FAIRMONT PLANNING COMMISSION The regular meeting of the Fairmont Planning Commission was held on September 16, 2015 at 7:00 p.m. at the Public Safety Building located at 500 Quincy Street. Vice President Aron Majic called the meeting to order at 7:00 p.m. and asked for a roll call of members. ROLL CALL OF MEMBERS MEMBERS PRESENT: MEMBERS ABSENT: Vice President Majic President Oliver Commissioner Weber Commissioner Straight Commissioner Richardson Commissioner Miller Commissioner Greene Commissioner Parker Commissioner Pitman CITY STAFF: City Planner – Mark Miller Recording Secretary – Maria Cipolla PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES FROM July 15, 2015 and July 22, 2015 Vice President Majic asked for a motion to approve the minutes. Commissioner Weber motioned to approve minutes. Commissioner Greene seconded. Motion carried 6-0 PUBLIC HEARINGS FOR September 16, 2015 None PUBLIC HEARINGS TO SET FOR October 21, 2015 1. Stoney Quinto, on behalf of S&S Auto Sales, is requesting a rezoning of his property located at 315 Morgantown Avenue from Neighborhood Mixed Use to Main Corridor Commercial. Tax Map 03-05 Parcels 103 through 110. Vice President Majic asked City Planner, Mark Miller for a staff report. Mark Miller stated, Mr. Quinto has applied for a rezoning of his property at 315 Morgantown Avenue. Staff recommends the request be set for public hearing at the October meeting. Vice President Majic added, that was pretty straight forward. Commission Eddie Parker motioned to set the public hearing. Commissioner Greene seconded the motion. 1 Commissioner Eddie Parker said, Mr. Chairman, I would asked that we invite Mr. Sansalone (the City Attorney) to appear that evening and be present for the discussion and enlighten us as need be. Could we extend that invitation and request for his presence that evening? Vice President Majic added, noted, I am sure that is something we can do. Commissioner Eddie Parker added, if the rest of the Commissioners agree with that, that is fine. This is my personal request. I can’t speak for the Commission. That would be my request. Mark Miler and the Board members all agreed that it would be a great idea. Vice President Majic said, thanks Eddie. 2. Blanche Rowan is requesting a rezoning of her property along Suncrest Avenue, Tax Map 06-07 Parcels 116 and 117, from Neighborhood Mixed Use to Industrial. Vice President Majic asked City Planner, Mark Miller for his staff comments. Mark Miller stated, Mrs. Rowan has applied for a rezoning of her property along Suncrest Avenue. Staff recommends the request be set for public hearing at the October meeting. Commissioner Weber asked where exactly this property is located. Mark Miller explained that these parcels are located between Morgantown Ave and Speedway on Suncrest Blvd. Vice President Majic asked if there is a motion to set this hearing. Commissioner Greene motioned to set the hearing. Commissioner Weber seconded the motion. NEW BUSINESS None CITIZENS PETITION None. OTHER BUSINESS Commissioner Comments: Commissioner Weber asked, when was the last time we denied Mr. Quinto his rezoning? Mark Miller stated, Mr. Quinto tried to have his property May 21st, 2014. He is entitled to do this every twelve months. His business was zoned Business B back before the zoning change in 2006. He feels that when the zoning changed, he lost property rights. It is Neighborhood Mixed Use now and he would like it to be Main Corridor Commercial. He feels that is more resembling to what he had before. There have been no significant changes in the area. We are just looking at his parcels. We are not looking at Morgantown Avenue or anything else. Commission Weber asked, didn’t we have 46 people sign a petition against this last year? Vice President Aron Majic added, Mr. Quinto is saying it was down-right illegal to change the zoning of his property. 2 Commissioner Weber said, then we need to have Mr. Sansalone at the hearing. Vice President Majic added, that was an excellent suggestion. I have a feeling he will be here. Commissioner Richardson said, but until someone or something wants to move into that area. What is the difference? Mark Miller stated, his request in the application was his auto use was non-conforming but with the changes we just passed in May, it’s conditional which makes it a conforming use and in Main Corridor it is conditional as well. Commissioner Weber asked, what does he want to do with the property that he’s not already doing? Vice President Majic stated, I asked him last time and he said it’s his right not to disclose that. We can ask him. Mark Miller said there was a lawsuit naming Jay Rogers, Kathy Wyrosdick, Ron Straight, and Bill Oliver. There was some sort of timing issue and the lawsuit had to be dropped. He made a mistake. So that is why we are hearing this again. So that he can reinstitute that lawsuit. Staff Updates: A. Owens-Illinois’ rezoning Mark Miller said this went through City Council with flying colors. Hopefully, the remediation process will do the same and we will have some new business over off of Speedway Avenue. B. Commissioner Pitman has agreed to serve another term ending September 17, 2018. Mark Miller announced that John Pitman’s term ends tomorrow but he has agreed to stay on with us for another three years. Thank you, John. C. Commissioner Majic’s term expires September 17th. He has decided to take Kevin McClung’s place on the BZA. Aron’s brother Ryan will be taking his spot on the Planning Commission. Commissioner Weber wished Aron Majic the best with the BZA. You will be missed and appreciate all your work you have done with the Planning Commission. We also welcome his brother, Ryan to the Planning Commission. Vice President Majic said, thank you. It is very nice of you to say that. Commissioner Houston added, it was fun while it lasted. Mark Miller added, Kevin McClung has decided to step down so Aron has decided to give the BZA a shot. His brother will be taking his place here. That will all take place next month. ADJOURNMENT Vice President Majic asked for a motion to adjourn. Commissioner Richardson made a motion to adjourn. Commissioner Weber seconded it. 3
