ADJOURMENT BOARD OF ZONING APPEALS This meeting of the Board of Zoning Appeals was held September 2nd, 2021 at 7:00 p.m. in the Public Safety Building located at 500 Quincy Street. ROLL CALL OF MEMBERS Present Absent Board Member Majic President Shultz Board Member Knapp Board Member Perkins Board Member Manchin City Staff Present Director of Planning- Shae Strait Staff Assistant, Kirstin Poluck Vice President Knapp called the meeting to order at 7:00 p.m. Vice-President Knapp made a motion to excuse Board Members Shultz and Perkins from tonight’s meeting. All were in favor. The motion was approved. APPROVAL OF MINUTES OF August 5th, 2021 Board Member Knapp asked for everyone to read of the previous months minutes and look for corrections or additions. With no corrections or additions indicated, a motion was made by Board Member Knapp to approve the minutes. Board Member Majic seconded the motion. Motion passed unanimously. PUBLIC HEARINGS FOR June 3rd, 2021 1. Jonathan Martin, owner of Tetra Holding Co., is requesting a Conditional Use Permit in accordance with Article 8.3.2 of the City of Fairmont Zoning Code to allow for a non-conforming use to change to another equal or less non-conforming use. The applicant is requesting a Conditional Use Permit for “Retail and Service use, not to exceed 5,000 sq ft”. The previous non-conforming use was “Automotive Sales and Services”. The property is located at 501 Merchant St. and is zoned Neighborhood Residential. Board Member Knapp asked if anyone is here to speak in favor of the variance. Frank Sowers spoke on behalf of the request. He stated that he is a lifetime resident of Fairmont and is the current owner of the property. The property in question has been vacant for the last 8-10 months as he has moved his business from the location. However, the property has been well maintained even though it is vacant. Mr. Sowers bought and renovated several of the other properties nearby over the last 18 years. He will be partially invested for the next 15 years with Mr. Martin at this location and new business venture. Jonathan Martin, formerly of Monongah and currently located in Thomas, WV, spoke in favor. He has been a math professor for the last 10 years and also opened up a coffee business in Davis, WV as well. He has been awarded 3 dispensary permits for WV. He would like to use one of permits to open a medical dispensary here in Fairmont. Board Member Knapp asked if there is anyone here to speak against the request. There was no one, and with that Board Member Knapp asked for a motion to close the public hearing. Board Member Majic motioned to close, Board Member Manchin seconded the motion. Planning Director Shae Strait stated that the retail is a less intense use. The business will be required to meet all standards. The requirements are: a. Hours of operation shall be restricted to 8:00 a.m. to 10:00 p.m.; b. Shall be oriented to the front of the lot facing the main street; c. Parking shall be located in the rear or side yards; d. No outdoor display of merchandise or products shall be permitted; e. Lighting shall be shielded and subdued so as not to interfere with the quiet use and enjoyment of surrounding properties as determined by the planning director; f. Traffic flow shall be patterned in such a manner so as not to interfere with the quiet use and enjoyment of surrounding properties; Staff recommended for the approval of the request based upon the evidence within the staff report and the determination that the proposed use, Retail Sales and Services, not to exceed 5,000 SF, was a less intense use than the previous Automotive Services. Board Member Knapp stated that there was an elected official who reached out to him regarding this issue and stated that they were in favor of adding medical cannibus. He wanted to make everyone aware that this occurred even though it did now sway his decision one way or the other. Board Member Knapp asked for a motion regarding the request. Board Member Majic moved to approve the conditional use permit. Board Member Manchin seconded. President Shultz- Absent Board Member Knapp- Yes Board Member Perkins- Absent Board Member Manchin- Yes Board Member Majic- Yes The motion passed and the Conditional Use Permit was approved. BOARD OF ZONING APPEALS STAFF REPORT PETITION # BZA 21-08 PREPARED 9/16/2021 Introduction Brad Kisner is requesting a variance to keep an unauthorized accessory structure, a pool, within the front yard of 702 Pittsburgh Ave. Existing Conditions The property is located at 702 Pittsburgh Ave. It is zoned General Residential, along with all other properties on Pittsburgh Ave. All adjacent uses are single-family residential.
