FAIRMONT PLANNING COMMISSION The meeting of the Fairmont Planning Commission was held June 22nd,2022 @ the Public Safety Building 500 Quincy St. Fairmont WV. President Greene called the meeting to order at 7:00 p.m. and asked for a roll call of members. ROLL CALL OF MEMBERS MEMBERS PRESENT MEMBERS ABSENT Commissioner Lambert Commissioner Bledsoe Commissioner Richardson Commissioner Jura Commissioner Straight Commissioner Wean Commissioner Yann President Greene Commissioner Majic arrived at 7:05, Commissioner Straight arrived at 7:10. CITY STAFF Director of Planning and Development – Shae Strait Senior Staff Assistant –Kirstin Poluck APPROVAL OF MINUTES from May 25th,2022 President Greene asked for everyone to read of the previous months minutes and look for corrections or additions. With no corrections or additions indicated. A motion was made by Commissioner Richardson to approve the minutes. Commissioner Majic seconded he motion. All in favor. Motion Passed. NEW BUSINESS / PUBLIC HEARINGS TO SET FOR June 15th, 2022 PC 22-07 – Major Subdivision – Matthew Bainbridge is petitioning to merge five parcels along Henry Dr, Coleman Ave, Woodside Dr, and Worthington St totaling 15.411 acres. These parcels are Tax District 3, Map 14, Parcels 64, 65, 66, 104, and 105. Planning Director Strait stated that the petitioner has applied to merge 5 parcels rather than divide them out. The petitioner currently resides at the neighboring property. At this time there has been no submission for anything other than the merging of the parcels. If at a later date there is a plan to develop the land, the petitioner will have to come before the Planning Commission and residents will be notified. President Greene asked if there was any one in favor of the request to speak in favor of the request. Mr. Bainbridge, the petitioner was there to speak in favor of the request. He stated that he had acquired the property and wished to combine the parcels into one large lot. As of now that would be the only plan he has for the lot. President Greene then asked if there was anyone there opposed to the request. Beverly Gouzd of 902 Henry Dr came to speak against the request. She stated that she was worried the property would be developed and that the storm water and water runoff would become an issue. Mr. Daniel Serge, of 901 Country Club Rd also came to speak in opposition. He reiterated the same concerns of Ms. Gouzd. He stated concerns of water runoff and storm water issues if there was to be future development. He questioned whether the City of Fairmont would be able to handle the stormwater from a new subdivision. President Greene stated that as of now there has only been a request to combine to lots and nothing else. If there was a plan in the future to do something else with the lot there would have to be another public hearing. Planning Director Strait stated that if there was ever a plan to develop the property then all the issues such as storm water and water runoff would be addressed then. William Cox, who lives on the corner of 965 Coleman, he stated he didn’t have any concerns, but that when the survey was done, there was a portion of his house and landscaping that was inside of the petitioner’s property. Director Strait stated that was of no one’s fault and this would be an issue that would be settled between the homeowners. President Greene asked if there were any more questions. There were none, he then closed the public hearing. Commissioner Richardson made a motion to approve the subdivision request. Commissioner Straight seconded the motion. Roll Call Vote: Commissioner Greene- Yes; Commissioner Jura- Yes; Commissioner Lambert- Yes; Commissioner Majic- Yes; Commissioner Richardson- Yes; Commissioner Straight- Yes; Commissioner Wean- Yes; Commissioner Yann – Yes; Motion approved and the major subdivision approved. PC 22-08 – Text Amendment – City of Fairmont is petitioning to amend the zoning code to create regulations pertaining to Accessory Dwelling Units and establish which zoning districts such structures shall be permitted in. President Greene opened the public hearing by asking if there was anyone there to speak in favor of the request? There was no one. He then asked if there was anyone to speak against the request. There was no one. Commissioner Wean asked why City Council was again the ADU’s on the General Residential District. Planning Director Strait stated that Council was concerned about rental properties increasing and the passage would create noise, and traffic issues. President Greene makes a motion to forward the request on to council. Commissioner Lambert seconds the motion. Roll Call Vote: Commissioner Greene- Yes; Commissioner Jura- Yes; Commissioner Lambert- Yes; Commissioner Majic- Yes; Commissioner Richardson- Yes; Commissioner Straight- Yes; Commissioner Wean- Yes; Commissioner Yann – Yes; Motion approved to favorably forward the amending of the zoning code. ADJOURNMENT President Greene asked for a motion to adjourn meeting. Commissioner Straight motioned to adjourn the meeting; Commissioner Richardson seconded the motion. All were in favor. Motion approved.
