gym and will be sure to handle any noise complaints immediately. President Machin: Is there anyone here to speak against this request. There were none. President Manchin: Do I have a motion to close the public hearing? Board Member Majic: I motion to close the public hearing. Board Member Deasy seconded the motion. Motion carried 5-0 President Manchin asked for the staff report. Page 1 of 2 Sandra Scaffidi: I believe we want to encourage new business and development. Based on the location of this existing business, I don’t see a problem for it to be 24 hours, as long as there are no objections from the residents. Board Member Majic: I agree with Sandra. President Manchin: Do I have a motion for this request? Board Member Ragan motion to approve the request as submitted. Board Member Deasy seconded the motion. Motion carried 5-0. DISPOSITION OF PAST CASES None OTHER BUSINESS None ADJOURNMENT President Manchin asks for a motion to adjourn. Board Member Majic motioned to adjourn. Board Member Ragan seconded the motion.
