February 27, 2018 The regular meeting of the City Council of the City of Fairmont was held at 7:00 p.m. on the 27th day of February, 2018, at the Public Safety Building located at 500 Quincy Street in Fairmont, West Virginia. Deputy Mayor Yann called the meeting to order. Councilmembers present were: First District Marianne Moran Second District Frank G. Councilmember Mason seconded the motion. The Deputy Mayor declared Mayor Mainella excused by voice vote of Council. IN RE: ADJOURN TO EXECUTIVE SESSION Deputy Mayor Yann moved to adjourn to Executive Session as per WV Code §6-9A-4(2)(9) and City Charter Section 2.11(a)(1)(A) – To consider matters arising from the appointment, employment, retirement, promotion, transfer, 1 demotion, disciplining, resignation, discharge, dismissal or compensation of a public officer. Councilmember Moran seconded the motion. Roll call was taken by the Clerk for the Executive Session. The Deputy Mayor declared the meeting adjourned to Executive Session at 7:05 p.m. by unanimous vote of those Councilmembers present. IN RE: MEETING RECONVENED The Deputy Mayor declared the meeting reconvened at 7:10 p.m. IN RE: ONE COUNCIL APPOINTMENT, THIRD DISTRICT VACANCY, UNEXPIRED TERM TO END AT THE COMPLETION OF THE CANVASS OF THE NOVEMBER 6, 2018 MUNICIPAL ELECTION Deputy Mayor Yann entertained a motion for one Councilmember appointment to the 3rd District vacancy created by the resignation of Robert Linger on February 13, 2018. He noted this will be for an unexpired term to end at the completion of the canvass of the November 6, 2018 Municipal Election. Motion: Councilmember Straight moved to appoint Walter L. Colley, Jr. as a Councilmember to the unexpired term of the 3rd District. The motion was seconded by Councilmember Mason. Roll call was taken by the Clerk. The Deputy Mayor declared Walter L. Colley, Jr. appointed to the 3rd District vacancy created by the resignation of Robert Linger on February 13, 2018 by unanimous vote of those Councilmembers present. The Deputy Mayor noted this will be for an unexpired term to end at the completion of the canvass of the November 6, 2018 Municipal Election. IN RE: OATH OF OFFICE – WALTER L. COLLEY, JR. – 3RD DISTRICT The City Clerk issued the Oath of Office to the newly-appointed Councilmember, Walter L. Colley, Jr., representing the unexpired term of the 3rd District. Congratulations were extended to Councilmember Colley. 2 IN RE: OPENING CEREMONIES Rev. Val Gittings gave the invocation followed by the Pledge of Allegiance to the Flag led by Councilmember Mason. APPROVAL OF MINUTES Deputy Mayor Yann noted that each member of Council had received a copy of the minutes from the Regular Meeting held on February 13, 2018. Councilmember Straight moved to approve the minutes as submitted. The motion was seconded by Councilmember Merrifield. The Deputy Mayor declared the minutes approved as submitted by voice vote of Council. PUBLIC HEARINGS IN RE: AN ORDINANCE TO APPROVE AND ADOPT CURRENT REPLACEMENT PAGES TO THE FAIRMONT CITY CODE Pursuant to a notice duly published in the Times-West Virginian on February 19, 2018, a public hearing was convened to obtain citizen input on a proposed ordinance to approve and adopt replacement pages to the Fairmont City Code. The Deputy Mayor asked if anyone present desired to speak to the proposed ordinance. There being no one to speak, the public hearing was called to a close at 7:17 p.m. IN RE: AN ORDINANCE PROVIDING FOR THE PUBLIC AUCTION OF SURPLUS PERSONAL PROPERTY OF THE CITY OF FAIRMONT; RESERVATION OF RIGHTS Pursuant to a notice duly published in the Times-West Virginian on February 19, 2018, a public hearing was convened to obtain citizen input on a proposed ordinance providing for the Public Auction of Surplus Personal Property. 3 The Deputy Mayor asked if anyone present desired to speak to the proposed ordinance. There being no one to speak, the public hearing was called to a close at 7:18 p.m. ANNOUNCEMENTS IN RE: CONGRATULATIONS TO COUNCILMEMBER COLLEY Councilmember Straight extended congratulations to Councilmember Colley. Councilmember Mason also extended congratulations to Councilmember Colley. He noted that he looked forward to working with him. Councilmember Grubb welcomed Councilmember Colley. Councilmember Warner extended a welcome to Councilmember Colley. Councilmember Moran said congratulations to Councilmember Colley and she looked forward to working with him. Councilmember Colley thanked Council for giving him this chance to serve and to represent the community. He said that he looked forward to working with everyone and moving the City forward. Councilmember Merrifield said that there were three excellent candidates that were interested in serving, all deserving, and it was a tough choice. He noted that Council looks forward to working with Councilmember Colley. IN RE: FAIRMONT 101 Councilmember Moran said that anyone interested in running for City Council should sign up for Fairmont 101. She noted that it will be the best, good, solid education you can get on the workings of the City of Fairmont. CITIZENS PETITIONS IN RE: AMERICAN FLAGS PRESENTED TO CITY SCOTT CROUCH, on behalf of Woodman Life, presented several United States flags to the City of Fairmont. He noted it was their way of giving 4 back to the community. IN RE: PRAYER AT COUNCIL MEETING JON DODDS, 1613 Country Club Road, addressed Council regarding giving a prayer at a Council meeting. He said that he has always enjoyed the opening invocation which is open to any faith. He noted that everyone’s rights are protected. He then pointed to the 2014 U.S. Supreme Court decision in Greece v. Galloway in which the court ruled 5-4 that prayer was allowed in government meetings. He then asked Council to continue with the prayer at the meetings. CHARLIE ROSS, employee of the Public Works Department, addressed Council regarding prayer. He said that prayer is very important to our Country and to our Nation. He then read a scripture from the Bible. He asked Council to consider having a prayer at the Council meetings. IN RE: NAMING OF NEW COAL RUN BRIDGE GEORGE RAMSEY, 1036 Sunset Drive, addressed Council regarding the naming of the new Coal Run Bridge. After a lengthy presentation, he suggested the name of Fuzzy Knight and said the bridge should be contributed to this man. BETHANY RETTON, 341 Colfax Road, stated that it surprised her when “The Battle of the Fairmont Bridge” was being voted on because she thought the bridge was going to be named after Rose Cousins. She said the bridge should be name after Mrs. Cousins for all she has done for the African- American community and for Fairmont as a whole. She said it would be a shame to name the bridge “The Battle of Fairmont Bridge” because she said that was a Confederate victory and she thought it would be disrespectful to the African-American community in Fairmont. She then explained the life of Rose Cousins in which she said she was an amazing woman. She closed by saying that the battle does not need more recognition. ROMELIA HODGES, 614 Benoni Avenue, asked Council to name the bridge after Rose Agnes Rolls Cousins. She said that she represents the African- American community and all women and said there is no commemoration of a woman bridge. She added that this woman is an inspiration not only to the African-American community of the past or in the Civil Rights era but also to our young ladies who are growing up today. She said what an opportunity it would be to give this honor to a female who has done so much 5 in this city with very little. She said that if you give her this honor, it will not only mean so much to a large sector of our community here in Fairmont but those to come after us. CREED HOLDEN, 516 Prospect Avenue, also talked to Council about the naming of the bridge. He spoke in opposition to naming the new bridge as “The Battle of Fairmont Bridge”. He said in this day and age of escalating violence, we should try to avoid more violence and instead try to find ways to emphasis the better aspects of human nature. He said that on behalf of himself and hundreds of other people, he requested that Council name the bridge as “The Rose Agnes Rolls Cousins Memorial Bridge”. He then asked Council to reconsider honoring Rose because of her remarkable life story and she is more than deserving of this honor. MICHAEL BOBIC, 10 Hollen Circle, stated this is a time to come together and there are reasons to name the bridge after “the Battle of Fairmont”. He noted there are good reasons to name it after Fuzzy Knight, after Rose Cousins, and after the First Father’s Day Church. Council has multiple possibilities here but this is a situation where Council has an opportunity to consider all of these possibilities and make a statement about what we believe Fairmont is. He said that any one of these names would well represent who we are as citizens of Fairmont. He then asked Council to consider the name “prayerfully”. IN RE: TWO POLICE OFFICERS COMMENDED POLICE CHIEF STEVE SHINE wanted to recognize two of his officers for their bravery. He said that Michael Angelucci with the Marion County Rescue Squad was going to speak but thought it would be out of turn in reference to an attempted suicide that we had last week. He said that on February 19 a woman decided to take her life off the Third Street Bridge. The contributions made by all of his officers and the dedication that they have shown, every day he sees acts of selfless service and dedication and every day he tries to thank them for what they do. This act, two officers went above and beyond in what they did to try to save this woman’s life. A caller had seen a woman exit her vehicle and jump off the Third Street Bridge into the river and it was pitch black outside and there was no lights, no moon, no stars, nothing like that. The officers were able to locate her and went into the river after her, pulled her to the shore where a Deputy helped them get out. Another officer gave her his jacket to stay warm. These officers were asked to be honor because of the decision they made. The decision they made went above and beyond the normal acts of sacrifice that you do on a daily basis. These officers put themselves at great risk to try to help her from whatever 6 temporary issues she was going through. Unfortunately, the woman passed away to her injuries a few days later, despite the officers successfully pulling her from the river. He then said that Officer Freme and Officer Hudson (soon to be Sergeant Hudson) were the officers that risked their life to save another. The Chief thanked them for their service on a daily basis. The Chief also said that the Fire Department took their boat out on the rough waters to try to help her, the Rescue Squad was there to immediately begin first aid and transport her for the injuries. The Chief then said that he sees this on a daily basis, not to this extent, but where they risk their life to save another. The Council thanked the officers, and the police department as a whole, for the dedicated work they do every day to keep the community safe. Deputy Mayor Yann said that all Councilmembers get a copy of Chief Shine’s Weekly Report and you should see how many calls they make and what they have to put up with. He personally thanked the Chief and his department. Councilmember Straight said that the whole Police Department puts their life out there every day. He then thanked Officers Freme and Hudson for what they did in rescuing the woman from the river. CITY MANAGER’S REPORT IN RE: POLICE DEPARTMENT Mr. Gomez also thanked the Police Department for their outstanding work every day. IN RE: FAIRMONT 101 The City Manager invited everyone, although there is limited space, to attend in Fairmont 101. He noted that the first session will begin Thursday, April 5th. It will be the first and third Thursday of every month from 11:00 a.m. to 1:00 p.m. and lunch will be included. This is a good way to learn more about what the City does. IN RE: FY19 BUDGET WORK SESSION The City Manager mentioned that, prior to this meeting, Council held a work session on the FY19 budget. He said the PowerPoint presentation on the 7 budget will be on the City’s internet site for viewing. CONSIDERATION OF COUNCIL BUSINESS IN RE: ADOPTION, AN ORDINANCE TO APPROVE AND ADOPT CURRENT REPLACEMENT PAGES TO THE FAIRMONT CITY CODE Deputy Mayor Yann entertained a motion for the adoption of an ordinance to approve and adopt current replacement pages to the City Code. Motion: Councilmember Mason moved for the adoption of the proposed ordinance. Councilmember Straight seconded the motion. Roll call was taken by the Clerk. The Deputy Mayor declared the ordinance adopted by unanimous vote of those Councilmembers present and the ordinance designated as Ordinance No. 1759 was duly adopted. IN RE: AN ORDINANCE PROVIDING FOR THE PUBLIC AUCTION OF SURPLUS PERSONAL PROPERTY OF THE CITY OF FAIRMONT; RESERVATION OF RIGHTS Deputy Mayor Yann entertained a motion for the adoption of an ordinance providing for the Public Auction of Surplus Personal Property. Motion: Councilmember Straight moved for the introduction of the proposed ordinance and the reading of a synopsis in lieu of the entire ordinance. Councilmember Warner seconded the motion. The Clerk read the proposed ordinance by synopsis for the first time. The Deputy Mayor declared the public hearing set for March 13, 2018 by voice vote of Council. IN RE: ADOPTION, A RESOLUTION BY THE COUNCIL OF THE CITY OF FAIRMONT, WEST VIRGINIA, AMENDING COUNCIL’S RULES OF ORDER AND PROCEDURE TO PROVIDE FOR THE REMOVAL OF PRAYER/MEDITATION FROM THE ORDER OF BUSINESS RELATIVE TO ALL REGULAR MEETINGS OF COUNCIL AS REQUIRED BY RULE 3 COUNCIL PROCEDURE OF SAID RULES Deputy Mayor Yann entertained a motion for the adoption of a resolution amending Council’s Rules of Order to provide for the removal of Prayer/Meditation from the Order of Business as required by Rule 3 of Council Procedure. Motion: 9 Councilmember Merrifield moved for the adoption of the proposed resolution and the reading of a synopsis in lieu of the entire resolution. The motion was seconded by Councilmember Colley. The Clerk read the proposed resolution by synopsis for the first time. Discussion: Councilmember Moran stated that she thought there has been a lot of confusion about how people are chosen that are allowed to come before Council for the Opening Ceremonies. She said that it was said tonight that people of all faiths are allowed to come and she wanted to make sure that was correct. Councilmember Grubb asked D.D. Meighen to speak on this issue. Deputy Mayor Yann asked the City Attorney if D.D. Meighen was allowed to speak at this time. The City Attorney replied that this discussion is only between Council. Councilmember Grubb said there have been members of the Buddhism faith, the Hindu faith, and the Mormon faith that have all spoke before Council giving prayer. The Deputy Mayor reminded Council that if you want to keep prayer, you have to vote no. Councilmember Straight stated this has been an enlightening year for him. He has been involved on Council for 20 plus years and for someone to sit up here and say that they have had other faiths afforded the opportunity when there has not been. He said that person may have chosen not to be here and with that being said, he is just as Christian as anyone else in this room but everybody in this room does it different but we all pray to the same God. He said not too long ago but we had a Human Rights Commission voted and set up and now we are waiting for the citizens of Fairmont to vote for this Human Rights bill. With all of this being said, what are we doing here tonight, to sit here and vote for prayer or to not have prayer. For the 20 plus years he has served on Council, we have had numerous faiths. His wife is Jewish and if she would come in here and sit, is she offended, no. She will go right along with it. He said that hopefully, the next meeting we can have a Rabbi in here and hopefully that doesn’t offend the other people. So, that’s where we are as a Council, we are not against prayer and meditation. 10 He then said that we have had numerous discussions on this and we, as a Council, went to Charleston and the lawyers from the Municipal League had told us and told us and told us not to exclude another faith. Councilmember Mason said that he thought this item was on the agenda by error. It was not intended and never an intention from City Council to remove prayer. This whole issue came about by mistake and what it does is provide us an opportunity for us, as Council, to re-affirm our desire to have prayer. IN RE: ADOPTION, A RESOLUTION OF THE COUNCIL OF THE CITY OF FAIRMONT, WEST VIRGINIA REQUESTING THAT THE WEST VIRGINIA DEPARTMENT OF TRANSPORTATION, DIVISION OF HIGHWAYS, UNDERTAKE TO OFFICIALLY NAME THE COAL RUN HOLLOW REPLACEMENT BRIDGE IN THE CITY OF FAIRMONT, MARION COUNTY, WEST VIRGINIA, AS “THE BATTLE OF FAIRMONT BRIDGE” Deputy Mayor Yann entertained a motion for the adoption of a resolution requesting the WV State DOH to officially name the Coal Run Hollow Replacement Bridge as “The Battle of Fairmont Bridge”. No motion was made on this item. The Deputy Mayor said this item died for the lack of a motion and second. IN RE: ADOPTION, A RESOLUTION BY THE COUNCIL OF THE CITY OF FAIRMONT, WEST VIRGINIA, AUTHORIZING THE FILING OF AN APPLICATION WITH THE WEST VIRGINIA HUMANITIES COUNCIL FOR A MAJOR GRANT TO FUND, IN PART, A MURAL PROJECT INTERPRETATING FAIRMONT’S HISTORY AND CULTURAL HERITAGE ON THE ABUTMENT AT PALATINE PARK, AND IF AWARDED, FURTHER AUTHORIZING THE ACCEPTANCE THEREOF AND PROVIDING THE CITY MANAGER WITH AUTHORITY TO DO ALL THINGS REASONABLE AND NECESSARY IN CONNECTION THEREWITH 11 Deputy Mayor Yann entertained a motion for the adoption of a resolution authorizing the filing of a grant application to fund a mural project on the abutment at Palatine Park. Motion: Councilmember Warner moved for the adoption of the proposed resolution and the reading of a synopsis in lieu of the entire resolution. The motion was seconded by Councilmember Moran. The Clerk read the proposed resolution by synopsis for the first time. Councilmember Mason asked which abutment we were talking about. Mr. Gomez said it was the abutment that Councilmember Mason brought up in prior meetings. It is the one that currently has the Lamar billboard attached to it and it is actually on East Park Avenue. Councilmember Mason said that he was imagining that ugly wall not being there. He said that he looked forward to voting no because he would like to see that ugly wall removed. Mr. Gomez said that our intent is to beautify the wall, however, if Council would prefer to remove the wall, a preliminary cost estimate to remove the wall was a minimum of $100,000, likely upwards of $150,000 to remove the abutment. Councilmember Straight said that right now he did not think it was feasible to remove the wall but if we can cover it up and make it look nice, that is a step in the right direction. IN RE: ADOPTION, A RESOLUTION BY THE COUNCIL OF THE CITY OF FAIRMONT, WEST VIRGINIA, RECOGNIZING THE VALUE AND IMPORTANCE OF THE FAIRMONT STATE UNIVERSITY ARCHITECTURE PROGRAM Deputy Mayor Yann entertained a motion for the adoption of a resolution recognizing the importance of FSU’s Architecture Program. Motion: Councilmember Moran moved for the adoption of the proposed resolution and the reading of a synopsis in lieu of the entire resolution. The motion was seconded by Councilmember Merrifield. IN RE: ONE COUNCIL APPOINTMENT, CONVENTION AND VISITORS BUREAU OF MARION COUNTY, UNEXPIRED TERM TO END JUNE 30, 2018 Deputy Mayor Yann entertained a motion for one Councilmember appointment to the CVB for an unexpired term to end June 30, 2018. Motion: Councilmember Straight moved to appoint Councilmember Marianne Moran to the CVB for an unexpired term to end June 30, 2018. The motion was seconded by Councilmember Grubb. Roll call was taken by the Clerk. 14 The Deputy Mayor declared Councilmember Marianne Moran appointed to the CVB for an unexpired term to end June 30, 2018 by unanimous vote of those Councilmembers present. IN RE: COUNCILMEMBER GRUBB REQUESTED TO SPEAK Councilmember Grubb said that she wanted to address Council regarding items that she didn’t get a chance to talk about earlier. The Deputy Mayor asked the City Attorney if she was allowed to speak at this point. Mr. Sansalone said that he is in a position to say that it is out of order.
